The outstandmg code vIOlatIOns are now exceedmg one year Dunng thIS time pen ad, the
department has notified the property owner on numerous occaSIons regardmg the outstandmg
vlOlatiOns, all With no resolve
The purpose of thiS letter IS to adVise the property owner that to aVOid any further code
enforcement actIOn they must apply for a bUIldmg penmt wIthm two weeks of receipt of thiS
letter and they must then ImmedIately complete all remedial work With requIsite mspectlOTIS
wlthm SIX months from Issuance date of Issuance of the permIt
Please be adVIsed, the City will begm enforcement on May 2, 2005 for the case to be presented
before the Mumc1pal Code Enforcement Board The board may set fines up to $50000 a day

Development application, It looks like the main Issues to resolve prior to being scheduled for the Community Development
Board IS the fence/wall within the easement on the southeast or east portion of the property (General Engineering
comments) Once we can resolve thiS, we should be ready to set you up for the COB meeting From a timing aspect
regarding the CDB meeting, the next date we have as a deadline to submit sufficient application Information for the CDB IS
Thursday, November 18, 2004 Any revISions to application matenals would need to be submllled by Ihat date to be
sch ed uled for CD B review on Decem ber 14, 2004 I waul d like to see If you co u Id work toward the Novem ber 18th date,
so Ihat this application could move toward completion and then be able to move toward obtaining a building permit and

Development case IS to permit an 10crease to fence height from three feet to a maximum of SIX feet for a penmeter
fence wlth10 the front setback 10 the MHDR, Medium High Density Residential District ThiS case for the fence/wall,
which has already been constructed Without benefIt of permits or FLD reView, was received on Apnl 7, 2004, and
went to the DRG on May 6, 2004 The representatIVe for thiS case IS a Mr Reuven Oded Though he was sent the
draft DRG comments, Mr Oded did not attend the DRG meet10g While I have called and left messages for hIm 10
the past, the manager of the apartments (I thmk that IS her trtle) has contacted me to ascertam what was needed
The FLD application was found suffiCient at the DRG meetmg to move forward to the COB, WIth modifications To
date, the modifications have not been fully addressed Some modifications to the application and site plan have not
been addressed, as well as some new Fire concerns have surfaced
1 The Fire Department has ordered the gates removedlleft open due to Fire access concerns Site inspection
reveals the location of the card reader (or where It used to be, s10ce It has been removed) and the gates present
Issues With turmng movements of Fire vehicles The Fire Department can more fully address their concerns m detail
However, until the Issues and the deSign solutIons are put on paper, It IS unclear how the Apartments are addressmg
the concerns
2 Apparently the Fire Department has senous concerns With the construction of the dnveway It has been stated
that, With the construction of the Drew Street overpass on US Highway 19 N , the State contract mcluded the
relocatlon of the Apartment's driveway There are grade elevation changes from Drew Street to the parkmg areas of
the Apartments beyond The FIre Department can more fully address their concerns m detail

have mdrcated that they Will relocate It out of the nght-of~way, but not where or how

order for the first time In a decade, IMT/MacArthur Park attorney conceded and they're on the hook, Allison
Thompson's attorney Will be pushing hiS client toward permitting, the chips are on the table for "Blue Chip" as
they'll become a repeat Violator If the properties slip, Lokey and other dealerships are getting the message, Dr
Janelllls under the gun
From my vantage pOint, the coordinated internal approach worked very well My observations and
appreCiation IS as follows
. Bob Hall has consistently been a strong contributor to our cause and delIVered again yesterday Bob's
efforts leading up to the CEB and In the case hearings have been key
. KeVin Garnott took the much needed strong approach In our diSCUSSions With IMT(case 25-05 MacArthur
Park Apts) before the actual hearing, which kept us In a good position gOing before the board
. Nell Legters expertise and cautious approach In our 11/29/05 conference call With Hersh-IMT was
Invaluable Nell's responses protected the City's Interest and supported KeVin fully Nell and I have only
recently worked together and hiS efforts In "crunch time" have my full respect

please accept thiS letter as a summary of the current situation Upon reviewing, please let
me know If you have any questions
We purchased the property on November 5,2004 Just pnor to the close we were
mformed of outstandmg vIOlatIons at the property related to the roofs After closing we
reviewed the status of the roofs and determmed that Hersh Construction, who had
effected rcpalrs and renovations to the roofs dunng 2003 and 2004, bore responsIbility
for the VIOlations We contacted Hersh In late November and asked for their mvolvement
In correctIng these VIOlatIons
In the month of November, a consultant hIred by IMT preparcd a full roof report that
outhncd the inSUffiCiencIes of the current roof and recommended that the roofs be
replaced In their entIrety In order to correct the outstandmg vIOlatiOns ThiS report was
forwarded to Hersh m December for theIr review However, It was not until January that
Hersh replied by statmg that they dIsagreed With the consultant's report and the scope of
the corrective work that was recommended Hcrsh requested, and IMT agreed, to meet
With Hersh at the property to go over the defects Il1 the mstallatlOn that had caused the
VIOlatIOns to occur
DUring thIS hme, III an effort to contmue movmg forward m thc event Hersh failed to
correct these VIolations, IMT prepared a scope of work and soliCited bids m preparatIOn
for replacmg the roofs However, m hopmg to resolve the sItuatIOn wlth the cooperation
of Hersh and waItmg to hear their proposal for the correctIOn of the VIOlatIon Issues, lMT
has not yet chosen a roofer to conduct the work
lMT and Hersh agreed to meet at the property on February 25th to review the roofs
together IMT flew both ItS Flonda ConstructIon Director, RICardo OrtiZ, and ItS roof
consultant, John Lance, mto Tampa m antIcIpation of the meetmg For unexplamed

reasons, Hersh dId not appear at the property and the meetmg did not occur as scheduled
IMT had hoped that after conductmg thiS meetmg, we would be able to provide the Clty

2 I have received an emallthat the gates have been removed I have also seen thiS (no gates) when I vIsited the site on
October 9,2004 Since the gates are gone, the Issue of Fire Department access has been resolved I have amended the
conditions (there were two similar conditions) appropriately In Permit Plan to reflect such ("met" with explanation) Any
deSire to have gates In the future will need to comply with all requirements of the City and the Fire Department, and
Plnellas County regulations, prOViding adequate stacking outSide of any such gates and any card reader/call box to prOVide
access to the Interior of the apartment complex nol block parking spaces or restnct turnmg movements A bUilding permit

I am the case planner for FLD2004-04022, 2690 Drew Street, for the MacArthur Park Apartments This Flexible
Development case IS to permit an Increase to fence height from three feet to a maximum of SIX feet for a penmeter fence
within the front setback In the MHDR, Medium High Density Residential Dlstnct This case for the fence/wall. which has
already been constructed without benefit of permits or FLD reView, was received on April 7, 2004, and went to the DRC on
May 6, 2004 The representative for this case IS a Mr Reuven Oded Though he was sent the draft DRC comments. Mr
Oded did not attend the DRC meeting While I have called and left messages for him In the past, the manager of the
apartments (I think that IS her title) has contacted me to ascertain what was needed The FLD application was found
suffiCient at the DRC meeting to move forward to the COB, with modifications To date, the modifications have not been
fully addressed Some modifications to the application and Site plan have not been addressed, as well as some new Fire
concerns have surfaced
1 The Fire Department has ordered the gates removed/left open due to Fire access concerns Site inspection reveals the
location of the card reader (or where It used to be, Since It has been removed) and the gates present Issues with turning
movements of Fife vehicles The Fire Department can more fully address their concerns In detail However, until the
Issues and the design solutions are put on paper, It IS unclear how the Apartments are addreSSing the concerns
2 Apparently the Fire Department has serious concerns with the construclion of the driveway It has been stated that, with
the construction of the Drew Street overpass on US Highway 19 N , the State contract Included the relocation of the
Apartment's dnveway There are grade elevation changes from Drew Street to the parking areas of the Apartments
beyond The Fire Department can more fully address their concerns In detail
3 A portion of the fence/wall has been constructed within the nght-of-way of the new roadway on the west Plans have
Indicated that they Will relocate It out of the nght-of-way, but not where or how
4 A portion of the fence/wall has been constructed within a drainage and utility easement on the southeast corner of the
property Plans have not Indicated how they are resolving thiS Issue
5 A sign has been constructed on the west Side of the driveway within the VISibility triangle While thiS Sign was
constructed with a City permit, review by Ms Lisa Fierce reqUired It not to be located within the vIsibility tnangle
We are awaiting revised plans that Will address the outstanding Issues Once submitted, the ORe Will review the plans to
see If the comments have been adequately addressed pnor to scheduling for review and deCISion by the COB
