STANDARDS FOR ANNEXATION In determining whether to annex a property, the City shall consider the extent to which: ❑ The proposed annexation will impact public services (e.g., water, sewer, police, parks, etc.). ❑ The proposed annexation is consistent with the City of Clearwater Comprehensive Plan. ❑ The proposed annexation requires a change in the future land use and zoning classifications assigned to the property as well as the jurisdiction for said change. ❑ Existing or proposed development is consistent with City regulations. ❑ Terms of a proposed Annexation Agreement, if any, promotes the City of Clearwater Comprehensive Plan. Requiring additional upland to be zoned Preservation as a buffer is redundant with the code requirements and effectively increases the buffer requirement. It is the expert opinion of Environmental Engineering that the creek area and up to the top of bank should be and remain zoned preservation. From this zoning boundary, on the Future Land Use map, a 25 -foot overlay designation of Drainage should be in place which will coincide with the required Preservation buffer but will not unduly extend it. This is a platted lot, so the legal description is in the Deed which our Engineering Department has always deemed sufficient. Attached is the Plat for this area / property (Lot 23, Block A). In the time I've been with the City we've processed a handful of map adjustments. 1. Previously vacated ROW that hadn't been captured on the maps (no survey required, letter from Engineering sufficient) 2. Small man-made stormwater pond that had been designated Water on the CW Map but didn't meet the threshold because of size (less than 3 acres) at the time, so we requested the Water designation be removed (survey provided to confirm size, applicant requested and City processed) 3. Removal of P & water/drainage feature from certain parcels in a neighborhood, and City applied Water/Drainage to other parcels — City provided historic map and field operation, and applied 4. Clearwater Christian College adjustments (requested by College) based on their surveys and Wade Trim info (pre -dated the land use map amendment) 5. Removal of Preservation from a paved area — provided certified site plan and other maps, but no survey. 6. Coordinated with Pinellas County to adjust a Preservation boundary along a wetland based on Jurisdictional Survey provided by an applicant. More than you asked, but I thought it showed the variety of information we've provided in the past and the types of adjustments we've requested. Most have been straightforward and several were applicant driven so it was reasonable to require the survey, and they tended to have it on hand anyway. The City has always tried to make annexations as painless as possible for applicants because these are people who really just want sewer and may not understand (nor need to know) all of the other stuff. We always say we're bringing in like for like, and occasionally this means there is Preservation that could probably be adjusted but it isn't really necessary or warranted at the time. This is the first time I've seen one that was worth investigating further and trying to handle appropriately before annexation instead of figuring we'd get to it eventually. (Of course, as I said, that is still my ideal situation for the others, especially since they aren't in City jurisdiction, unless you'd prefer I talk with the County sooner rather than later and see what else can be cleaned up now.) The property abuts Stevenson's Creek, and on the Countywide Plan Map about % the parcel is designated as Preservation. The City designates Stevenson's Creek as Water on the FLUM but as Preservation on the Zoning Atlas. If you look at the aerials of this area, you can see that most of the properties have some sort of structure (pool, house) in the areas shown as Preservation. For the parcel requesting annexation, there is a swimming pool and regular lawn. The City's environmental specialist indicated that it was appropriate to designate the Creek, but the lawns adjacent are not preservation and are incorrectly designated. The City would like to utilize its administrative adjustment process available through our Community Development Code to adjust the boundary lines at the time of Annexation. Michael Delk has this authority and is comfortable doing so based on the recommendation of our environmental specialist. The CDC requires a 25' buffer from property Zoned Preservation, so based on current Preservation boundaries, everything about this property is nonconforming — within either Preservation or within that 25' buffer area. We wanted to change this to maintain the Preservation line as drawn for Stevenson's Creek, but remove the Preservation designations on the Parcel. To address/reflect this buffer, our environmental specialist requested that we place 25' of "Water/Drainage Feature overlay" on the parcel, based on the existing Preservation zoning line. So, on the FLUM it would be Residential Urban with Water/Drainage Feature Overlay, and on the City's Zoning Atlas the property would be Low Medium Density Residential only. The City's code does not require a jurisdictional survey to make such an adjustment to the FLUM when such adjustments "are consistent with the purpose and characteristics of the particular category being adjusted and are based upon a finding of appropriateness by the Community Development Coordinator that such adjustment is de minimis in extent and effect." Moreover, the CDC says "Zoning atlas adjustments may be made by the Community Development Coordinator based upon information demonstrating errors or omissions, or based upon historical data." I am providing a series of maps below to illustrate the issue both on the property requesting annexation and really in the area as a whole. In the City, the Preservation line runs closer to the creek line, although it does come up onto parcels. I don't know the history of this, but assume based on the pattern to the north and south of these parcels that there's a strong possibility that the Preservation line was adjusted at some point. But parcels to the north (in the County) and south (in the County), including the property that has requested annexation (1516 Stevenson's Drive) clearly have structures in the area designated as Preservation. If the City proceeds with annexation without making any map adjustments, it creates issues because what is built (a pool) is not consistent with the purpose and characteristics of the City's Preservation District, so we would be inappropriately designating property per our Code. And, it would not be appropriate to adjust the line only on the Zoning Atlas, because then we wouldn't have consistent FLU and zoning. I would like to discuss options for addressing this situation for this individual parcel. In the past, Mike Crawford allowed for adjustments based on formal letters provided by the City's Engineering and/or Environmental staff when consistent with aerials and other current data. The City is not likely to incur the cost of preparing a jurisdictional survey, nor is the property owner. The property owner wants sewer service. I'd like to deal with this one parcel, but add the other properties in the City to our long list of areas to look at more closely when we complete a large update to our comp plan in the next year or two, because it would make sense to discuss a larger adjustment in this area (as well as others we've previously talked with Forward Pinellas staff about). But that is not a priority at this point, and would probably be more appropriate to discuss with Forward Pinellas as well as Pinellas County since many parcels in their jurisdiction have the same issue. If you would like to talk through this once you've reviewed the materials, I'd be happy to do so. As I said, we received the Petition for Annexation, and based on our Code, we have a certain time frame upon which to complete the reviews, prepare maps, etc. We are in the map preparation stage now.
