The subject parcells currently developed WIth a manufacturing use and an accessory
residence occupied by the owner. The owner IS in the process of having 26' of the
existing 60' wide Lakevlew Drive nght-of-way vacated in order to erect a six foot high
wooden security fence. Addttlonally, the owner may m the future, request to expand the
manufacturing use on site which would require a separate appl1cahon process. The City
of Clearwater has taken It upon itself to initIate the vacation request
Description of Request
To erect a SIX foot high wooden security fence within the front yard setback (along
Lakevlew Drive a.k a. Dempsey Street) in lieu of a masonryfbrick wall as required by
Section 3-804 A. 2. of the City Code and to not be required to provide a three foot wide
landscaped strip on the street Side of the fence as required in SectIOn 3~804 A 3
Written Submittal Requirements:
1. This proposal will be in harmony with the surrounding and adjacent
properties Although Lakevlew Drive (a.k.a Dempsey Street) IS technically a
front yard for this double frontage lot, It serves functionally as a rear yard for
the subject property, adjacent sites and serves functionally as a Side yard to the
two properties directly across the street Section 3-804 E would allow thts SIX
foot high wood fence by right if all properties across the street and adjacent to
the site utilized the frontage as a rear yard by function
2 This proposed wood fence and lack of landscaping will not hinder or
discourage appropriate development and use of adjacent lands as even though
a portion of Lakeview Drive (Dempsey) IS gomg through the vacatIOn process,
there will still be 24' of paved roadway for use by normal two-way traffic and
fire/emergency vehicles
3. The proposed SIX foot high wood fence Will not adversely affect the health or
safety of persons within the neighborhood Accordmg to the applicant, the
mam reason for the proposed fence IS to provide secunty for the subject site
which manufactures candy for use by Disney World and the PreSident of the
Umted States The applicant does not Wish to go to the expense however of
constructing a masonry wall or brick columns with grill work The lack of
proViding the required three foot wide strip of landscaping will not adversely
Impact persons witlun the neighborhood.
4 The proposed vacation deSign has been modified from the prevIous request m
order to provide the required 24' wide paved roadway that the City FIre

5. ThIs proposal is consistent with the commuruty character of the Imme<hate
vicimty as the adjacent properties and properties directly across the street do
not enjoy this right-of-way as a front yard
6 The erection of the proposed wood fence may actually help to buffer
surroundmg uses from any adverse eXlstmg conditions such as visual,
acoustic, olfactory and hours of operation Issues
Zoning District Criteria:
Section 3-804A.2 allows uses within the Commercial Zoning distrIct to have six foot
high masonry walls or masonry columns hoked by substantial gnll work within a
reqwred front setback. Although this particular frontage of this double frontage lot IS
technically a front yard It functions as a rear yard not only for the subject Site but also for
the adjacent sites and as a side yard for the sites directly across the street from the Candy
Factory
SectlOn 3-804 A 3. reqwres that any fence or wall exceeding three feet in height and
located within any reqUIred structural setback adjacent to a pubhc right-of-way proVIde a
three feet WIde landscaped strip on the street Side of the fence This partIcular sectIOn of
the Lakeview Drive (Dempsey Street) right-of-way functions as a rear or side yard for the
nnmedlate neighbors that would be traveling thts section. The lack of landscaping on the
street side of the proposed fence will not adversely unpact surrounding sites and would
be difficult to mamtain conSidering the locatIOn
Section 3-804 E would allow double frontage lots to enjoy the wood fencing proVided
that 1 ) The rear yards of adJ acent lots on the same Side of the street are oriented the same
as the lot on which the fence IS proposed; and 2.) The pattern of the dwelhngs across the
street is also oriented WIth the rear yard facing the lots across the street. Although all
properties along the Dempsey Street right-of-way do not utIhze their frontages along
Dempsey as a rear yard they will not be adversely impacted by the requested wood fence
and lack of landscapmg outside of the fence at this partIcular section of the road

I met With John Schodtler at the Zoning Counter today as to exactly what type of application will be
necessary for this project John said that I should double check With you Since Mr Rehm keeps telling me
that he discussed all of this With you and Ralph Stone awhile back
The City's Englneenng Dept (Steve Doherty) has taken over the initiation of the vacation of nght-of-way
request relative to this project We are hoping to submit the Site plan next week for the garage addition
All that It Involves IS the addition of a 658 sq ft garage With second floor open deck strictly for use by the
owner as part of his residence (he and his wife live upstairs above the office portion of the commercial use
Additionally, the owner IS proposing a SIX foot high wood fence for secunty purposes Within the area of the
row being vacated
John believes that thiS would be a Camp Inflll request as no asphalt IS bemg removed from the area bemg
vacated, CommerCial Zoning dlstnct does not allow wooden fencmg and because the proposed garage will
not meet required front and side setbacks We are not proposmg any other Improvements other than the
garage and fence
Is thiS then a comp mflll request? Mr Rehm states to me that you and Ralph Stone agreed to lei him keep
thiS simple Without any other Improvements being required at thiS pOint but when he IS ready 10 expand the
commercial use laler on he would be required to meet other reqUirements (landscaping, retention, etc

Btll-you had asked me last week to check on the status of Mr Rehm's sIte on Lakevlew I send the followmg
Informatton I met With Mr Rehm and Steve Spencer on January 14, 2004 and adVIsed them of the code
reqUIrements We dIscussed the possIbIlity of a way to phase the project smce he seemed to be m a hurry to do the
gat<Ige to ~erve hIS home on !lIte, and then do the commercIal Improvements later.
I referred hIm to Mike QUIllen regardmg vacation of the street behmd hIS sIte At my January meeting WIth hIm, I
explamed that the vacation process IS lengthy due to the revIew by all utllrry companIes and urged hIm to start that
process as soon as possIble. MIke's response IS below-Mr Rehm has not pursued the vacatton as of now

After heanng lus Interest<; In expandtng and the reasons behtnd the expansIons, Mr Rehm agreed to only do 2
expansIons a two -car garage to serve the second floor apartment that he and ills WIfe l1ve In and an addtnon to
one of the western bmldtngs (not the bmldtng west of the casement) to expand hlS storage and allow for secw:e
storage of raw matenals Ba<;ed on these two 1D1provements, I made the folloWlOg cotnmltments and suggestlons
1 Steve will prepare a two-phased project conslSttng of the above nnprovements, Wlth the first phase to be
the resldentllll garage and the second phase to be the commerctal expansIon PlanOlOg will consIder It a<; one sIte
plan but will allow the parktng/landscapIng/ dram age nnprovements to bc lOstalled Wlth the commcrcta! expanslOn,
and not reqwred 1f he only does the resldenttal garage They are aware that tlus IS hkely a CDB apphcanon due to

Anyway he IS extremely high on Diane - he wants to bUild hiS garage first so he can Increase hiS secunty (multiple
break-ms and shootmgs) as he now supplies to Disney and AIr Force One He would then expand onto the back of
hiS bUilding (candy factory) to facilitate hiS sugar dellvenes Finally once he has enough money he would do further
expansIOn
It seems from my perspective that he wants to stage hiS work, while plannmg feels different - by the way, I do not
know what Issues plannmg has with this request
He dtd mention to me that the commuMy IS well aware of the aggressIve pro-bUSiness attitude of ED, but that
developers stili hit a bnck wall wIth plannmg - for what ItS worth
He personally does not want to rnterface one on one wIth planning - feels he would lose It Use hiS architect Instead
