Drtild Road west of Bypass Dnve m the City of Clearwater To develop the
property the applIcants seek to amend the land use plan to ResIdentIal Medtum
(RM) and rezone the property to Medmm DenSIty ResIdentIal (MDR) to permIt
development of townhouses at a densIty of 15 umts per acre
H. LAND USE I ZONING
The property has a ResIdenttal/Office/General (RJO/G) land use deSIgnatIOn per
the ComprehensIve Plan and an Office (0) zomng classificatIOn which does not
permIt resIdential development Therefore a rezonmg to MDR is necessary to be
consIstent WIth the mtent of the CountywIde Future Land Use Plan
The CountywIde Land Use Plan allows 15 umts per acre III an RJOIG area,
however, SectlOn 2-301 1 of the Clearwater Commumty Development Code, does
not hst RlOIG as a land use desIgnatton III whIch an MDR zomng dIStnct can be

located, but It does lIst RM as a consIstent land use desIgnatIOn Therefore, for
consIstency between the Commumty Development Code, the ComprehenslVe

the Southgate MHP to the east of the Progress Energy powerltne was approved
for a townhouse development The proxImIty to commercIal areas along Gulf-
to ~ Bay Boulevard and the McMullen Tenms Center complex wIll proVIde
shoppmg and recreatIOnal destmatIOns for future resIdents TYPIcally resIdenttal
development has lesser Impacts to publIc faCIlItIes than office development
Accordmg to Pmellas Plannmg CouncIl (PPC) gUldelmes, under the RJO/G land
use desIgnatton the expected tnp generatIon IS 170 dally tnps per acre, under the
RM deSIgnatIon the expected tnp generatIon IS 96 dally tnps per acre The SIte IS
located m humcane evacuatIon zone D, whIch IS a zone that IS rarely reqUIred to
evacuate Therefore it is suitable for residential development. The proposed
development IS not expected to adversely affect the natural enVIronment smce
there are no known envIronmentally senSItIve areas on-SIte The proposed
development W1Il not adversely Impact property values, and tn fact may Improve

With respect to any recommendanon for an alternative compromise recommendation or
request to continue, WIthdraw, reconsIder, modrfy or substitute a plan amendment whIch
has been submItted for COnsIderatiOn, the provisions as set forth follo\Ving shall govern.
AL TER.."lATIVE COMPROMISE RECO.MMENDATION.
PumLant to Section lO(4)(b) of Chapter 88-464, Laws of Florida, as amended, the PPC
shall forward recommendations for Future Land Use Plan amendments to the applicant
local government when saId action by the PPC constitutes an alternative compromise
recommendatron. The process for referral to and action by the local government shall be
as hereinafter set forth.
The PPC shall transnnt any such alternative compromise recommendatIon for plan
amendment to the applicant local government 'WIthIn five (5) days of action by the PPC.
The applicant local government shall consider the alternative compromise
recommendatton of the PPC at an official meeting of the local government legislanve
body and take formal actron to accept or reject the PPC recommendation. The local
government action to accept or reject the PPC recommendation shall be as is determined
necessary by the local government to lawfully accomplish such action and m the form
required by the ppc.
The local government action to accept or reject the PPC recommendation shall be
transmitted to the PPC WIthin forty-five (45) days ofreceipt of the PPC recommendation;
except as the local government may require additional time to lav.-fulIy accomphsh such
actIon and shall request a contmuation as set forth below 'Within the forty-five (45) days.
If the local government accepts the recommendation of the PPC, and transmits said
acceptance in the reqwsite form Wlthin the ~ forty-five (45) days, or as same may
be contInued, the PPC staff shall forward th1s amended applicanon for plan amendment
to the CPA WIth the PPC's recommendatJ.on for approval.
If the local government does not accept the recommendatron of the PPC as forwarded, or
faiIs to take actIon in the requisite form or withm the required fortywfive (45) days, or as
same may be continued, the PPC staff shall forward the origmal application for plan
amendment from the local government to the CPA with the PPC's recommendation for
denial.
