To close out the correspondence below,we received the additional fittings requited to offset the water
main out of conflict on September 13th and completed the installation of them that same day,thus
ending the delay.
Per the contract, please allow this email to serve as our notice of extent of the claim (originally detailed
in the email below) and our request that the contract time be adjusted by three (3) additional days to
account for both the delay and the additional work required to mitigate the delay.Thank you.

Thanks for the direction. We have ordered the additional fittings and restraints so as soon as they are

Brian,
I discussed the conflict with the engineer, and you could use a 45 to offset the water main to the east.
Since the sanitary is much deeper than the water, the minimum horizontal distance can be 3' between
the outsides of the two pipes.

Ivan,
While excavating to install the new 6"water main running to the south end of Avanda Ct.,we
encountered a Verizon fiber optic line running parallel to the water main in direct conflict with it. The
plans show the Verizon cable/conduit running parallel to the new water main but anywhere from 4'-8'
to the west of it(see attached Plan Sheet 44), which would be plenty of room to install the
main. However,just to the south of the new storm sewer main between 2093 & 2072 we encountered
the Verizon line in conflict(line &grade)with the proposed water main. We brought this issue to the
attention of the on-site Verizon rep, Chris Blauvelt,who told us that Verizon isn't required to move the
line for the new water main at their cost. As of this point, until Verizon relocates their line or we are
directed by the City to re-route the water main,we cannot proceed with the installation of the main.
Per the contract documents, please allow this email to serve as our notification of an event with the
potential to give rise to a claim for an adjustment to the Contract Time and/or the Contract Price. Until
we have a solution to this conflict, we are unable to complete the water main, demo the old and
complete the subsequent roadway reconstruction in this location. As of now,we do not know the extent
of the impacts to the project, therefore,we are reserving our rights to recover all additional contract
time and/or any potential costs related to this issue . As always,we will do anything we can to mitigate
any delays or extra costs associated with this conflict.
