AMENDMENT TO ART AWARD AGREEMENTAMENDMENT TO ART AWARD AGREEMENT
THIS AMENDMENT TO ART AWARD AGREEMENT (the "Amendment") is made
effective this /0 day of December, 2018, by and among the Pinellas County School
Board and Justin McAllister (collectively the "Artist"), Ron Willis ("Property Owner"),
and City of Clearwater Community Redevelopment Agency, a redevelopment agency
established pursuant to law (the "CRA"), having its principal place of business at 112
South Osceola Avenue, Clearwater, Florida 33756.
WITNESSETH:
WHEREAS, the Artist and the CRA entered into an art award agreement (the
"Agreement") dated October 10, 2018, whereby the Artist agreed to convey certain
artwork to the Property Owner which the CRA agreed to pay for; and
WHEREAS, the parties now mutually agree to amend the Agreement solely with
respect to the party whom payment is directed;
NOW THEREFORE, for good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, the parties agree as follows:
1. Payment. Payment as outlined in the artist proposal attached to this
Amendment shall be issued to the non-profit Supporter of the Pinellas County Center for
the Arts of Gibbs High School.
2. Remainder of Agreement Unaffected. In all other respects, the remainder
of the Agreement shall remain in full force and effect. Any portion of the Agreement that
is inconsistent with this Amendment is hereby amended to be consistent.
3. Headings. The headings contained in this Amendment are for reference
purposes only and shall not modify or affect this Amendment in any manner whatsoever.
4. Counterparts. This Amendment may be executed in counterparts, all of
which together shall constitute one agreement binding on all the parties hereto.
IN WITNESS WHEREOF, the Artist, the Property Owner, and the CRA have
caused this Amendment to be duly executed on the day and year first written above.
