The applicant requests approval to resubdivl.de Lot 5 and part of
Lot 6, Block A, Jos. J. Eldridge's Subdivision into two parcels,
both of which meet the dimensional requirements of the Single-
Family Residential 11 Eight II District (RS-8l. Both parcels will
front on Cedar Street. The parcel at the northwest corner of Cedar
Street and Osceola Avenue has the minimum required width of 70 feet
at the building setback line. This parcel has an existing
structure of approximately 1,680 sq. ft. Part of this structure
was formerly used as a garage. It is not clear How the remainder
of the building was utilized. The building does have a bath, and
apparently was used for sleeping quarters. It is proposed to
convert this structure into a single family residence. The owner
states that their intent is to utilize the building as Ilvl.ng
quarters for her parents. The building only has a setback of 6.76
feet from Osceola Avenue. This is less than the 25 feet required
for the RS-8 district. However, this is an existing nonconformity,
and is permitted to continue. The building meets the other
required setbacks for the RS-8 district. No new non-conformities
are being created, so this parcel meets the requirements for an
administrative lot split.
The applicant has constructed a six foot fence along the property
line on Osceola Avenue and Cedar Street except in front of the
house addressed as 203 Cedar Street. This fence does not comply
with the requirements of Section 42.26 of the Land Development
Code. The applicant intends to utilize the structure on the corner
lot as a dwelling for her parents. However, ~f the lot split is

approved, it will be constructed on a separate parcel and must be
a complete living unit; i.e., it must have its own bath, kitchen,
and living area. A "Certificate of Occupancy" (COl can not be
issued until the structure complies with this requirement, nor will
a CO be issued until the fence is brought into compliance.
The western parcel created by the proposed split meets all
requirements for an RS-8 district except for the setback from Cedar
Street. The existing structure has a setback of 14.49 feet, less
than the required 25 feet. This is an existing condition and is
not being changed, and therefore does not prohibit administrative
approval of the proposed lot split.
Along the north side of the property, the survey shows that there
are three structural encroachments. The applicant has agreed with
the bank to provide an easement permitting these encroachments, but
prohibiting the expansion or replacement of the encroachments.
This will be a benefit to the adjacent properties by removing a
cloud on their titles, and provide the applicant with documentation
to restrict further expansion of the encroachments. However, the
encroachments do not have any affect upon the proposed lot split.
The applicant's request meets the requirements for an
administrative lot split, and the staff of the Central Permitting
Department recommends your approval subj ect to the following
conditions:
(1) A certificate of Occupancy will not be issued until
A. A complete living unit, in accordance with all
City Codes, is completed, and
B. The fence along the property line is removed,
relocated, or brought into compliance with the
Land Development Code.
Please forward this memorandum to the City Clerk for certification
and distribution.

requesting permission to divide these lots into parcel 1 and
parcel 2.
a. Not more than two (2) new lots are affected.
b. No new street or alley is proposed or additional
right-of-way is needed.
c. No vacation or elimination of streets, alleys, setback
