day's finale shtp berthing This will serve to mirumize the impact of the proposed use upon
surrounding properties
The applIcant has proposed to operate from 11 OOam untIl 12 30am on 'Y(e_e]CJiays and I OOam
until I 30am on the weekends This represents a change from the previous conditional use
approval which required that the cruise ship be berthed by 12 30am on Fnday and Saturday nights
and by 11 30pm the remamder of the week The marina in which this use IS located is surrounded
by residential uses The previous conditional use approval identdied specific hours of operation in
the effort to mirnmize the Impact of the proposed use on these surrounding properties The
community surroundmg the proposed use has not change since the original conditional use
approval in 1994 Accordingly, the altered hours of operation proposed by the applicant are noL
consistent With the residential uses in the surrounding community It would be consistent With the
welfare of the community to maintain the previous condition that states the ship shall be berthed
by 12 30am on Fnday and Saturday nights and by 11 30pm the remainder of the week
s. Is the proposed use compatible with the surrounding properties and will the proposed use
result in increased demands on public facilities (Section 41.033(6));
The applIcant intends to continue to operate in the same manner as the existmg cruise line
previously approved at this location Accordmgly, this change in business ownership will not
result in an increased demand on public facilities
There are several commercial divmg and fishing businesses that operate ITom Clearwater Bay
Marina A cruise ship is compatible WIth these commercial uses The proposed alcoholIC
beverage use will not occur until such time that the slup eXIsts the manna Accordmgly, dus wtll

Staff has reviewed this applIcatIOn for a Conditional Use Pemut to allow a nightclub (change of busmess
ownerslup) at 900 N Osceola Avenue Based on the following findings of fact, staff has deternuned that
the proposed use meets the standards of re.~iew as set forth in Sect10n 41 033 of the Land Development
Code Staff recommends APPROVAL of this request subject to the folloWIng conditions of approval

1 The applicant shall obtam the requiSite occupational license WItlun six months from the
