The Chair called the meeting to order at 1:00 p.m. at City Hall, followed by the
Pledge of Allegiance.

Request: The Community Development Board is reviewing a 14 unit attached
dwelling project in the Old Florida Character District of Beach by Design and the
Tourist (T) District for property located at 12 Idlewild Street. The project is 65 feet
in height (from base flood elevation to roof), includes 28 parking spaces, requests
allowable flexibility consistent with Community Development Code Sections 2-
803.B and 3-1202.G; requests approval for construction seaward of the Coastal
Construction Control Line in Section 3-905 and a two-year Development Order
under the provisions of Section 4-407.

fields of comprehensive and redevelopment planning; zoning, historic preservation,
land development and landscaping ordinance interpretation, amendment and
administration; and site plan analysis and preparation. The motion was duly
seconded and carried unanimously.

Senior Planner Melissa Hauck-Baker said inconsistencies were resolved since the
June 19, 2018 meeting; the Fire Department required access leaving a 2-foot wide
landscaping area along the north access walkway for a permitted encroachment.
Color elevations were submitted. The Staff Report was unchanged. Staff
recommended approval.
In response to questions, Ms. Hauck-Baker said there was no requirement for
historical styling in the Old Florida District; all Beach by Design character districts
had the same design guidelines. Staff verified the project's compliance with Beach
by Design, including setbacks and stepbacks. The project was a level two
application because the building's height will be 65 feet measured from BFE (Base
Flood Elevation). As Beach by Design did not elaborate on a method to measure
building heights, staff relied on Code which dictated that building heights be
measured from BFE plus 1 foot of freeboard. An error in the Staff Report was noted;
this building's height was measured from BFE not grade.
Concerns were expressed balcony space may be part of the building's envelop,
changes in the plane on the building's north elevation appeared to be insufficient,
and the quality of materials may not meet Beach by Design standards. Ms. Hauck-
Baker said staff verified the project met all Beach by Design standards. Staff will
review project site lines for compliance with Code.
Concern was expressed re maintenance of proposed pond seaward of the CCCL
(Coastal Construction Control Line); the site plan did not indicate the area would be
sodded. Ms. Hauck-Baker said the stormwater narrative was submitted. FDEP
(Florida Department of Environmental Protection) approval of the pond was
required; the City could not delay the project while the applicant pursued FDEP
approval. If FDEP denies the request, the project would need to be altered. If a
substantial change was proposed, the project would return to the CDB (Community
Development Board).
Applicant Mehrdad Moshtagh said the structure's setbacks and stepbacks complied
with Beach by Design architectural requirements. He said the building would not
have any exterior wood. He said the stucco medallions were included in the design
to meet the decorative percentage requirement. He said all calculations re the size
of the development were based on inside air-conditioned space and did not include
balconies.
Party Status Holder James McCullough said he could not find anything on the
City's website re changes to the application since the last meeting. He expressed
concern the project's contemporary design was not consistent with or reflect the
character and history of the Old Florida District or exhibit high quality design
standards required by Beach by Design. He said illustrations in the Old Florida
District section of Beach by Design showed historical buildings.

Party Status Holder Robert Radomski said the proposed development was not
right for his neighborhood. He requested a feasibility study be done as many
similarly priced condominium units nearby were unsold. He expressed concern the
project could be abandoned after construction began, leaving behind a blighted lot
enclosed by chain link fencing. He requested the City limit construction start times,
traffic, and delivery trucks and require the site to be clean and maintained so that
residents are not burdened.
Planning & Development Director Michael Delk said the City could not restrict the
applicant's private property rights by requiring a feasibility study.
Discussion ensued with comments that lenders will determine if the project is
feasible before funding the development and the proposal had improved since last
month. The project's proposed landscape was commended.
Member Anuszkiewicz moved to approve Case FLD2017-12025 based on the
evidence and testimony presented in the application, the Staff Report and at
today's hearing, and hereby adopt the Findings of Fact and Conclusions of Law
stated in the Staff Report with conditions of approval as listed plus conditions: 1)
the project is required to have 27 medjool date palm trees Florida fancy grade with
20-foot clear trunks; 2) the building's height is to be measured from BFE (Base
Flood Elevation) not grade as incorrectly stated in the Staff Report; and 3) staff is
requested to verify that the size of the building's theoretical envelope complied with
Code. The motion was duly seconded and carried unanimously. Alternate Member
Van Scoyoc did not vote.
G. CONSENT AGENDA: The following cases are not contested by the applicant,
staff, neighboring property owners, etc. and will be approved by a single
vote at the beginning of the meeting: (Items 1-4)

Request: The Community Development Board (CBD) is reviewing a request to
amend the Clearwater Community Development Code to establish a new
Downtown District and Development Standards (Appendix C), establishing
development standards and a regulating plan for properties within the Downtown
Planning Area, and to make other amendments associated with the new
Downtown District, and making a recommendation to the City Council.

relating to housing policies, and updating appendices, and making a
recommendation to the City Council.
