MINUTES OF TH� MEETING OF TI� CZTY COl�QISSION
The City Commission, of the Citg �f Clearm:ater held a
Special Meeting in the City Hall at eight o'clock on the
even3ng oP September 23rd, 1940, for vrhich the following
notice had been delivered ta the Maycr and each Commissioner:
September 23, 1940.
There will be a special meeting of the City Commission
tonight at ei�ht ofclocls in the City Iiall to take the
place oi` the last regulr�r mseting which was postponed.

Minutes of the previ��us meeting were read and approved.
Sealed bids from oil companies rvere received by the Citp
Manager and presented to the Co�nission unopened. Mr. Hugh
Hayes, representing a majoritg oP the oil dealers in Glearwater
who have paid wholesale dealBrs lioense, stated that up until
the past two years the City had purchasPd its gas and oil on
a ti�o���ia��^� tsasis and stated that th�a City would save mone�
by adopting this plan agains and i�hat the City fox the past
two years has _lost money b�r nat purchasing on the rota�ing
p1an..�,ir. Reed, representing Shell Oil Gompan�, stated he
thought the City would save money by buging on a com�etitive
basis. Aftzr considerable diseussion between repsesentatives
of oil companiss �nd the City Gommiss3.on, moved by Mr. Seavy,
seconded by �r. Norton and unanimously csarrie� that the bids
be returned to the oil dealers and the matter be taken up at
an adjourned meetin� to be held at 5:00 o*clock Tuesday after-
noono
M. H. �'ones appeared before the Co�ission and asked
ii they would allow him to pay the accumulated taxes and
assessments and attornsy's cost of foreclosure proceeding
wl�ich would amount to $ 325.00 including 1940 taxes on
Lot 3 Block 7 Pine Crest Subdivision and issuing him s Pee
simple deed on same. bZoved by Mr. Grice, seconded by Mr.
Norton and unanimously carried that Mr, Jones' proposition
be acaepted.

Be it resolved by the City Commissioners of the
City of C1ear�vater, Florida, in meating assembled, that
the Mayor-CovIInissioner be, and he hereby is, authorized
to enter into an agreemant �vith the Atlantzo Coast Line
Railroad q.ompany, and to s3gn same on behalf of said
City, wh�reby the s�id Railroad Company giv�s and grants
ur�to the said Ci�y the r�ght mr,3 privilege to pay and
maintain, for tne purposs of conduc�ing gas,. a line of
14 inch wrought iron pipe across the right of way and
underneath the main tra�k of said Rai?road Company at
Clearwater, Florida, at a.p�int 1006 iset northwardly,
measured along the esnter line oP said track, from mile
post 135 (Prom SanPord); as more particularly described
in said agreement, whioh agreement is dated Sep�L'ember 13th

BE IT OFtDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER,
FLORIDA:
Section 1. The following words and ph�ases where used�
in this Ordinance shall for the purpose of this Ordinance have�
the meanings respectively ascribed to them in this section:
i_�� An operator is one who owns, leases, manages or
controls any o,P the machines or contrivances hereinaPter
described in this Ordinanoe. An operator is to embrace any _
person who for a percentage of the funds derived i'rom the
public use of the machines or contrivances hareinaPter
described, or Por any rent or other considerations permits
the use directly or indir_ectly oY the said machines or
contrivances.
(b) A location is the plaee �vhere a�y of the machines
or contriaances hereinaPter described in this Ordinance arQ
located for the use oP the public.
(c) A person shall include any firm, association or
�ox-poration. .
Section 2. It shall be unlawful for anq aperator io
operate, own,'mana,ge, lease or control, in the City of
Clearwater, any sutomatia phonograp�, piano, organ, �victrola, -
or a.ny musical instruraent or music play3ng machine o� any kind
and eharacter operated by �he use of a coin slot, and for anp
operator to s'urnish music through the use �� any mechanical
deviee to the publie for a consideration, until a licens�
has been procured from the City and also until that said
operator has paid to the City oi Clearwater an occupational
license ta$ oP � 200.00 per year.
Section 3. 'In addition to the above a�d Y�regoing
occupational license'tax, there shall be paid by the said
licensee a permit fee of � I.00 Por eaeh location wher�e an�
coin operated amusement machine, device or games are located,
and the ChioY oP Police shall issue permits i'or each locatiion
upon tne payment oi' the said asiditional � 1.00 herein provided,i�

Section 4. Bei'ore ��e issuance or any permit required
in Section 3 hereor, the Chie2' or Police shall determine that
the operator applying for the said permit ha� not been a party
to the mai3tenance oY any r�ui.sance, directly or indirectly,
in the Gity ot' Clearwater Por the preceding two years prior
to Lhe daLe oi' the application Por the said license. The
Chiet' or Police maq rei'use a permit ii' tne op$ra�tor applying
has been convi�ted oY a�elony, involving moral turpitude,.
eitines• in the State of' F'lorida or elsewhere.
Seetion 5. Upon tine ChieP oP Police notii'�ing the
operatior licensed under 5ectiion 1 or this Act that any
locatiien where n.e has any maenine or device as set up in
Seetion l nereor• is creating a nuisance, the said li.censPe
shall witinin tne period oP five (5) days recti�'y Lne said
conditiions sa�cisractorilp to the Chiei' oY Yolice; and upon
tne 2'ailure to do so, the City ':ovmiissioners, upon Lne re-
commendatiion of the Chier oi' Police, may revo�e and ca�cel
the permit issued Por that �artiicular loca�cion. IInon the
ceasing or said nuisance, upon application tne Chiei' oY
Poliee is au�tnorized to issue a ne�r permit upon conpliance
with Section 3 hereof, and said new psrr,�it is subject to
Section 5 ?�ereof.
Section 6. In es�ent oi non-�ayment of the licenses
herein provided, the C3ty Clerk is authorized to seize said
machine Por such non-payment, in which event there shall be
aaaea, charged and collectsd bg the Gity of Clearwater, sn
additional sum in the amount oP Ten Dollars (�10.00) �or
storage and hauling charges for each machine sa seized, and
such machine shall not be released or returned until and
unless the nperator has paid to the Citp o� Cleartivater the l
license fee and the '1'en Dollars (�10.00) stosage and hauling
charge.
Thai; t;he City Clerk of the City oY Clearwater is
hereby autnorized and directed, in all cases where there
has. been a seizure made for the non-payment of the license
fee for the machinea described in Sec�ion 2 hereof, to noti�'y
the ovmer or ptiiners, where possible9 of the said machines
that same are bzin� retained under the provisions of tlie
Ordinances of the Citp of �learwater, and shall, during the
period of thirt� days irom date oY said seizure, permit
the owner or oxmers to regain possession thereof by proof
o? ownership and the payment of all char�es connected with
the seizure and storage of the machines.

That a�ter the expiration of said thirty days period
the City Clerk shall sell any such machines not claimed or
reduced to possession by the ovrner or owners tiiereoP at
pubTic sale at'ter ten days' notice in writing to th� owne�
if he can be found, and by ad�vertisement in one issue of a
newspaper of general circulation 'i:n the Citp of Olearwater,
Florida.
That out oP the proceeds of the sale of an�* such
machines, all costa anci storage shall be firs�c paid, and
any balance r?m�ining shall be retained Tiy the City oi
CZsarwater in a fund in possession of said C3.ty, �or a
period oP six months in order to enable the o�vner or owners
of said machines to r�ovP ownership of said machines so sold
and when such ownership is pro�ren, such surplus fusid shall
be �qaid to �he o�vner.
After the expiration of sig months, as in the paragraph
next preceding provided any sums arising from the sales oi'
the said machines in aecordance with the provisions oY this
Ordinance, if' unclairn.ed by the owner or owners of the said
machines, shall be tr.ansferred to the general funds of the
City of Clearwater.
Section 7. Nothing herein contained shall allow the
o�e�ner or operator of any machines, mecnanically operated,
to gam.ble with or allow said machine to be operated as a
gr�mblin� device.
Section 8. A11 laws and parts oi' laws in conrYict with
�he proviaions oP this Ordinance are hereby repealed.
Section 9. If any part or parts oY this Ordinance are
Yor anp reason held ta be invalid, such decision shall not
afPect the validity og the remaining portions oP this
Ordinance.
Section 10. This Ordinance is hereby.declared to be a
necessary measure on the graund of urgent public-need for
the preservation of' peace, he�lth, sar'ety, convenience anrl
general welfare of the City oP Clearwater.
Seetion 11. Eve.r;� person convicted of a viol�tion oz any
provision o� this Ardinance shQll be punished by a i'ine of
not more than ;�100.Q0 or b y imprisonment in the Ci�y Jail Por
not more than sixty days, or by both such fine and imprisonment
in the discretion of the Judge,
