To provide continuity for research, items are in agenda order although not necessarily discussed in that order. B. ROLL CALL: C. APPROVAL OF MINUTES OF PREVIOUS MEETING: May 21, 2019 Member Anuszkiewicz moved to approve the minutes of the May 21, 2019 Community Development Board meeting as submitted in written summation. The motion was duly seconded and carried unanimously. Alternate Member Van Scoyoc did not vote. D. CITIZENS TO BE HEARD RE ITEMS NOT ON THE AGENDA: None. E. CONSENT AGENDA: The following cases are not contested by the applicant, staff, neighboring property owners, etc. and will be approved by a single vote at the beginning of the meeting: (Items 1 -2) 1. Presenter: Diego Guevara, Senior Planner Member Anuszkiewicz moved to recommend approval of Case LUP2019-03001 on today's Consent Agenda based on evidence in the record, including the application and the Staff Report, and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report. The motion was duly seconded and carried unanimously. Alternate Member Van Scoyoc did not vote. F. CONTINUED FROM MAY 21, 2019: (Items 1 - 2) 1. Case: FLD2019-001003 — 1006 Eldorado Avenue Level Two Application Owner: Steve Samaha Agent: Mike Loomis, Landscape Fusion (3353 South Dale Mabry Highway, Tampa FL 33629; phone: (813) 399-3634; email: mike @landscape-fusion.com) Location: 0.723 acre property is located on the west side of Eldorado Avenue approximately 60 feet north of the Island Drive and Eldorado Avenue intersection. Request: The Community Development Board (CDB) is reviewing a pool/pool deck to be located seaward of the Coastal Construction Control Line (CCCL) in the Low Medium Density Residential (LMDR) District for the property located at 1006 Eldorado Avenue. The project requests allowable flexibility from setback Community Development 2019-06-18 2 requirements and to allow new construction seaward of the CCCL (Community Development Code Sections 2-204.E and 3-905). Neighborhood Association: Clearwater Neighborhoods Coalition. Presenter: Kevin W. Nurnberger, Senior Planner Member Anuszkiewicz moved to accept Kevin Nurnberger as an expert witness in the fields of zoning, site plan analysis, planning in general, and the landscape ordinance. The motion was duly seconded and carried unanimously. Alternate Member Van Scoyoc did not vote. Senior Planner Kevin Nurnberger said this case was on last month's Consent Agenda but was continued; the City received no objections. He reviewed the Staff Report, noting modification to Condition of Approval 3 based on the applicant's request to place the outdoor equipment in the north side setback adjacent to the house where the minimum side setback was met. In response to a question, Mr. Nurnberger said the applicant must present approvals from the Florida Department of Environmental Protection and US Army Corps of Engineers before permits are issued. Member Behar moved to approve Case FLD2019-001003 based on the evidence and testimony presented in the application, the Staff Report and at today's hearing, and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report with conditions of approval as listed with Condition of Approval 3 modified to read "That any proposed new outdoor mechanical equipment associated with the pool and pool deck shall not be located in the portion of the north side setback that was reduced from five to four feet through a Level Two approval." The motion was duly seconded and carried unanimously. Alternate Member Van Scoyoc did not vote. 2. Case: FLD2019-04008— 1920 Gulf-to-Bay Boulevard Level Two Application Owner: G & G Realty Agent: David Millisor, Oliveri Architects (32707 US Highway 19, Palm Harbor, FL 34684; email: dave @oliveriarchitects.com) Location: 0.642 acre site is located at the northwest corner of Gulf-to-Bay Boulevard and South Meteor Avenue. Request: The Community Development Board (CDB) is reviewing a proposed redevelopment of a fast food restaurant in the Commercial (C) District for the property located at 1920 Gulf-to-Bay Boulevard. The project is 18.9 feet in height (from grade to top of roof line), includes 25 off-street parking spaces, and requests allowable flexibility from setback requirements, landscape requirements, and off- street parking requirements (Sections 2-7045 and 3-1202.G). Neighborhood Association: Clearwater Neighborhoods Coalition. Presenter: Kevin W. Member Lau moved to approve Case FLD2019 -04008 based on the evidence and testimony presented in the application, the Staff Report and at today's hearing, and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report with conditions of approval as listed with Condition of Approval 12 modified to read "That prior to the issuance of any building permits except for demolition, clearing and grubbing or the provision of fill that the northern most driveway along Meteor Avenue shall have an ingress and egress turning radius that is acceptable with the development and City Engineering, Fire, and Solid Waste departments."
