PLANNING & ZONING BOARD MEETING
TUESDAY, MAY 5, 1992 - 1:30 PM
PLEDGE OF ALLEGIANCE
INVOCATION
Members Present: Chairman Mazur, Messrs. Bickerstaffe (left at 1:35 and returned at 1:39), Carassas, Hamilton, Merriam and Savage
Members Excused: Ms. Martin
Also present: Scott Shuford, Planning Manager
Pat Fernandez, Recording Secretary
Chairperson Mazur outlined the procedures for conditional uses and advised that anyone adversely affected by a decision of the Planning and Zoning Board, with regard to conditional uses,
has two weeks from this date in which to file an appeal through the City Clerk's Office. Florida Law requires any party appealing a decision of this Board to have a record of the proceedings
to support the appeal.
ITEM
A. APPROVAL OF MINUTES
Approved (motion by Mr. Hamilton, second by Mr. Carassas) minutes of April 14 and April 21, 1992 with one correction. Motion carried unanimously (6 to 0).
B. REQUESTS FOR EXTENSION, DEFERRED AND CONTINUED ITEMS:
1. (Continued from 04-21-92) Lots 2 thru 8 and 1/2 of vacated alley on west, Blk A, Replat Clwr Beach Park 1st Add (470 Poinsettia Ave) B.J.E., Inc. (Bungee Maxx), CU 92-26
Request - To permit: (1) Outdoor commercial recreation/entertainment; (2) Temporary retail sales and display (bungee jumping); and (3) Temporary building - use not identified in Code
(bungee jump support, assoc. retail)
Zoned - CB (Beach Commercial)
Mr. Carassas announced a conflict and did not participate in the discussion or vote.
Mr. Shuford gave the background of the case and submitted, in writing, the staff recommendation.
The applicant was not present at either this or the preceding Planning & Zoning Board meeting. To date, no appeal has been made of the DCAB decision.
Pro or Con: None
Motion by Mr. Hamilton, second by Mr. Bickerstaffe, to DENY the above agenda item. Motion carried (5 to 0) with one abstention.
C. CONDITIONAL USES:

The applicant's representative, Al Torchia, 1520 US 41, Lutz, FL., stated that he is currently building a house for the applicant on the property.
Recommended approval (motion by Mr. Hamilton, second by Mr. Carassas) to the City Commission of the proposed Annexation, Land Use Plan Amendment to Low Density Residential, and Zoning
Atlas Amendment to RS-2 as they appear to be supported by the Standards for Approval of Land Development Code Section 132.005, 137.015(e), 137.016(e). Motion carried unanimously (6
to 0).
E. CHAIRMAN'S ITEMS
There is a slight chance that at the June 30, 1992 Planning and Zoning Board meeting that both the Chairman and Vice Chairman will not be there. If this does occur, the rules provide
that the members in attendance shall select from among the members present one member to preside over the meeting. No other member stated he/she had other plans for that date. Vacations
will be discussed at the next meeting. sufficient members to attend each meeting.
F. DIRECTOR'S ITEMS
G. BOARD AND STAFF COMMENTS
Members expressed their well wishes to outgoing Recording Secretary Pat Fernandez.
The Sea Breeze Cafe which is in the Days Inn on Clearwater Beach, has enclosed their patio and draft beer is set up for serving there. Mr. Shuford stated that Code Enforcement will
check on licensing and permitting.
Another member inquired about the Cabana Club Restaurant at Sand Key. They are now open to the public and the board does not recall them requesting a conditional use permit. Mr. Shuford
indicated he would look into this matter.
