12/04/2000CITY COMMISSION SPECIAL MEETING CITY OF CLEARWATER December 4, 2000 Present: Brian J. Aungst Mayor/Commissioner J. B. Johnson Vice-Mayor/Commissioner Robert Clark Commissioner Ed Hart Commissioner Vacant Seat Commissioner Also present: William B. Horne II Interim City Manager Garry Brumback Assistant City Manager Pamela K. Akin City Attorney Cynthia E. Goudeau City Clerk Brenda Moses Board Reporter The Mayor called the meeting to order at 9:00 a.m. at City Hall to discuss filling the vacancy of Commission Seat 3. In response to a question, City Attorney Pam Akin said per the City Charter the Commission should make a good faith effort and is obligated to fill the vacancy but also provides a remedy should the vacancy remain unfilled. She said if the Commission fails to fill the vacancy within 60 days, a special election is required. It was remarked that critical decisions must be made prior to the March 2001 election and the vacancy should be filled. Commissioner Clark moved to appoint former Commisioner Ed Hooper. Upon the vote being taken, Commissioner Clark and Mayor Aungst voted “aye”; Commissioners Johnson and Hart voted “nay”. Motion failed due to a tie vote. Mayor Aungst moved to appoint David Hemerick. Upon the vote being taken, Commissioners Clark and Hart, and Mayor Aungst voted “aye”; Commissioner Johnson voted “nay”. Motion carried. Commissioner Johnson congratulated newly appointed Commissioner David Hemerick and said he would change his vote to “aye” in favor of the appointment. Upon the re-vote being taken, Commisioners Clark, Hart, Johnson, and Mayor Aungst voted “aye”. Motion carried unanimously.
