Dear CIty of Clearwater,
The deck that was bUIlt at 752 Bay Esplanade IS 248 sq ft and 17 Inches at Its highest pOint
We have prOVided pictures of the prevIous deck and spa The old deck overlapped Into the neighbor's
lot line and the tree was causing the concrete slab for the spa to crack and nse ThIS resulted In
drainage problems (water dralnmg towards the house) and cracked spa pIpes We decided to remove
the spa and deck and replace It WIth a smaller deck that would not overlap Into the neighbor's lot as
well as correct the water drainage Issue The deck was bUilt outSide of the easement lines relative to
the boundary survey The new deck does not Interfere with the eXlslmg tree and was built In
accordance to code Adjacent neighbors are delighted that the outdated spa and paba were removed
We are In the process of renovating the entire house and have three permits outstanding at thiS tlme
We made the mistake of not Inqulnng about a permit regarding our new deck We are applYing for a
vanance In order to keep the eXisting deck

1 That under no CIrcumstances shall the deck be constructed WIthIn the fIve-foot easement located
along the rear (west) property hne
I concur WIth the findmgs of the Development ReView COmITIlttee and, through thIS letter, approve
your applIcatIOn for FleXIble Standard Development With the above eIght condItIons. The approval IS
based on and must adhere to the SIte plan and applIcatIon received February 26,2004
Pursuant to SectIon 4-303, an applicatIon for a butldmg permIt shall be made wlthm one year of
FleXIble Standard Development approval (Apnl 6, 2005) All requIred certlficates of occupancy shall
be obtamed wIthm one year of the date of Issuance of the bUIldIng penmt TIme frames do not change
WIth successive owners
The Issuance of thIS Development Order does not relIeve you of the necessity to obtam any bUIldmg
perrmts or pay any Impact fees that may be reqUIred In order to facIlItate the Issuance of any perrmt or
