08/06/2003 AIRPARK ADVISORY BOARD MEETING CITY OF CLEARWATER August 6, 2003 Present: Brenda Harris Nixon Chair Bob Lunt Vice-Chair J.B. To provide continuity for research, items are in agenda order although not necessarily discussed in that order. 2. Approval of Minutes from June 4, 2003 It was requested the following changes be made to the June 4, 2003, meeting minutes: 1) On page one that Assistant City Attorney Bryan Ruff be removed under “Also Present”; 2) sentence two in paragraph four on page two read “…one hour to fuel a truck.”; 3) sentence two in paragraph five read “…currently has 165 airplane spaces.”; and 4) sentence two in paragraph one on page 3 read “…to all 48 contiguous states.” Member Johnson moved to approve the minutes of the regular meeting of June 4, motion carried 2003, as amended. The was duly seconded and unanimously. 3. Tenant & Lease Report from FBO (Fixed Base Operator) FBO David King said he received three complaints this week regarding aircraft taking off from the Airpark after 9:00 p.m. and before 7:00 a.m. The only planes allowed to take off earlier are those that may take off no earlier than 6:00 a.m. for traffic reporting. He said he could not confirm the takeoffs, as the security guard was not aware of the takeoffs, and the security cameras may have been adversely affected by inclement weather. Marine & Aviation Department Director Bill Morris said the number of complaints received at the Airpark have decreased substantially. Most of them are from less than half a dozen people, and sometimes are related to the same incident. Mr. King said due to recent rainfall levels, the Airpark needs to and will be sprayed for insects. The grass also will be mowed. Groundbreaking for the corporate hangar is expected on August 11, 2003. The fuel farm should be ready within the next few days. Mr. King said one of the Airpark tenants has built an office in his hangar without permission. He did not know if the tenant has been able to obtain an occupational license for the office. Airpark tenants are required to submit a written request to the FBO, obtain an occupational license and building permit from the City, and obtain approval of the FBO and Marine & Aviation Director for any items that are not permitted in the lease, including Airpark Advisory 2003-08-06 1 8/6/03 modifications of hangars. In response to a question, Mr. King said three tenants at the Airpark have offices in their hangars. Discussion ensued and it was remarked that hangars are to be used for aircraft only. It was remarked that there should be no selective enforcement of office space at the Airpark. In response to a question, Assistant City Attorney Bryan Ruff said office space constructed in the hangars without permission is a violation of the tenant lease for hangars. Three persons spoke regarding tenants’ office space in hangars. Mr. Morris said the City’s Community Response team is going to inspect the Airpark property and make a list of code violations. Staff also is looking into individual meters for electrical service for tenants. Concern was expressed that occupational licenses could be obtained from the City on a City-owned facility. It was remarked that an office in a hangar that meets the regulations of the Code would still be a breach of a tenant’s lease if the construction was not requested and approved in advance. It was questioned if a tenant’s unauthorized office could be grandfathered in at the Airpark under a 30-day lease. A suggestion was made that the rent should be increased for tenants who already have offices in hangars, as they could be considered corporate hangars. It was suggested that if it is determined that there is a need for personal office space for tenants, additional space in the new general aviation building could be considered. The types of businesses allowed in the building could be regulated. Consensus was that further discussion is needed and a decision must be made regarding whether or not to modify tenant leases to allow office space in hangars. 4. New Business – Charter Operation Mr. King said he has requested the City’s permission to run his own charter business at the Airpark within normal operating hours. His lease permits the charter operation if approved by the City. 5. Other Business In response to suggestions from a resident, it was remarked that there must be a balance between the neighborhood surrounding the Airpark and the Airpark’s fiscal returns. Airpark tenant Bruce Kaiser requested the board and the City consider extending the hours of landing at the Airpark to 11:00 p.m. It was remarked that considerable discussion previously had taken place regarding the hours of operation for the Airpark, which resulted in the 9:00 p.m. deadline for aircraft landings. It was suggested that prior to the board making a recommendation to the Commission regarding the request, neighbors of the Airpark be invited to a test flight by Mr. Kaiser to witness firsthand the noise levels of the aircraft. 6.
