04/19/1999 - 9:00 AMCITY COMMISSION SPECIAL MEETING Closed Attorney/Client Session April 19, 1999 The City Commission of the City of Clearwater met in closed session at the Martin Luther King Center, Monday, April 19, 1999 at 9:00 a.m., with the following members present: Brian J. Aungst Mayor/Commissioner Ed Hooper Vice-Mayor/Commissioner J. B. Johnson Commissioner Robert Clark Commissioner Ed Hart Commissioner Michael J. Roberto City Manager Pamela K. Akin City Attorney James B. Thompson Esquire Absent: John R. Richardson Esquire The Mayor called the meeting to order and announced a closed session would be held for the purpose of discussing litigation regarding Ewa Skowronek, as widow and personal representative of the Estate of Wieslaw Skowronek, Deceased, and Ewa Skowronek, Individually vs. City, Clearwater Police Department, and John Smith. This meeting is exempt from the provisions of the Sunshine Law. The entire session was recorded by a certified court reporter and the transcript shall be made part of the public record upon conclusion of the litigation. The closed session adjourned at approximately 9:30 a.m. The meeting reconvened in open session at 9:35 a.m. The City Attorney recommended the Commission authorize settlement of this litigation. She indicated the amount of the settlement would exceed the statutory limits and will require a claims bill to be approved by the State legislature. If the Commission approves the settlement, the City would not oppose the claims bill. Commissioner Johnson moved to authorize up to $500,000 to settle this litigation. The motion was duly seconded and carried unanimously. The meeting adjourned at 9:40 a.m.
