6 Occupancy. Borrower shall occupy, establish, and use the Property as Borrower's pnnclpal
residence wlthm SlXty days after the executIOn of tlus Secunty Instrument and shall contmue to occupy the
Property as Borrower's pnnclpal residence for at least one year after the date of occupancy, unless Lender
otherWise agrees m wntmg, whIch consent shall not be unreasonably withheld, or unless extenuatmg
CIrcumstances eXIst which are beyond Borrower's control
7. Preservation, Maintenance and Protection of the Property; Inspections. Borrower shall not
destroy, damage or ImpaIr the Property, allow the Property to detenorate or commit waste on the

order to prevent the Property from detenoratmg or decreasmg III value due to ItS conditIOn Unless It IS

(b) Any such agreements wdI not affect the rights Borrower has - if any - with respect to the
Mortgage Insurance under the Homeowners Protection Act of 1998 or any other law. These rights
may include the right to receive certain disclosures, to request and obtain cancellation of the
Mortgage Insurance, to have the Mortgage Insurance terminated automatically, and/or to receive a
refund of any Mortgage Insurance premiums that were unearned at the time of such cancellation or
termmation.
11. 'Assignment of Miscellaneous Proceeds; Forfeiture. All Miscellaneous Proceeds are hereby
assigned to and shall be patd to Lender
If the Property IS damaged, such Miscellaneous Proceeds shall be applied to restoratIOn or repair of

remedial actIOns III accordance With EnVironmental Law Nothlllg herem shall create any obligatIOn on
Lender for an EnvIronmental Cleanup
NON-UNIFORM COVENANTS Borrower and Lender further covenant and agree as follows
22. Acceleration; Remedies. Lender shall give notice to Borrower prior to acceleration following
Borrower's breach of any covenant or agreement m thiS Security Instrument (but not prior to
acceleratIOn under Section 18 unless Applicable Law provides otherwise). The notice shall specify.
(a) the default; (b) the action required to cure the default; (c) a date, not less than 30 days from the
date the notice IS given to Borrower, by which the default must be cured; and (d) that failure to cure
the default on or before the date specified in the notice may result m acceleration of the sums secured
by this Security Instrument, foreclosure by judicial proceedmg and sale of the Property. The notice
shall further inform Borrower of the right to reinstate after acceleration and the right to assert ID the
foreclosure proceeding the non-existence of a default or any other defense of Borrower to acceleratIOn
and foreclosure. If the default is not cured on or before the date speCified in the notIce, Lender at its

23. Release. Upon payment of all sums secured by thIS Secunty Instrument, Lender shall release thiS
Secunty Instrument Borrower shall pay any recordatIOn costs Lender may charge Borrower a fee for
releaslllg thlS Secunty Instrument, but only If the fee IS paid to a thIrd party for services rendered and the
chargmg of the fee lS permllted under Applicable Law
24. Attorneys' Fees. As used III thiS Secunty Instrument and the Note, attorneys' fees shall mclude

Mass Appraisal is the systematic appraisal of groups of properties as of a given date using
standardized procedures and statistical testing. Its purpose is to provide an equitable and efficient
appraisal of all property in a jurisdiction for ad-valorem tax purposes.
We recognize that there is a reasonable range of values within which a property can sell. Our
Mass Appraisal Market Value tends toward the lower end of the range. Recent upgrades or
remodeling efforts completed by a seller in order to prepare a property for sale, especially those
on the interior of a building, are often not reflected in our Comparable Sales Value.
Finally, our values are historical and are developed using arms length sales from the three years

AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ANNEXING CERTAIN REAL PROPERTY LOCATED ON THE
SOUTH SIDE OF SAN JOSE STREET, APPROXIMATELY 110
FEET WEST OF MADERA AVENUE, CONSISTING OF LOT 50,
DEL ORO GARDENS SUBDIVISION, WHOSE POST OFFICE
ADDRESS IS 3137 SAN JOSE STREET, INTO THE CORPORATE
LIMITS OF THE CITY, AND REDEFINING THE BOUNDARY
LINES OF THE CITY TO INCLUDE SAID ADDITION, PROVIDING
AN EFFECTIVE DATE
WHEREAS, the owner of the real property described herein and depicted on the map
attached hereto as Exhibit A has petitioned the CJty of Clearwater to annex the property Into the
City pursuant to SectIOn 171 044, FlOrida Statutes, and the City has compiled with all applicable
requirements of FlOrida law In connection with thiS ordinance, now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CLEARWATER, FLORIDA
Section 1 The follOWing-described property IS hereby annexed Into the City of Clearwater
and the boundary lines of the City are redefined accordingly
Lot 50, Del Oro Gardens SubdiVISion; according to the plat thereof, as recorded In Plat
Book 45, Page 74, Public Records of Plnellas County, Florida

SectIon 2 The provIsions of thiS ordinance are found and determined to be consistent
with the City of Clearwater ComprehenSive Plan The City CounCil hereby accepts the dedication
of all easements, parks, nghts-of-way and other dedications to the public, which have heretofore
been made by plat, deed or user within the annexed property The City Engineer, the City Clerk
and the Planning Director are directed to Include and show the property described herein upon the
offiCial maps and records of the City
Section 3 ThiS ordinance shall take effect Immediately upon adoption The City Clerk
shall file certified caples of thiS ordinance, Including the map attached hereto, with the Clerk of the
Circuit Court and with the County AdmInistrator of PJnellas County, Flonda, within 7 days after
adoption, and shall file a certIfied copy with the Flonda Department of State within 30 days after
adoption

DEL ORO GARDENS SUBDIVISION, WHOSE POST OFFICE
ADDRESS IS 3137 SAN JOSE STREET, UPON ANNEXATION
INTO THE CITY OF CLEARWATER, AS RESIDENTIAL URBAN,
PROVIDING AN EFFECTIVE DATE
WHEREAS, the amendment to the future land use plan element of the comprehensive
plan of the City as set forth In this ordinance IS found to be reasonable, proper and appropnate,
and IS consistent with the City's comprehensive plan, now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CLEARWATER, FLORIDA

AMENDING THE ZONING ATLAS OF THE CITY BY ZONING
CERTAIN REAL PROPERTY LOCATED ON THE SOUTH SIDE
OF SAN JOSE STREET, APPROXIMATELY 110 FEET WEST OF
