The City Commission of the City of Clearwater met as the Community
Redevelopment Agency at City Hall, Tuesday, October 16, 1984. The meeting
was convened at 9:19 a.m. with the following members present:

The Mayor called the meeting to order. The meeting was called by
Notice of Special Meeting dated October 12, 1984, addressed to members
of the Community Redevelopment Agency of the City of Clearwater, Florida,
for the purpose of discussing the settlement of the Community Redevelopment
Agency vs. Jannelli litigation. The Agency had authorized the acquisition
by eminent domain of the property at the southeast corner of Cleveland
Street and Garden Avenue, known as the Jannelli parcel. Staff has
continued to negotiate with the parties involved and it appears the action
can be settled and the subject property acquired by the Agency for a gross
cost which will not exceed $958,000.
The City Manager reported there is $650,000 in an escrow account that
was contributed by J. K. Financial and an interfund loan from the General
Fund of $300,000 would make up the difference. He also noted that the
Downtown Development Board has offered to help offset up to 50% of the
overage over $650,000. These monies would come from the tax increment
funds which will be generated with the new development. He also stated
J. K. Financial will pay Mr. Jannelli's attorneys' fees. However, the
matter of the tenant relocation is still to be addressed.
Commissioner Justice expressed concerns for the tenant citing an
inability to expand the business.
Commissioner Calderbank suggested the downtown zoning issue be re-
addressed. The City Manager responded that the project has gone too far
for that.
Commissioner Garvey moved that the attorneys for the Community
Redevelopment Agency be authorized to settle the eminent domain action
filed to acquire the Janelli parcel at a gross cost to the Agency not to
exceed $958,000, and that the appropriate officials be authorized to
execute same. Motion was duly seconded. Upon the vote being taken,
Commissioners Garvey, Justice and Calderbank voted "Aye"; Mayor Kelly voted
"Nay." Motion carried.
