Section 4606(2) of the Clearwater Land Development Code allows City Manager approval
of minor subdivIsion plat adjustments without the need to replat , providIng that the
provIsions of the cIted code, sections 46 06(2) (a) and 46 06(b) are met
In the case presented herein, the applicant, Wendy's International, Inc purchaser of a -
proposed outparcel from Wal-Mart at Loehmanmn's Plaza, wishes to establish and record
by administrative lot subdivIsion action, the creation of the outparcel on which they are
locating their fast food restaurant at 23072 U IS Highway 19 N, consisting of a portion of
lot 1 of Loehmann's Plaza Replat, Plat Book 109. pages 13 & 14.
Staff review has established that the proposed creation of the subject lot clearly meets
conditions 46 06 (b) 1-7 of the Land Development Code (attached)
It IS desirable that the divIsion be allowed as proposed This subdivIsion action IS required
to allow the development of the Wendy's on the Wal-Mart site at Loehmann's Plaza as
approved by the CIty Commission and the DRC The applicant chose this allowed
administrative approach as a less time consuming and less costly method over the more

ARTICLE t. IN GENERAL
Sec. 46.01. Title.
Th1s chapter shall be known and may be CIted
as the subdiVlSion and condominium platting reg-
ulations and may be referred to in this chapter as
'"th1s chapter'" or '"these plattmg regulations..

Sec. 46.02. Purpose of chapter.
(1) It IS the fJurpose ofUus chapter to establish
a procedure and standards for the diVlslon of un.
platted property and the rediVlslon or recombma-
b.on ofpreVlously platted property so as to further
the orderly layout of property proposed to be dJ.

(3) It is the specific objectIve of this chapter to
establtsh a procedure and standards that are con-
sistent with the oty's comprehensive plan, and in
particular WIth the thoroughfare, parks and rec.
reation, environmental conservation, ubltty and
energy elements of the plan, including the street,
recreation/open space, enVIrOnmental protecb.on,
utility extensIon, energy conservab.on and related
pohcles and deSign guidelines of such plan ele--
ments.

ter.
(1) These platb.ng regulations shall apply to all
subdivisions and condommiums Wltlun the corpo-

(2) A subdivisIOn shall be any dlV1s10n or redi.

parcels for the purpose of transfer of ownershIp or
bUlldmg development Furthermore, a subdlVl-

(3) A condominium shaD be the partitioning of
single units in a multiple-unit structure for the
purpose of indiVldual ownership where there are
included commonly owned areas or facilities.
(4) Whenever any subdivision of land 18 pro-
posed, and before any site plan approval or build-
ing permit for the development of or constructJ.on
of any improvement on land proposed for subdi.

apply for and secure approval from the oty of a

(5) Whenever any condominium is proposed. be-
fore any bOOding permit or certificate of occupancy!

filed of record at the office of the clerk of the coun.

Sec. 46.04. Exemptions.
The followmg transactions shall be exempt from
subd1Vlslon and condominium plat review proce-
dures:
(1) The public acqwsIhon of stnps of land for
the WIdemng of eXlSnng streets,
(2) The reverslOn, combmatIon or recombma-
hon of portlOns of preVlously platted lots

where no new parcels or residual parcels
are created wln.ch alP smaller than any of
the ongmallots or less than the minimum
lot area reqwrements as set forth lD chap-
ter 40 which pertams to zoning;
(3) The transference of part of one lot or tract

transference neither reduces any lot or tract
to an area or a WIdth less than that speci-
fied lD chapter 40 nor contravenes any oth-
er development regulatlon contained. in tln.s
development code.

Sec. 46.05. Administration, interpretation,
etc., of chapter.
The administration, interpretation and applica-
tion of the provisions of this chapter not othel'WlSe
specifically set out in this chapter shall be as set
forth in chapters 35,36,39,42,43 and 45.

Sec. 46.06. Administrative plat approval;
condominium plats and lot divi-
sions.
(1) Condommtum plats. Before any condomm-
lum plat is filed of record in the office of the clerk
of the county court, a copy of the ground level
survey drawing shall first be submitted to the city
engineer for determination that all requisite ease-
ments are properly delineated on the plat, all
streets are properly named without duplicatIon,
and the plat comports with other engineering prac-
tices of the city.
(2) Lot divisions. Minor subdiVlSion plat adjust-
ments may be approved by the CIty manager Wlth.

ted property to comply WIth the full plat-
ting process where the condittons ofthe in-
stant case warrant.

Sec. 46.07. Variances.
(1) Applicatwn Any request for a variance from
the provisions set forth in this chapter shall be
made in writing and be submitted to the develop-
ment code adm.inistrator concurrently with the pre-
liminary plat. Such wntten request shall state
fully the grounds for the vanance request and all
facts relied upon by the pennoner The develop-
ment code administrator shall identify for the de--
velopment reVlew commIttee the vanance which
is being sought at the tune the comm1ttee IS con-
Sidering the prelumnary plat.
(2) Detenmnatwn Vanances may be granted
