Submittal Package Instructions & Checklist
IN ADDITION TO THE COMPLETED ANNEXATION PETITION FORM, ALL PETITION FOR ANNEXATION PACKAGES SHALL
INCLUDE A SUBMITTAL PACKAGE THAT INCLUDES THE FOLLOWING:
❑ Signed and sworn (notarized) disclosure of interest statement (form attached).
❑ If the property is not a platted lot of record, a current survey identifying the dimensions, area and location of the
property having been prepared, signed and sealed by a land surveyor currently registered in the State of Florida within
the most recent 12 months.
❑ If development is to be initiated prior to submission of an annexation petition and/or prior to the effective date of the
annexation, requisite site plans, plat, and/or engineering plans are required. City staff will review proposed plans to
determine their compliance with the City's Community Development Code.
❑ Terms of a proposed Agreement to Annex, if any.
❑ If the proposed annexation requires a change in the land use classification and zoning category assigned to the
property, a justification for such change must be submitted in writing. If the requested zoning is not consistent with the
Future Land Use Map of the City of Clearwater Comprehensive Plan, the applicant will be required to file a companion
application to amend the map.
❑ Proof of ownership (e.g., copy of deed, title insurance policy, or other instrument demonstrating ownership).
❑ If connection to city services is desired prior to the effective date of the annexation, applicant must provide notarized
Petition for Annexation Supplemental Statement (form attached).
❑ If applicant is designating an agent/representative to work with City, applicant must provide notarized Affidavit to
Authorize Agent/Representative (form attached).

Information for Applicants
The applicant or applicant's representative is encouraged to attend City Council public hearings unless the annexation
pertains to a property developed or to be developed with one single family dwelling.
STANDARDS FOR ANNEXATION
In determining whether to annex a property, the City shall consider the extent to which:
❑ The proposed annexation will impact public services (e.g., water, sewer, police, parks, etc.).
❑ The proposed annexation is consistent with the City of Clearwater Comprehensive Plan.
❑ The proposed annexation requires a change in the future land use and zoning classifications assigned to the
property as well as the jurisdiction for said change.
❑ Existing or proposed development is consistent with City regulations.
❑ Terms of a proposed Annexation Agreement, if any, promotes the City of Clearwater Comprehensive Plan.
PROPERTY OWNER AGREEMENT
Please be advised that, in consideration of the annexation, the property owners do hereby agree that:
❑ All structures and improvements which are erected upon said property subsequent to the date of this petition for
annexation shall comply with all applicable City of Clearwater regulations and ordinances as set forth in the City
Community Development Code;
❑ All residential rental units, including single-family residences must comply with the requirements in the city's
residential rental ordinance, which requires the property owner to obtain a Business Tax Receipt upon annexation
into the city;
❑ If development is to be initiated prior to submission of an annexation petition and/or prior to the effective date of
the annexation, requisite site plans, plat, and engineering plans shall be submitted to ensure compliance with the
city's Community Development Code (see Submittal Package Instructions Checklist). It is recommended that the
applicant meet with Planning and Development Department staff to review plans and/or discuss the applicable city
regulations;
❑ All annexations of residential dwellings of eight dwelling units or more shall convey such recreation facilities fees
and recreation land dedication and/or fees in the amount and manner prescribed by Chapter 54, Article II of
Clearwater Code of Ordinances; and
❑ When any substandard abutting street or utilities are subsequently upgraded by the City to meet City Standards,
said improvement(s) will be done on an assessment basis, consistent with City procedures therefore.

The Pinellas County Future Land Use map currently shows two designations, Preservation and
Residential Low on the subject property. Preservation covers approximately the western half of the

5) Countywide Map
The Countywide Plan Map designation for the subject site is Residential Low Medium and does not
appear to have any Preservation, though the scale is inconclusive. To the west the property abuts the
designation of Submerged Land.

6) City of Clearwater Zoning Atlas
The subject site abuts an area on the west which is designated as Preservation (P) on the City of
Clearwater's Zoning Atlas (page 2696, see section below). The City of Clearwater's Community
Development Code Section 3-907.A.1. requires a twenty-five foot vegetative buffer from any property
designated on the Zoning Atlas as preservation (P). On the City's Future Land Use Map, Water/ Drainage
Feature Overlay will be placed over proposed this required twenty-five foot buffer . The City
understands that this overlay is no longer a category in the Countywide Plan Rules.

Currently Stevenson's creek has a zoning designation of Preservation. The Community Development Code requires a 25
foot buffer from all properties zoned as Preservation. Requiring additional upland to be zoned Preservation as a buffer is
redundant with the code requirements and effectively increases the buffer requirement. It is the expert opinion of
Environmental Engineering that the creek area and up to the top of bank should be and remain zoned preservation.
From this zoning boundary, on the Future Land Use map, a 25 -foot overlay designation of Drainage should be in place
which will coincide with the required Preservation buffer but will not unduly extend it.

(7 3 8f5Map; Adjustment Consistent'Wrth Boundi lnterpretatron The provisions set forth
above relative to plan map boundary adjustments for Preservation and Recreation/Open
Space categories shall not be deemed map amendments; provided that such boundary
adjustments are:
Related to and consistent with a jurisdictional boundary determination under state
agency rules which is consistent with such rules; or
Related to and consistent with the purpose and characteristics of the particular
category being adjusted and, absent a determination by the Executive Director to
the contrary, based upon a finding by the local government with jurisdiction or its
designee that such adjustment is diminimus in extent and effect.
Submerged lands, as specifically defined within these Countywide Rules, may be added,
deleted or adjusted on the Countywide Plan Map in accord with a stormwater
management project, based on the request of the local government(s) with jurisdiction,
through the map adjustment process, based on the approved plan(s) for such project.
Nothing in these Countywide Rules shall require a local government with jurisdiction to
seek or obtain a Countywide Plan Map amendment or adjustment in advance of a
project to create, expand, reconfigure, or otherwise establish a body of water and/or
drainage feature in connection with a stormwater management project.
Upon approval of a final site plan or other authorized development order action of the
local government with jurisdiction, the established boundary survey or approved plan
shall be forwarded to the PPC. Any adjustments to the Countywide Plan Map deemed
necessary to more accurately reflect the boundary interpretation or approved plan on
the Countywide Plan Map will be considered for official acceptance by the CPA, upon
recommendation by the PPC, during the annual map update process referenced in
Section 2.2.2.
7.3.8.5.1 The PPC staff shall provide property owners affected by this map adjustment process
notice, which shall include the proposed map adjustments and the dates and times of
both the PPC and CPA public meetings at which the official acceptance of such
adjustments will be considered.
7.3.8.5.2 Determinations by the Executive Director under subsection 7.3.8.5 are interpretations
governed by Division 7.3_ Any map boundary adjustment determined under the
applicable provisions of these Countywide Rules for interpretation to be of such
significance as to require plan map amendment, shall comply with the otherwise
applicable provisions of these Countywide Rules for map amendment.
7.3.8.6 Cases Not Covered by 7.3.8.1 through 7.3.8.5. In cases not covered by Sec. 7.3.8.1
through 7.3.8.5, or where the property or street layout existing on the ground is at
variance with that shown on the Countywide Plan Map, the interpretation of the
Countywide Plan Map shall be in accordance with the purpose and intent of the

Thanks, Rodney, for understanding our situation and being willing to work with us on this one. Ella is working with
Engineering to prepare maps — we wanted to make sure things were generally ok with y'all before we finished
everything. She will send over a formal request soon. 15` reading is not until Mid -May, but for Annexations there are
rarely any questions or issues raised at Council.
This conversation did remind me that I had not seen through my commitment to submitting a follow-up map adjustment
to Forward Pinellas to remove the various residential and commercial designations on the actual preservation area the
City bought from the Clearwater Christian College (that got changed back last year when we unwound the development
agreement). I'll coordinate and have Ella include that in the same transmittal. Might as well do both at the same time. I
won't have a formal survey for that one though. I was going to highlight which areas to change, based on the maps we'd
used for the various land use amendments if that is OK.

We only require a survey if it is not a platted lot of record. This is a platted lot, so the legal description is in the Deed
which our Engineering Department has always deemed sufficient. Attached is the Plat for this area / property (Lot 23,
Block A).
In the time I've been with the City we've processed a handful of map adjustments.
1. Previously vacated ROW that hadn't been captured on the maps (no survey required, letter from Engineering
sufficient)
2. Small man-made stormwater pond that had been designated Water on the CW Map but didn't meet the
threshold because of size (less than 3 acres) at the time, so we requested the Water designation be removed
(survey provided to confirm size, applicant requested and City processed)
3. Removal of P & water/drainage feature from certain parcels in a neighborhood, and City applied
Water/Drainage to other parcels — City provided historic map and field operation, and applied
4. Clearwater Christian College adjustments (requested by College) based on their surveys and Wade Trim info
(pre -dated the land use map amendment)
5. Removal of Preservation from a paved area — provided certified site plan and other maps, but no survey.
6. Coordinated with Pinellas County to adjust a Preservation boundary along a wetland based on Jurisdictional
Survey provided by an applicant.
More than you asked, but I thought it showed the variety of information we've provided in the past and the types of
adjustments we've requested. Most have been straightforward and several were applicant driven so it was reasonable
to require the survey, and they tended to have it on hand anyway.
The City has always tried to make annexations as painless as possible for applicants because these are people who really
just want sewer and may not understand (nor need to know) all of the other stuff. We always say we're bringing in like
for like, and occasionally this means there is Preservation that could probably be adjusted but it isn't really necessary or
warranted at the time. This is the first time I've seen one that was worth investigating further and trying to handle
appropriately before annexation instead of figuring we'd get to it eventually. (Of course, as I said, that is still my ideal
situation for the others, especially since they aren't in City jurisdiction, unless you'd prefer I talk with the County sooner
rather than later and see what else can be cleaned up now.)

The City received a Petition for Voluntary Annexation for 1516 Stevenson's Drive. The property abuts Stevenson's Creek,
and on the Countywide Plan Map about % the parcel is designated as Preservation. The City designates Stevenson's
Creek as Water on the FLUM but as Preservation on the Zoning Atlas.
If you look at the aerials of this area, you can see that most of the properties have some sort of structure (pool, house)
in the areas shown as Preservation. For the parcel requesting annexation, there is a swimming pool and regular lawn.
The City's environmental specialist indicated that it was appropriate to designate the Creek, but the lawns adjacent are
not preservation and are incorrectly designated.
The City would like to utilize its administrative adjustment process available through our Community Development Code
to adjust the boundary lines at the time of Annexation. Michael Delk has this authority and is comfortable doing so
based on the recommendation of our environmental specialist. The CDC requires a 25' buffer from property Zoned
Preservation, so based on current Preservation boundaries, everything about this property is nonconforming — within
either Preservation or within that 25' buffer area. We wanted to change this to maintain the Preservation line as drawn
for Stevenson's Creek, but remove the Preservation designations on the Parcel. To address/reflect this buffer, our
environmental specialist requested that we place 25' of "Water/Drainage Feature overlay" on the parcel, based on the
existing Preservation zoning line. So, on the FLUM it would be Residential Urban with Water/Drainage Feature Overlay,
and on the City's Zoning Atlas the property would be Low Medium Density Residential only.
The City's code does not require a jurisdictional survey to make such an adjustment to the FLUM when such adjustments
"are consistent with the purpose and characteristics of the particular category being adjusted and are based upon a
finding of appropriateness by the Community Development Coordinator that such adjustment is de minimis in extent
and effect." Moreover, the CDC says "Zoning atlas adjustments may be made by the Community Development
Coordinator based upon information demonstrating errors or omissions, or based upon historical data."
I am providing a series of maps below to illustrate the issue both on the property requesting annexation and really in the
area as a whole. In the City, the Preservation line runs closer to the creek line, although it does come up onto parcels. I
don't know the history of this, but assume based on the pattern to the north and south of these parcels that there's a
strong possibility that the Preservation line was adjusted at some point. But parcels to the north (in the County) and
south (in the County), including the property that has requested annexation (1516 Stevenson's Drive) clearly have
structures in the area designated as Preservation.
If the City proceeds with annexation without making any map adjustments, it creates issues because what is built (a
pool) is not consistent with the purpose and characteristics of the City's Preservation District, so we would be
inappropriately designating property per our Code. And, it would not be appropriate to adjust the line only on the
Zoning Atlas, because then we wouldn't have consistent FLU and zoning.
I would like to discuss options for addressing this situation for this individual parcel. In the past, Mike Crawford allowed
for adjustments based on formal letters provided by the City's Engineering and/or Environmental staff when consistent
with aerials and other current data. The City is not likely to incur the cost of preparing a jurisdictional survey, nor is the
property owner. The property owner wants sewer service. I'd like to deal with this one parcel, but add the other
properties in the City to our long list of areas to look at more closely when we complete a large update to our comp plan
in the next year or two, because it would make sense to discuss a larger adjustment in this area (as well as others we've
previously talked with Forward Pinellas staff about). But that is not a priority at this point, and would probably be more
appropriate to discuss with Forward Pinellas as well as Pinellas County since many parcels in their jurisdiction have the
same issue.
If you would like to talk through this once you've reviewed the materials, I'd be happy to do so. As I said, we received
the Petition for Annexation, and based on our Code, we have a certain time frame upon which to complete the reviews,
prepare maps, etc. We are in the map preparation stage now.
