understand how to proceed In future, and so that we can better applicants However, for now we Will not Withdraw any
other applications for annexation based on verbal disapproval of PPC or any other review authOrity We Will first adVise the
applicants and determine what course they would like to take They have the right to have their application heard, but also
need to know of any facts that may affect the outcome You and I discussed thiS after you had taken the steps to Withdraw
thiS case, and I asked you to contact the applicants I am sure that you have done so, but please confirm the contact, and
let me know what their response was Ultimately the applicant IS our customer In these cases, and we owe them the

In reference to your request, this e-mail contains the information about the case that was recently not supported by the
PPC for annexation Michael Schoderbock at PPC called me about this He stated that the property at 1446 Regal Road
was not contiguous to the City In regard to Ord No 00-63, Section 4 (6) (ThiS particular property IS catty-cornered to an
eXisting City property) Additionally, he stated that the r/o/w In front of the property, If annexed, could not be considered to
make It eligible, as the r/o/w could not be annexed solely to make the property contiguous
Cky has a similar case at 1424 Regal Road (ANX2006-02005) However, he received no negative comment from the PPC
when he sent the letter to PPC However, although It doesn't show up on Cky's map as It was not offiCial yet, another case
(ANX2005-11 037) was annexed by the second reading of ItS ordinance last night, thiS property lay directly across the
street from 1424 Regal at 1425 Regal Road The letter for the PPC for the 1425 address was sent to the PPC on
December 8,2005 Whether or not the PPC took thiS Into consideration when reviewing Cky's case (he sent his letter to
the PPC on February 17, 2006), I don't know I didn't want to bring It up when I talked with Michael S , as It would not have
been appropriate to have shared thiS Information at that time without knowing what the ramifications would be
