provIsions of the Cited code, sections 46 06(2) (a) and 46 06(b) are met
In the case presented herein, the applicants, Mr Gaylord Landahl, owner of the vacant lot
at 1528 Walnut Street, and Mr Jim Heyer, owner of the house and lot at 1532 Walnut
Street, Wish to confirm and record by administrative lot subdiVISion action, the eXisting
ownership of the two properties at 1528 and 1532 Walnut Street, consisting of lots 18 &
19 and the East 10 feet of lots 2 & 3, Block F, "Oak Hill S SubdivIsion,", PI at Book 7,
Page 66.
The proposed divISion of the four subject lots clearly meets conditions 46 06 (b) 2-6 of the
Land Development Code (attached) Condition 1 IS generally met In that not more than
two new tracts or lots are affected although four previously platted lots are affected
It IS hIghly desirable that the divISIon be allowed Without a legally recorded sub-diVIsion
of the properties Involved, building permits cannot be legally Issued at the vacant lot which
IS In the process of development by Mr Landahl for a Single family home and neither can
Mr Heyer make any Improvements to hiS property requIring the Issuance of bUilding
permits
In accordance With the above and based on the legal department reView, I recommend
and request your approval of this minor plat subdiVISion action as presented

County, Florida. She deSires to Increase the size of Lot One by the West 10 feet of Lot 2

Sec. 46.05. Administration, interpretation,
etc., of chapter.
The admmistration, interpretation and applica-
tion of the prOVlSlons oftius chapter not otherwise
specifically set out in this chapter shall be as set
forth 10 chapters 35, 36,39,42,43 and 45.

Sec. 46.06. Administrative plat approval;
condominium plats and lot divi-
sions.
(1) Condommlum plats Before any condomm-
ium plat IS filed of record in the office of the clerk
of the county court, a copy of the ground level
survey drawmg shall first be submitted to the City
engmeer for determmation that all requiSite ease-
ments are properly delineated on the plat, all
streets are properly named Wlthout duplication,
and the plat comports with other engineering prac-
bces of the city,
(2) Lot divr.sions. Mmor subdivision plat adjust-
ments may be approved by the City manager Wlth-
out the requirement to repIat It 18 the objectIve of
tlus proviSion to enable a stmplified admmistra-
tive process whereby owners ofprevtously platted
property may further diVlde such property accord-
ing to the foHoWIng process WIthout filing an
amended plat:
(a) The Clty manager is hereby autbonzed to
reVIew and approve or disapprove the fur.

(b) Amon by the city manager to approve or
dIsapprove such diVlsion of platted proper-
ty shall be limited to the followmg-
1. Not more than two new or prevlOusly

ter and the development code, The ctty man-
ager may, at his dtscretion, require any
division or combination of previously plat-
ted property to comply with the full plat-
tIng process where the conditIons of the in-
stant case warrant.

(1) Applreatwn Any request for a variance from
the proVISions set forth 10 this chapter shall be
made in wnting and be submitted to the develop-
ment code admtnistrator concurrently with the pre-
bmmery plat Such written request shall state
fully the grounds for the variance request and all
facts relied upon by the petItioner The develop-
ment code admimstrator shall identify for the de-
velopment reVIew committee the variance wmch
IS being sought at the time the committee IS con-
Sidering the preliminary plat
(2) Detenmnatwn Vanances may be granted
by the development review committee m approv-

Sec. 46.05. Administration, interpretation,
etc., of chapter.
The admInistratIon, interpretation and applIca-
tion of the proVIsions of this chapter not otherwise
specifically set out in tlus chapter shall be as set
forth m chapters 35, 36,39,42,43 and 45,

Sec. 46.06. Administrative plat approval;
condominium plats and lot divi-
sions.
(1) COndOmLnlUm plats, Before any condomin-
Ium plat is filed of record in the office of the clerk
of the county court, a copy of the ground level
survey drawmg shall first be submitted to the city
engineer for determination that all requisite ease-
ments are properly delineated on the plat, all
streets are properly named without duplication,
and the plat comports WIth other engmeenng prac-
tices of the city.
(2) Lot diIJiswns Minor submVlSion plat adjust-
ments may be approved by the City manager wtth-
out the reqUlrement to replat It IS the objective of
this proVlSJOn to enable a sunphfied adminIstra-
tive process whereby owners of prevIOusly platted
property may further divide such property accord-
ing to the followmg process without filing an
amended plat:
(a) The city manager is hereby authonzed to
reVIew and approve or chsapprove the fur-
ther diVlslon of platted property

(b) ActIon by the city manager to approve or
disapprove such diVISion of platted proper-
ty shall be wmted to the following-
1. Not more than two new or previously
platted tracts or lots are a1fected
2 No new street or alley is proposed or
addItional ngbt-of-way is needed.
3. ITc vacation or elinunatIon of streets

alleys, setback lines, access control or
easements is reqUlI'ed or proposed.
4. Such action WIll not result m Signifi-
cant increases In service requirements
or mterfere Wlth maintaming exIsting
semce levels
5 All easement requirements have been
or will be satisfied.
6, Such split will not result in a tract or
lot Wlthout direct accesg to a street.
7. A nonconformIng situation will not be
created.
(e) In grantIng approval, the city manager may
impose such condibons and restrictions upon
the property as determined necessary to car-
ry out the intent and purpose of this chap-
ter and the development code. The city man-
ager may, at his discretion, require any
division or combinatIon of previously plat-
ted property to comply Wlth the full plat-
ting process where the conditions of the in-
stant case warrant

Sec. 46.07. Variances.
(1) Appltcatu:m. Any request for a variance from
the proVIsions set forth In this chapter shall be
made 10 wnting and be submItted to the develop-
ment code administrator conCUITeIltly with the pre-
LImmary plat. Such written request shall state
fully the grounds for the variance request and all
facts relied upon by the pehtioner The develop-
ment code adnllntstrator shall Identify for the de-
velopment reVIew committee the variance wluch
IS bemg sought at the time the committee is con-
sldenng the prelimmary plat.
(2) Detemunatwn. Vanances may be granted
by the development review commIttee 10 approv-
