ANALYSIS CODE elT A TIONS ~ STANDARDS OF APPROVAL In reviewing this application for a conditional use permit to allow a tavern at 2551 Drew Street where the sale and consumption of alcoholic beverages (beer and wine) shall take place, the Planmng and Zoning Board shall conSider the following analysIs and make the following determinatIon' 1, Is the proposed conditional use In conflict with any section of the City of Clearwater Land Development Code (Section 41 033 . 21; The proposed use compiles wIth all other applicable Sections of the Land Development Code 2. Is the proposed use In compliance With applicable conditional use general and supplementary standards of approval (Section 41,033 - 3); The proposed use complies with all other apphcable conditIonal use general and supplemental standards of approval In particular, thiS proposed use compiles with Section 41 052 (2) - acceptable Ingress/egress from the Site, (3) - noIse generated from the use shall not unreasonably diminish the use, enjoyment or value of surrounding properties, (4) - the glare and direction of lights from both motor vehicles and illuminating fixtures on the site shall not adversely affect surrounding properties, (6) . suffiCient parking IS prOVided and (7) the use IS consistent WIth the community character of the propertIes surrounding thIS use 3. Will the proposed use adversely affect the property values in the area (Section 41,033 - 5), The proposed use IS not antiCipated to adversely affect the property values In the area surrounding the proposed use due to the fact that the other properties In the area are commerCial In nature or far enough removed from the Site as to not be affected 4. Is the proposed use consistent With the community welfare (Section 41.033 - 41; The granting of thIS conditIOnal use IS not antiCipated to generate excessive nOIse or negatively contribute to the pubhc's ability to utlhze surrounding properties. The applicant has indicated that there will be no types of entertainment at thiS sIte - Indoor or outdoor The hours of operatIon have been listed by the apphcant as 7 00 AM - 10 00 PM Monday through Sunday ThIS should not result In an adverse Impact on nearby properties 51 Is the proposed use compatible With the surrounding properties and will the proposed use result in increased demands on pubhc faclhtles (Section 41.033-6), The subject property IS located directly on Gulf to Bay Blvd, directly across from a a-Lube and next door to a gas station Any reSidential actiVities are far enough removed from the site such that the proposed accessory use will not have any Impact on them The proposed use IS compatible With these eXisting uses as well as the mtent of the General CommerCial ZOMlng Dlstnct. Furthermore, grantlng of thiS conditional use IS not antiCipated to result In an Increased demand on pubhc faCIlities 6. Is the proposed use conSistent with the land use plan (Sectlon 41 .033 -1 ); The proposed use IS consIstent With the land Use Plan C FINDINGS OF FACT . Whereas, the proposed use IS conSistent with the Intent of the Land Development Code for the City of Clearwater, . Whereas, the proposed use IS located directly on a major cOrridor and IS surrounded by vanous types of commerCial uses, . Whereas, the proposed use will be an accessory use only and IS not Intended to be or become the primary use, . Whereas, residential uses which are m the VIClntty of this establishment are removed to such a degree that this proposed Accessory Use Will have no Impact upon them, . Whereas, the proposed use will not have an adverse Impact on any surrounding properties, and . Whereas, the applicant's property had received a Conditional Use permit to allow Package Alcoholic Beverage Sales as an accessory use on December 2nd, 1997 D. STAFF RECOMMENDATION Staff has reViewed this applicatIon for a Conditional Use Permit to allow an Accessory Use. Package Alcoholic Beverage Sales at 2999 Gulf to Bay Blvd, Based on the Fmdlngs of Fact, staff has determined that the proposed use meets the standards of review set forth In Section 41 033 of the Land Development Code Staff recommends APPROVAL of this request subject to the follOWing conditions' CONDITIONS OF APPROVAL 1. This ConditIOnal Use Permit IS based on the apphcatlon, testimony, and documents submitted by the apphcant, Including maps, plans, surveys, and other documents In support of the request Deviation from any of the documents beyond the scope expressly authorized by the Board In approval of this vanance, Will result In this vanance being null and of no effect, 2, The sale of alcoholic beverages shall be hmlted to package sales with no consumption on premises, 3, There shall be no outdoor entertainment, seatmg or speakers, and 4, The applicant shall obtain a State of Flonda Alcoholic Beverage License within SIX (61 moths of the date of this pubhc heanng. 5.
