B. ANALYSIS: CODE CITATIONS - STANDARDS OF APPROVAL
In reviewing this application for a conditional use permit to allow a restaurant at 1261 Gulf
Blvd. unit #129 where the sale and consumption of alcoholic beverages (beer and wine) shall
take place, the Planning and Zoning Board shall consider the following analysIs and make the
following determination:
1. Is the proposed conditional use in conflict with any section of the City of Clearwater land
Development Code (Section 41,033.2)1
The proposed use complies with all other applicable Sections of the Land Development
Code.
2. Is the proposed use in compliance with applicable conditional use general and
supplementary standards of approval (Section 41.033 - 3)1
The proposed use complies with all other applicable conditional use general and
supplemental standards of approval. In particular, the proposed use complies with Section
41.052 (21 acceptable mgress/egress from the site; (3) noise that Will generate from the use
will not unreasonably diminish the use, enjoyment or value of surrounding properties, (4)
the glare and direction of lights from both motor vehicles and Illuminating fixtures on the
site shall not adversely affect surrounding properties, (5) sufficient landscapmg and
screening IS provided diminish noise, reduce glare and generally buffer the site from
surrounding uses, (6) sufficient parking is provided and (7) the use is consistent with the
community character of the properties surrounding this use and Will not have any
detrimental effect on those surrounding properties.

3. Is the proposed use consistent with the community welfare (Sec'bon 41 033 - 411
The granting of this conditional use is not anticipated to generate excessive noise or
negatively contribute to the public's ability to utilize surrounding properties. The hours of
operation have been listed by the applicant has Noon - 10:00 PM Monday through Fnday
and Noon - 11 :00 PM Saturday and Sunday This should not result In an adverse Impact on
nearby properties,
The use IS also consistent with the community welfare In that It contributes to the tOUrist
services in the area,
4. Will the proposed use adversely affect the property values in the area (Section 41.033. 5)?
The proposed use is not anticipated to adversely affect the property values in the area
surrounding the proposed use since there are already similar uses In the area, In fact, the
proposed use will benefit the surrounding resort and residential uses by providing upscale
dining close to home with no adverse Impact in terms of traffic generation, noise or light
pollution.
5. Is the proposed use compatible with the surrounding properties and will the proposed use
result in increased demands on public facilities (Section 41,033-611
The subject property IS located within a shopPing complex and IS surrounded by residential
and resort uses, The proposed use is compatible with the existing uses, While there are SIX
businesses within the retail complex that currently sell food and/or package goods, only
three of them are offer sit-down dining and only one (The Columbia) offers a more formal
dining expenence Fourteen of the twenty shops within the complex do not offer food or
beverages. Another dining establishment will benefit the residents and guests of Sand Key
by providing additional dining choices within walking distance of hotels and residences.
The granting of this conditional use is not anticipated to result In an increased demand on
public facilities, since the proposed restaurant IS located In an existing retail complex.

The proposed use is consistent with the Comprehensive Plan.

C. FINDINGS OF FACT
Whereas, the proposed use IS consistent with the Intent of the Land Development Code for the
City of Clearwater;
Whereas, the proposed use IS located wlthm an eXisting shopping complex and IS surrounded
by resort, residential and commercial uses;
Whereas, the proposed use will not have an adverse Impact on any surrounding properties and
will benefit the residents of Sand Key and of Clearwater.
D. STAFF RECOMMENDATION
Based on the Fmdings of Fact, staff recommends APPROVAL of the request of Shop pes
Associated limited Partnership With the following conditions'
1. This Conditional Use Permit IS based on the application, testimony, and documents submitted
by the applicant, Including maps, plans, surveys, and other documents in support of the
request.
2. The applicant shall obtain an occupational license and certificate of occupancy withm SIX (6)
months from the date of this public hearing;
3. The sale of alcoholic beverages shall be limited to consumption on premises With no
package sales.
