A. CALL TO ORDER, INVOCATION, PLEDGE OF ALLEGIANCE
The Chair called the meeting to order at 1:00 p.m. at the Main Library followed by the
Pledge of Allegiance.
To provide continuity for research, items are in agenda order although not
necessarily discussed in that order.

C. APPROVAL OF MINUTES OF PREVIOUS MEETING: February 13, 2019
Member Anuszkiewicz moved to approve the minutes of the February 13, 2019
Community Development Board meeting as submitted in written summation. The motion
was duly seconded and carried unanimously.

E. LEVEL TWO APPLICATIONS: (Item 1)
1. Case: FLD2019-01001 — 114 Turner Street Level Two Application
Owner: Stanley 114 Turner LLC
Agent: Katherine Cole; Hill Ward Henderson (600 Cleveland Street, Suite 800,

Location: 0.138 acre located on the north side of Turner Street approximately 60
feet west from the Bay Avenue and Turner Street intersection.
Request: The Community Development Board (CDB) is reviewing a proposed
addition to an office in the Office (0) District for the property located at 114 Turner
Street. The project is 23 feet in height (from grade to top of mid-point of cupola
pitched roof), includes two off-street parking spaces, and requests allowable
flexibility from the minimum required lot width, setback requirements, landscape
requirements, and off-street parking space requirements (Sections 2-1004.A and 3-
1202.G).

Member Lau moved to grant Attorney Jan Govan Party Status.
Member Lau moved to accept Kevin Nurnberger as an expert witness in the fields of
zoning, site plan analysis, planning in general, and the landscape ordinance. The
motion was duly seconded and carried unanimously.
Senior Planner Kevin Nurnberger reviewed the Staff Report.
Attorney Katie Cole, representing the applicant, said the request to construct a small
addition to the front of the building would match other neighborhood properties and not
double the structure's size.
Member Lau moved to accept Robert Pergolizzi as an expert witness in the fields of
planning, land use, and traffic impact studies. The motion was duly seconded and
carried unanimously.
Attorney Cole said inability to park on the front of the property was consistent with the
neighborhood. She presented photographs of neighboring properties, noting the
adjacent property owner to the west had submitted a letter of no objection. She said the
midpoint of the pitched roof was just over 15 feet. She said while architectural features
were not included in height computations, the addition met Code even if the cupola was
included in the measurement.
Robert Pergolizzi, representing the applicant, said the neighborhood featured small
offices on small lots; parking on the property in the front would conflict with the
neighborhood's ambience. He said while the rear of the property could only
accommodate 2 parking spaces, ample on-street parking existed.
Party Status Holder Jan Govan said he was an attorney and had worked as a city
planner. He presented photographs of his 2-story office/residence next door and a
neighborhood house with a flat roof on its front porch. He said he wanted to protect the
view from his second floor window. He said the extension was larger than reported. He
said he had requested the project extend less into the front yard or a flat roof cover the
porch. He said the project was inconsistent with Criteria 6, general standards for level
two approvals as the design did not minimize adverse visual effects. He supported
proposed parking. He said he met with the applicant who did not want to move the
building back but would consider a flat roof if architecturally acceptable.
Attorney Cole said the Staff Report did not request relief for the front setback or building
height; Code would permit the structure to extend 12 additional feet into the front yard.
She said the project's impact on Mr. Bevan's view was not before the board for

consideration. She said Mr. Bevan had referenced the previous submittal of a larger
plan; Staff Report dimensions were correct.
Planning & Development Director Michael Delk said the project was consistent with
Code which did not protect views; a 2 -story building would be permitted. Available
public parking was more than sufficient. The City supported applicant efforts to preserve
a large hickory tree in the back yard.
Attorney Cole said the applicant was attempting to save the tree while meeting Code
parking requirements. Mr. Delk said with board approval, the City would accept a single
handicapped parking space in the rear instead of two.
Support was expressed for allowing a single rear handicapped parking space if the
hickory tree would be preserved.
Member Anuszkiewicz moved to approve Case FLD2019 -01001 based on the evidence
and testimony presented in the application, the Staff Report and at today's hearing, and
hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report
with conditions of approval as listed including modification of Condition of Approval 11
to read "That prior to the issuance of any Certificate of Occupancy a minimum of two
CDC - compliant parking spaces will be provided on -site unless space is sufficient to
accommodate only one CDC compliant handicapped parking space while preserving
the hickory tree on- site." The motion was duly seconded and carried unanimously.
