Pursuant to SectIon 4-303, an applIcatIon for a bUlldmg permIt shall be made wlthm one year of
FleXIble Standard Development approval (January 6, 2005) All reqUired certificates of occupancy

Wllhams (resident/owner of 1611 Sunset Dove) and Peaches Pook (owner 1607 Sunset
Dove) and a potential CIVIl htIgatlOn to resolve the Issue Several weeks ago I had a
dIscussIOn With Peaches regard10g the encroachment of a concrete SIdewalk on the south
Side of 1611 Sunset Dove We were 10 agreement that the SIdewalk was encroach1Og but
we dId not know what needed to be done to correct the problem r have 2 surveys that
show a 1 8' overage at the rear and a 95' overage towards the front of the Sidewalk
There IS a storm dram In the Sidewalk at the center of the property lme that IS posmg a
ddenuna as well as the exact locatIOn of the property lme On phone several
conversatIOns With Peaches r h.ave expressed my concern over exactly where the property
Ime IS due to several concerns My pnmary concerns are,
There IS a stonn dram m the Il1lddle of the property Ime that IS the only dramage
for the South SIde of my property My property IS sloped from back to front and a
maJonty of the property IS covered With concrete There]s also paved alley at the
rear of the property IS also sloped towards my property Dunng heavy rams my
garage floods I also have a sewer drain cIeanout near tlus area that may not be
Involved If the lme IS where I dunk It IS
2 Is the new development gOing to shed more water onto my property? The
property south of mine IS about one foot elevated and Without proper dramage,
and or a retalmng wall, wlll erode onto my Sidewalk, lunder access to my sll.le
door and create a dramage problem for me
J WIll I stIli have access to the SIde door of my home? Thts IS my pnmary and onJy
access to the rear and back of the house as my wife and I park m our garage at the
rear of the property MIs Pook IS of the opullon that my house IS butlt on the
property hne !fthat were to be the case (I do not dunk It IS) and a fence were to
be put on the property hne then I would not have, or would have very Imuted

On October 30Lh Mrs Pook caJled to mform me tha.t the city ofCledlWater wanted me
to remove the concrete from her property r explained that I didn't thmk It was my
responsibility and that we had not agreed on where the line was
I Viewed a COpy of the survey for 1607 Sunset Dnve and the mornmg of November
rd
3 J contacted Mrs Pook to mform her that our two surveys were not much different
Her survey shows my SIdewalks closer to her property but the encroachment
measurements were about the same I also expressed my concern over the stann dram
and asked to meet wtth her to reVIew the two surveys and see If we could come to
terms on the location of the line and where to cut Mrs Pook responded that we
would not be able to come to an agreement and stated that we would need the City to
make the detennmatlon of the lme and what to do about the dram
Later that day I saw Mrs Pook on the property and again approached her to rev:tew
the surveys and at least come to some kmd of a mutual agreement as to where the
property line was I explained that If we could not resolve the Issue that It would have
to go to CIVIl litigation She then called her contractor and handed me the phone The
contractor quggested that he and I meet and resolve the property line IM,ue and that he
would look mto saVIng the dram and haVIng a shared ownership of 11 I agreed that
this would be a good Idea I also expressed my concern to him about the run off and
he 5al.d that he would address that and get back WIth me
At trus tIme I thmk that we may be close to resolvmg the property lme ISSue It should
have been a Simple matter of runrung a stnng and markmg a lme, however I have met
WIth qUIte a bit of resistance As to the storm dram, the City Will have to allow for it to
remam and be a shared fixture or come up Wlth some other resolution
I hope tills letter helps you to understand my SItuatiOn and that you will have some
suggestions to help resolve these Issues I do not Wish to prevent or hold up the
project but I do feel that I should not be Imposed upon or lmuted m my access to my
