7 to the north. Lots 1 thru 8 and the north four (4) feet of lot 9 are developed WIth a commerCial
bUIlding, most recently housing the Mernll Lynch business offIce Upon survey of the property, it was
found that the budding encroaches a httle less than four (4) feet onto Lot 9 Therefore, It IS
requested that the lot be so divIded In order to unencumber the property for tItle purposes for the two
separate owners The owner of the southerly portion of Lot 9 also owns lot 10 directly adjacent to
the south of Lot 9

COURT SQUARE SUBDIVISION REDIVISION
Applicant is the present owner of Lots 1, 2, 3, 4, 5, 6, 7
and 8, Court Square, a subdivision, located in the City of
Clearwater, Florida. There is presently a commercial building
located on said property, most recently housing the Merrill Lynch
business office. Upon survey of the property, the building
encroaches less than four feet onto Lot 9 of Court Square which
is immediately adjacent. Applicant proposes to acquire the
Northerly four feet of Lot 9 to encompass the improved portion of
Applicant's property, leaving the remaining portion of Lot 9,
along with all of Lot 10 of Court Square, in the ownership of
Robert J. Burnside and Margaret Word Burnside, his wife. There
are no contemplated additional physical improvements to either
parcel at this time.
It is the intent of Applicant to sell the property as
redivided as an exist~ng unit to a proposed purchaser. This
division of property will result in no administrative burden on
the City of Clearwater and is in accordance with the City Code.

(1) The pubhc acqUIsItion of stnps of land for the wldenmg of eXlstmg streets
(2) The reverSIOn, combination or recombmatlOn of portions of prevIOusly platted lots
where no new parcels or residual parcels are created which are smaller than any of
the ongmal lots or less than the mmllnum lot al ea reqUIrements as set forth III
chapter 135, "Zonmg Dlstnct Regulations"

transference neither reduces any lot or h act to all 81 ea or a Width less than thlll

Sec. 133.030. Administrative plat approval; condominium plats and lot divisions.
(a) COl1dommwm plats Before any condOllllnlum plat IS filed of recol d m the office of the
clerk of the county caUl t, a copy of the ground level survey drawmg shall first be ')ubmltted to
the city engmccr for deternllnutlOl1 that all reqlllslte easements al e propclly delineated on
the plat, all ')tI eet'l al C propclly namcd Without dupiLcatlOll, and the plat compol ts With othcl
engmeermg practices of the city
(b) Lot dwtSlOflS Mmor subdiVISIOn plat adJuc;tments may be approved by the city man-
ager Without the reqtlll ement to replat It IS the objective of thiS prOVISion to enable a
slmphlied admmlslrah ve process whel eby owners of prev lOusly platted property may further
diVide such property according to the followmg process Without filing an amended plat
(1) The CIty manager IS hereby authOllzed to review and approve or dIsapprove the
further dIVISIOn of platted property
(2) Acllon by the city manager to approve or dIsapprove such diVISIOn of platted property
shall be limited to the followmg
a Not more than two (2) new or pi eviously platted tracts or lots are affected
b No new street or alley i" proposed or additional rlght.oC-way is needed.
c No vacatIon or ehmmatlon of streets, alleys, setback hnes, access control or
easements IS reqUIred or proposed
d Such actlOn Will not result m slgmficant mcreases in service reqUIrements or
mterfere With mamtammg eXlstmg service levels
e All easement reqUIrements have been or will be satIsfied
f Such spht wlil not result m a tract or lot Without direct access to a street
g A nonconformmg situatIOn Will not be created
In grantmg approval, the city manager may Impose such conditIOns and restrictIOns upon the
property as determined necessary to carry out the Intent and purpose of thiS chapter and the
development code The cIty manager may, at hiS discretIOn, reqUIre any diVISIOn or comblna.
tion of preVIOusly platted property to comply With the full platting process where the condi-
