The work performed under this Contract has been observed by authorized representatives of the Owner,
Contractor, and Consultant, and the Project(or specified part of the Project, as indicated above) is hereby
declared to be substantially completed on the above date.
DEFINITION OF SUBSTANTIAL COMPLETION
Substantial completion is the stage in construction when a project or designated portion thereof is
sufficiently complete in accordance with contract documents so that the Owner can use the work or
portion thereof for its intended use. Items that affect operational integrity and fiinction of the work must
be capable of continuous use.

possession of the specified area of the Project on July 26, 2018. The responsibility for utilities, security,

PROJECT PUNCH LIST
A punch list of items to be completed or corrected by August 26, 2018 is appended hereto. This list may
not be exhaustive,and the failure to include an item on it does not alter the responsibility of the Contractors
to complete all the work in accordance with the Contract Documents. Below is the list of items that were
verified during the site observation and substantial completion visit.
® 10 gallons of Prime Resins Prime Flex 910 Injected at the location of the leak
e 2-Sumps installed at location next to the leak. Each sump had a City provided sump pump and 1"
flexible piping back to the South Primary Clarifier
® Fabric installed between the two sumps along with 57-Stone to contain the leak into the two sumps.
PROJECT ONE YEAR WARRANTY
Contract Section III,
13.5 WARRANTYICORRECTION PERIOD
If within one year after the date of Substantial Completion or such longer period of time as may be prescribed
by Laws or Regulations or by the terms of any applicable special guarantee required by the Contract
Documents or by any specific provision of the Contract Documents, any Work is found to be defective.
Contractor shall promptly, without cost to the Owner and in accordance with the Owner's written
instructions; (i) correct such defective Work, or, if it has been rejected by the Owner, remove it from the site
and replace it with Work that is not defective and(ii)satisfactorily correct or remove and replace an),,damage
to other Work or the work of others resulting therefrom...
Where defective Work(and damage to other- Work resulting therefrom)has been corrected removed or
replaced under this paragraph the correction period hereunder with respect to such Work will be extended for
an additional period of one year after such correction or removal and replacement has been satisfactorily
completed.

EXCEPTION TO THE WARRANTY
The one-year warranty does not apply to the NE WRF South Primary Clarifier Leak Repair project as this
was a below grade emergency leak repair project in which the Engineer and the Contractor did not have
the time to investigate the leak including determining the exact location of the leak. The product that was
injected is meant to route itself to the location of the leak and seal it.There is a product warranty from the
product manufacturer. The rest of the project was labor only. The pump and the flexible piping that were
installed as a back-up to catch any leaks were provided by the City and are not warrantable.
