foot of deck that was added to an eXIsting permitted deck of approximately 2,500 square feet without pnor
permits The deck addition was performed to fill In a "gap" In the eXisting permitted deck The deck IS
used exclusively by the patrons of Shephard's Lagoon Resort There are no boat slips and boats are not
pe rmltted to moor at the deck Corrective meas ures for the deck addition are to get both City of elea rwater
and PlneUas County after-the-fact permits to bnng the entire deck structure Into compliance. Please note
that the Department of Environmental Protection (DEP), for corrective action, had Shephard's run a Public
Service Announcement In the St Petersburg Times stating that permits are required for the construction
of docks (St Petersburg TImes affidavit enclosed)

square feet. The total deck square footage IS 2,770 The deck addition was performed to fill In a "gap"
In the eXisting deck The deck IS used exclusively by the patrons of Shephard's Lagoon Resort
(b) Impacts on EXIsting Water Recreation ActIVities
The deck addition Will not create any adverse Impact on persons usmg the adjacent waterways for
recreational or commercial purposes The deck addition IS set back from the property to the east 158'
(120' setback from eXisting deck) and to the west 185', which are well In excess of required setbacks

The deck addItion Will have no detrrmentallmpact on users of the adjacent waters as the deck addition
extends out approximately 27' from the shoreline and the eXlstmg permitted deck extended out 50' from

under enforcement actIOn from the Department of EnVironmental Protection (DEP), and are
bnngmg forward this request to bnng the dock Il1to confonnance WIth City regulatIOns
Commelclal docks must be approved as part of a Level Two, Flexible Development review The
227 5 square-foot dock addition baSically filled m an approXImate 12-foot by 20-foot gap or
Il1dentatlon on the west side of the dock This dock IS pnmanly over sand, actll1g more as a deck
than a dock, as no boats can moor at this stI ucture, but IS watef\vard of the seawall This dock
(deck) IS used as an outdoor entertamment area whele bands play at, mcludll1g vertical shade

area I have no problem with the docks as It Will represent a decrease In boat traffic and the potential for a fuel spill In that
area When mentioned to the Manne Advisory Board their concern was for the loss of high and dry's and pnvate manna's
city Wide which are all gOing over to condo development The average recreational boater IS being displaced and eXisting
trailer launch facIlities are already inSUfficient for the current demand The Marine AdvIsory Board has no problem with the
docks as proposed
- one Item worth clanfYlng IS the statement on Plat 51 for Unit 5 Island Estates where It states No Dock shall extend more
than 30 feet from the seawall ThiS was made In 1959 and presently the county reserves the right to have docks go out to
a length not to exceed 25% of the Width of the waterway and at least far enough to have adequate water depth under the
moored vessel (at least one foot under the "keel" at mean low water, and to be deep enough to be beyond any sea grass
beds The document further makes a statement that all streets, alleys and waterways shown on the Plat are dedicated to
the public In general There has been significant public and prIVate development Including multIple pnvate mannas (the
High and Dry, Quality Boats, Ross Yachts and Island Estates Yacht Club), as well as residences which all have docks In
these public waterways
