ThIS letter is in reference to an annexatIOn petition filed by the City of Clearwater.
Pursuant to Section 2-608 of the Pmellas County Code, please accept thIS letter as
our fonnal petition obJectmg to the proposed annexation and requesting the
Pinellas Plannmg CouncIl and the Countywide Planning Authority review the
proposal for consistency WIth the criteria and procedures set forth In Chapter 2,
ArtIcle VII of the Pinellas County Code
Our firm represents Attention Home, Inc., whose property is dIrectly adjacent to
the property sought to be annexed by the City of Clearwater. It IS our contentIon
that Pinellas County should object to the annexation on the grounds that the
property sought to be annexed does not meet the criteria required by Florida
Statute Section 171.043(2), which defines urban purposes as follows:
(a) It has a total resident population equal to at least two persons for
each acre of land included within its boundaries,
(b) It has a total reSident populatIOn equal to at least one person for each
acre of land included within its boundaries and is subdivided into
lots and tracts so that at least 60 percent of the total number of lots
and tracts are 1 acre or less in size, or

School Board For reasons known only to the City of Clearwater, they have since
withdrawn their application to the County and opted to pursue the lengthier and
more complex option of annexation, thereby removing any oversight by Pinellas
County
For these reasons, we respectfully request that the Planning Council and the Board
of County Commissioners in their capacity as the Countywide Planning Authonty
seek a full review of this annexation petItIon for compliance with the terms of
Chapter 2, Article VII of the Pinellas County Code and Chapter 171 of the Florida
Statutes.

Department The correspondence states that It IS a formal petItion on behalf of AttentIon

The City of Clearwater IS In receipt of correspondence from Figurski a Harrell
regarding the above-referenced annexation case now bemg processed by our Planning
Department The correspondence states that It IS a formal petition on behalf of Attention
Home, Inc objecting to the proposed annexation and requesting a review of the
proposal by the Plnellas Planning Council and the Countywide Planning Authority for
consistency with Article VII, Chapter 2 of the PlnelJas County Code The
correspondence further asserts that FlOrida Statutes Section 171 043 applies to the
annexation and that the proposal does not meet criteria contained In that Section
Since the proposed annexation IS not an Involuntary one under Section 171' 043,
but rather IS Initiated by the property owner [the City of Clearwater] on a vOluntarY. basIs,
Flonda Statutes Section 171 044, Voluntary Annexation, IS the applicable statutory
section The applIcation has yet to be heard by the Community Development Board or
the City Council The City Council will determme whether the application meets the
criteria contamed In Section 171 044 as well as Community Development Code Section
4-604 1 hIS office believes that the procedure set forth In Plnellas County Ordinance
No 00-63, Section 7, providing for limited review by the Council, should apply We do
not believe that the Figurski & Harrell letter alleges legitimate grounds upon which the
annexation does not comport with the procedure and cntena set forth In OrdInance No
00-63 such that full review by the Council and the CountYWide Planning Authority IS
appropriate
