PARKING AGREEMENT
THIS PARKING AGREEMENT made this 26 day ofCb~~ 2004, by and between
MICHAEL W MCCLURE as owner of 1375 "E" Street. Clearwater, Flonda (Grantor) and MICHAEL W
MCCLURE as owner of 509 "0" Street, Clearwater, Flonda (Grantee).
WHEREAS, Grantee lS the owner and holder of certain property located at 509 "0" Street,
Clearwater, Florida which IS adjacent to and abuts property at 1375 "E" Street, Clearwater, Flonda,
owned by Grantor, and
WHEREAS, Grantee has requested of Grantor the ability to utilize twelve to sixteen parking
spaces owned by Grantor, and
WHEREAS, Grantee Intends to Indemnify and hold harmless Grantor and any lessee/tenant of
Grantor from any and all liability connected wIth Its use of the spaces
NOW THEREFORE, IN CONSIDERATION of the covenants and promises contained herein,
the parties hereto do hereby agree as follows
1 Grantor hereby grants to Grantee license to use tWelve to sIxteen parking spaces of the
parking lot directly abuttIng the property located at 509 "0" Street, Clearwater, Flonda
2 Grantee hereby agrees to Indemnrfy and hold harmless the Grantor and/or Grantor's
lessees/tenants from any claims, choices of action or any liability whatsoever In connection with the use
by Grantee of the parking spaces, and m furtherance of that Indemmficatlon, agrees to provide proof of
lIability Insurance for the Grantor showing the Grantor as an additional Insured on Grantee's hablllty
policy with limits of $100,000 00 per person and $300,00000 per occurrence and $50,00000 property
damage. Grantee agrees to provide proof of said insurance to the Grantor on an annual baSIS when
the polley IS renewed
In addltlon to the foregOing, Grantee agrees to keep and mamtaln the twelve to sixteen spaces
In a neat and orderly condition and allow no damage to occur to the parking lot nor Will It let trash
accumulate or any unsightly conditIon to occur or remain
The license of use granted by the Grantor to the Grantee shall continue from year to year
The nght granted by the Grantor to Grantee shall be considered a licensed nght and not
constitute any tenancy under the LANDLORD TENANT LAWS OF THE STATE OF FLORIDA and
Grantee waives any and all nghts of notice otherwise granted by any Flonda Statute

with my check. $125000 on 12/18/2004 plus thousands In legal fees
There have many Issues and the community team has tned to shut us down several
times

submitted December 22,2004, to permit retail sales within the IRT Dlstnct as a Comprehensive Inflll
Redevelopment Project (freestanding retail sales IS not a permitted use In the IRT District) The application was
deemed Incomplete on December 27, 2004 There have been vanous meetings, insufficient submittals and
emails since that time without the submisSion of a complete application Deadlines have been missed many
times My phone diSCUSSions, emalls and letters have all been with Stephen Watts, attorney for the tenant and
the property owner and I have had no contact with Mr Boone While there are baSIC completeness Issues
(outlined In the December 27,2004 letter), the pnmary Issue relates to required parking Finally on Apnl 20, 2006,
after the last deadline was missed, I requested Community Responses assistance to move the violations
forward Segway has operated at thiS location since the beginning without a valid occupational
license Separately, there have been Issues with the display of motor vehicles for sale, which was not part of the
ongmallssuance of the occupational license for such (office only) I have many times attempted to move thiS

I am now in possession of your Notice of Unlawful due to the followmg mdicated condItions:

I am getting the feeling that this is a personal problem Dr a problem WIth the City of Clearwater
with thIS property. In my pnor correspondence with you. I told you that Michael McClure owns a
number of cars, they are his cars and they are on his property. Since they are being stored on his
property, I don't thmk he needs tags on the cars and therefore I think your notice is totally erroneous.
They are not inoperable vehicles. that's wrong and therefore I just wonder why you are doing this.
These are taxpayers to the City of Clearwater. They do not need to be fNstrated anel/or harassed
by you folks even though you think you know something that they are or are not doing.
Therefore. cease the unlawful tags to the cars. stay off the property and leave them alone
I IndICated In my prior correspondence that these are collector cars owned by Mike McClure who
owns the property and can park cars anywhere he wants to on hi.fproperty. I am not quite sure what the

Violation mailed on April 27, 2006.
The vIolation cited was corrected immediately. It was a misunderstanding with an
employee who works at that office and If you have re-inspected. you will find no reference to
any vehicle sales.
Michael McClure owns the property. IS a car collector, and those are his personal cars that
are parked on the property. ~n some cases it IS necessary to leave a few vehicles of his outside.
when the ware house where they are stored is full.
We are working with Planning and Zoning and supplying them with Information for an
lnfill development project. In the meantime. no vehicles will be offered for sate on this property.

By letter dated December 27, 2004, you were mformed that the above referenced applIcatIOn was

found suffiCient at that DRC meeting, the application would be scheduled for the May 16, 2006, CDS meeting

happens to have a license tag on It and It IS the car that we donated to Chanty

The appearance of the car was enough to anger the

I think this would have some media Interest
All we are trying IS to run a small business but It IS an uphill battle If this

was gOing to Broker cars on the Internet which I need a motor
vehicle license to do I had to have a change In zoning and I spoke
to the city and was told to submit an application for that I was
then told that I was operating Segway operation Illegally because
It was a merchant Category
I hired an attorney Steve Watts and he submitted Flexible
Development Application along with my check $125000 on
12/18/2004 plus thousands In legal fees
There have many Issues and the community team has tried to
shut us down several times
Bottom line 4/24/05 Notice of Violation Unapproved Vehicle Sales

Nothing but harassment
I am now making and offer on a bUilding on Clearwater Largo
Road In Largo I am fed up With thiS kind of antll bUSiness attitude

been gone for 2-3 months we called twice no action and some

Occupational License When I started here In December 2003 I was
gOing to Broker cars on the Internet which I need a motor vehicle license
to do I had to have a change In zoning and I spoke to the city and was
told to submit an application for that I was then told that I was operating
Segway operation Illegally because It was a merchant Category
I hired an attorney Steve Watts and he submitted FleXible Development
Application along With my check $125000 on 12/18/2004 plus thousands
In legal fees
There have many Issues and the community team has tried to shut us
down several times
Bottom line 4124/05 Notice of Violation Unapproved Vehicle Sales
05/03/05 Notice of Violation Inoperative Vehicle
Nothing but harassment
I am now making and offer on a bUilding on Clearwater Largo Road In
Largo I am fed up With thiS kind of antll bUSiness attitude
Some other smaller Issues Our Street does not have a Sign It has been
gone for 2-3 months we called twice no action and some one stole our
garbage cans we called two weeks ago no action

I requested Code Enforcement to take action on Apnl 20, 2006, due to inactivity or inability to file a complete FLD
application On May 15, 2006, I received an emall from Mr Watts explaining he has been called out of the
country and would return on May 22,2006, whereupon he would call me to complete the application (see
attached) I did not hear nor receive anything from Mr Watts on any date after May 22,2006 On July 14,2006, I
received an emall request from Mr Watts to meel to diSCUSS 2 or 3 tOpiCS (don't know If It IS related to Segway at
5090 Street) I sent a response on Fnday letting Mr Watts know of my availability (see attached) I have not yet
heard from Mr Watts as to setting up the meeting he requested
While Mr Boone IS the subject of the Issue, I have been dealing with Mr Watts I am unaware of whether he IS
