RE: Request for Lease Termination of the 11 Floor of Harborview Center
Dear Jim:
You may be aware that the Aquarium purchased a warehouse last year with the intentions of
preparing to ultimately move our warehouse operations out of Harborview Center (HVC).
Our construction timeline for the entire project on Island Estates is currently projected to be
completed in 36 months from October of 2016 or around September of "191, assuming we will
have adequate funding for continued construction throughout the project. Given that timeframe,
we would like to remain occupying the 2nd floor of HVC for the duration of our project since that
floor provides us with additional guest capacity while we are under construction.
The 31d Amendment to the HVC lease includes the following lease termination:
LEASE TERM.
The Term of the Harborview Lease shall extend beyond November 30, 2015 on a month-
to- month basis until terminated by either party in writing. Either Party hereto, at the
respective Party's sole discretion, may terminate this lease with six (6) months notice
("Notice Period") to the other party. The Parties may agree to a shorter Notice Period upon
mutual consent, provided that the Notice Period may not be less than thirty (30)days.
When we purchased the warehouse we obtained a mortgage on the property and we have
continued to pay rent to the City for the first floor of HVC since its purchase. To miniimize our
overhead, we would like to respectfully request a lease termination of the 1st floor and the old
Pickles Plus building of HVC effective May 1, 2017 if that is agreeable with the City while
continuing with our lease of the 2nd floor.
