Dear Mr. McCann
This letter is to request modification to two items previously approved or suggested by the Design
Review Board for Pinch.A-Penny's new store at 651 Court Street.
The first item is the wrought iron enclosure which had been proposed for the front and east Side
of the building My insurance company has recommended against the wrought iron enclosure, for
safety and security reasons Therefore, I am requesting that the Design Review Board approve a
metal overhead gate gnU enclosure commonly used in shopping malls. This enclosure will proVide
a more secure and safe environment for both the store property and the general populace. Unlike
the wrought iron enclosure, the overhead gate will not offer the opportunity for someone to stick
their head between the openings and become stuck The gate will roD up out of view during store
hours The overhead gate enclosure system is more expensive than the previously approved
wrought iron design, however, I believe that overall it is a better means to enclose the area.
Therefore, I request the Board' s approval to mstall the overhead metal gate in lieu of wrought
iron.
The second item is the green-coated fence The original fence design called for a chain link fence
covered with ivy. It will take about two years for the ivy to completely cover the fence The
green coated fence material is more expensive than the standard fencing and, in my opinion, is not
justified, when in time a green coating of ivy will provide sinular benefits The cost for the

applicant proposes to extend an eXIsting entranceway canopy, and create new bUSiness
Identification slgnage to tie In with that of the adjacent uses In the same bUilding The Design
ReVIew Board preVIOUSly approved slgnage and design for the adjacent uses Clearwater HOUSing
Authority (CHA), and LeVison Community Center Refemng'to a site plan and elevation drawang,
Mr McCarty said the proposal effectively Integrates existing slgnage for a unified appearance
Staff felt conditions support the request and recommended approval
In a letter dated March 4, 1997, CHA Executive Director. Deborah Vincent, expressed full

Mr McCarty presented background Information and staff recommendations, stating the
applicant has submitted amendments to a plan preVIously approved by the board at the beginning
of the year He has worked extensIVely with the proJect's architect In an attempt to bnng the
proposed design changes Into closer conformity WIth what the board prevIously approved Among
the changes to the plan, It was noted the onglnal proposal to remove the front 32 feet of the
eXIsting bUilding to create a covered outdoor display area has been WIthdrawn
Robert Aude, architect representing the applicant, explained the architectural considerations
as presented at the January 14 meeting, compared to the current proposal The onglnal plan had
been to remove a badly detenorated front portIon of the eXIsting building The new bUilding design
had received ORB approval, but the board had requested the applicant to come back with certain
site plan amendments and a landscape plan After obtalmng the appropnate permits and
proceeding WIth the demolition and Intenor work, It was discovered the front 32 feet of the buildIng
was not as detenorated as had been suspected The deciSion VIlaS made to reVIse the design to
retain the eXIsting roof deck and columns on the north wall, to retain the value of the structure and
prOVide additional outdoor merchandise display area
Mr. Aude explained the amended proposal is for ornamental CIrcular form metal gnllwork
between the columns In the prevIous WIndow openings, with open spaces on the north and east
sKies for customer access A new roof WIll be bUilt with open, flat gables on the east and west
ends ThiS WIll allow suffiCient vertical area for slgnage on the east wall, for mBXImum exposure to
westbound Court Street traffic He explained the sign code reqUires a roof pitch greater than
12 12 to aVOid haVing slgnage being considered as roof slgnage The colors WIll remain as In the
anginal proposal shades of gray, white with dark gray accents, and blue shutters. Heavy textured
roof shingles will be multt.toned gray for compatibility with the Mure tram station roof The
applicant Wishes to have a professionally painted, non.commerctal mural on the east wall The
mural WIll not advertise the subject bUSiness He requested approval of the architectural desIgn so
work may continue because the applicant IS anXIous to proceed WIth the current design
Board diSCUSSion ensued Concerns were expressed the current proposal bears little
resemblance to the charm of the onginal proposal Speclfical~ 1) a shingkKi, gable roof IS not
compatible Wtth the train station or nelghbonng propertIeS, 2) staff was not aware the train station

Lengthy diSCUSSion ensued regarding whether or not the work that has been done was In
accordance with the demolition and Intenor construction permit, and whether the motion to
approve the onglnal plan had reqUIred a landscaping plan Reading from the January 14 minutes,
Mr McCarty indicated the approval related to the bUilding alone, and that landscaping and slgnage
would be brought back as separate applications DISCUSSion resumed regarding 1) slgnage
placement. 2) concern the setback has been ehmlnated, 3) charm of the onglnal plan contrasted
with the lack of continuity of the new plan, 4) the purpose of the board not being to legislate
aesthetiCS, 5) reiteration of diSCUSSion regarding the decISion not to demohsh the front 32 feet of
the bUilding, 6) use of the unsecured front area for spa display, 7) the board's preference for the
hip roof deSIgn that reflected the traIn station's roof, and 8) the need for the site to look mce due to
Its high VISibility location
Mr McCarty explained It IS the property owner's nght not to demolish a portion of hiS buildIng,
and the board should conSider altematlVe design solutions However, he reiterated concerns the
new proposal does not Incorporate any elements from the previous deSign Nothing has been
submitted regardIng landscaping, stormwater retention, color samples, or design features
reflecting the train station He was encouraged to hear the mural proposal Will be coming back, to
give the board an opportunity to offer suggestJons regarding use of colors and use of a three-
dimensional pattern down the long eastern expanse Concerns were expressed with the use of
shingled roofs and dISCUSSion ensued regarding other types of roof matenals that would appear
more appropnate to preserve the hlstoncal appearance of the adjacent train station
Mr Aude pointed out he has to work wrth the client's desires, but he IS open to suggestions
He Will take board and staff suggestions to the client regarding. 1) prtchlng the roof to match the
train station, 2) plaCing signage on the band below the fascia, 3) creating smaller scale decoratIVe
devices to reflect ornamental detatls on the train station, 4) attentton to a more pedestrian friendly
floonng surface In the front courtyard entryway, and 5) more attention to scale and color at street
level He could not guess what the Mure holds for the mural or train station deSign He Indicated,
If hiS suggestions would moderate the board's concems, and potentIal vote, he would ask for a
continuance to consult wrth hiS chent and bnng back an amended plan DISCUSSion ensued
regarding what the board would request in order to hear thiS request again Strong concerns were

surrounding lot conditions, City parlong requirements, and the proposal to fit 13 parking spaces
between the bUilding and the train station He said the City Traffic Englneenng Department has
approved the parking plans Mr Hams said the EnVironmental OffiCial Indicated, SInce no
landscaping eXists on the mostly ImpeMous site, none wlll be required Upon learning thIS,
Mr Hams saId the owner directed him not to prepare a landscaping plan Refemng to the pmns,
he poInted out where planters Will be placed, and diSCUssed the SWFWMD exemption to the
stormwater retention process Mr Hams responded to questions and diSCUSSion ensued
Board members expressed strong opposrtlon to the concept of having no landscaping, In vteW
of the fact the plan calls for parking lot resurfacing Staff was requested to Investigate how the
Unity of Title affects the landscaping reqUirement, because the train statIon property IS not
imperviOUs It was indicated the location proposed for the planters IS within the City nght..of-way
DISCUSSion ensued regarding vanous locatIons where landscaping matenals could be planted
WIthin the overall site The board reiterated again their request for a landscaping plan
Concern was expressed with a turnout being left open for overflow parking on the adjacent
unpaved vacant lot to the south The applicant was requested to reconfigure two perpendicular
parking spaces on the south end of the lot, to aVOid the danger of someone backing out the wrong
way and trying to eXIt through the one-way entrance It was Indicated clOSing the turnout would
allow enough room for three parking spaces, to avoid the applicant having to ask for administratIVe
approval of a minor parking variance Concern was expressed wrth the appearance of double steel
posts In front of each parking space to stop damage to the columns on the train station It was
Indicated the paoong spaces are long enough to allow the addition of a curb, or curb stops to stop
cars from hitting the bulldmg The board strongly urged removal of paving along the east wall of
the Plnch-A.Penny building to allow landscaping at the base Mr Hams indicated the applicant
did not want to have vegetation groWing up in front of the mural, and the Sidewalk along the base
of the wall was to aVOid having customers walking behind parked cars
DISCUSSion ensued regarding the dumpster area the City's reqUirement, who has the
authority to decide on the location, the need to provide adequate screemng, and the board's desire
to have dumpster locatIons determined by the design planners, Instead of the Solid Waste
DIVISion
No verbal or wntten support or opposition was expressed.
Member Pllsko moved to continue ORB 97..()()1 (amended) to the next meeting to allow bme
for the applicant to bnng a color elevation of the proposed bUilding, a landscape plan, and a site
plan addressing the follOWing board concerns. 1) making no use of the property to the south:

4) changmg the two rear parktng spaces to a diagonal alignment, and 5) answenng whether or not

Badcock Furniture Store located at 651 Court Street These are submitted for

A summary of this project IS as follows
1) Proposed use of the bUilding shall be a retail store for Pinch A
Penny Inc It IS the owner's Intent to conform With design
gUidelines In the downtown district to the greatest practIcal

be removed to be replaced by entrance patio and covered canopy

We are transmitting 10 caples of revised floor plans, elevations, and site
plan for renovations to 651 Court Street In downtown Clearwater This
Will confirm our prevIous telephone conversations regarding reVISions to
this design which have been requested by Pinch A Penny Stores
As you know, this project was submitted for design review by the Board
on January 14, 1997 At that time the proposed design Involved
demolition of a substantial portion of the North section of the eXistIng
bUilding DRB approved the project related to the bUilding only With a
request that site plan and landscaping be submitted for approval at a
subsequent heanng
PermIts were Issued for the bUilding only and demolition proceeded As
demolition began, PInch A Penny Stores felt that more of the eXisting
structure should be retained to allow for an extenor covered "courtyard"
designed to access the North entry to the bUilding ThiS approach caused
a substantial reVISion to the North and East elevation of the building.
We respectfully request that the Design Review Board exalTJlne these
drawings In preparation for a presentation scheduled for March 11th. At
that time, both the architects and site planners Will be present to explain
thiS reVISIon and answer any questions the Board may have

response Code of OrdInances Section 36038 provIdes authonty for the ORB to
consider and act upon applications I beheve you have a copy of thiS Section as well
as the Design GUidelines for Downtown Clearwater, whIch our office previously
forwarded to you In addition to the above documents, the Board has promulgated
Rules and Regulations and has approved a Design RevIew Process descnptlon, these
deal more directly With the Staff Report I am enclOSing a copy of the latter two
documents for your Information.
Sectlon 36 038 provIdes that a property owner may appeal the Board's deCISion
In accordance With the procedures establIshed In Section 36065 As you Will note from
the enclosed copy of Section 36065, a notlce of appeal must be filed With the City
Clerk Within fourteen days of the deCISion of the board setting forth In detail the basIs
for the appeal, and payment of any applicable fee must be made I hope that the
