Submittal Package Instructions & Checklist
IN ADDITION TO THE COMPLETED ANNEXATION PETITION FORM, ALL PETITION FOR ANNEXATION PACKAGES SHALL
INCLUDE A SUBMITTAL PACKAGE THAT INCLUDES THE FOLLOWING:
❑ Signed and sworn (notarized) disclosure of interest statement (form attached).
❑ If the property is not a platted lot of record, a current survey identifying the dimensions, area and location of the
property having been prepared, signed and sealed by a land surveyor currently registered in the State of Florida within
the most recent 12 months.
❑ If development is to be initiated prior to submission of an annexation petition and/or prior to the effective date of the
annexation, requisite site plans, plat, and/or engineering plans are required. City staff will review proposed plans to
determine their compliance with the City's Community Development Code.
❑ Terms of a proposed Agreement to Annex, if any.
❑ If the proposed annexation requires a change in the land use classification and zoning category assigned to the
property, a justification for such change must be submitted in writing. If the requested zoning is not consistent with the
Future Land Use Map of the City of Clearwater Comprehensive Plan, the applicant will be required to file a companion
application to amend the map.
❑ Proof of ownership (e.g., copy of deed, title insurance policy, or other instrument demonstrating ownership).
❑ If connection to city services is desired prior to the effective date of the annexation, applicant must provide notarized
Petition for Annexation Supplemental Statement (form attached).
❑ If applicant is designating an agent/representative to work with City, applicant must provide notarized Affidavit to

The applicant or applicant's representative is encouraged to attend City Council public hearings unless the annexation
pertains to a property developed or to be developed with one single family dwelling.
STANDARDS FOR ANNEXATION
In determining whether to annex a property, the City shall consider the extent to which:
❑ The proposed annexation will impact public services (e.g., water, sewer, police, parks, etc.).
❑ The proposed annexation is consistent with the City of Clearwater Comprehensive Plan.
❑ The proposed annexation requires a change in the future land use and zoning classifications assigned to the
property as well as the jurisdiction for said change.
❑ Existing or proposed development is consistent with City regulations.
❑ Terms of a proposed Annexation Agreement, if any, promotes the City of Clearwater Comprehensive Plan.
PROPERTY OWNER AGREEMENT
Please be advised that, in consideration of the annexation, the property owners do hereby agree that:
❑ All structures and improvements which are erected upon said property subsequent to the date of this petition for
annexation shall comply with all applicable City of Clearwater regulations and ordinances as set forth in the City
Community Development Code;
❑ All residential rental units, including single-family residences must comply with the requirements in the city's
residential rental ordinance, which requires the property owner to obtain a Business Tax Receipt upon annexation
into the city;
❑ If development is to be initiated prior to submission of an annexation petition and/or prior to the effective date of
the annexation, requisite site plans, plat, and engineering plans shall be submitted to ensure compliance with the
city's Community Development Code (see Submittal Package Instructions Checklist). It is recommended that the
applicant meet with Planning and Development Department staff to review plans and/or discuss the applicable city
regulations;
❑ All annexations of residential dwellings of eight dwelling units or more shall convey such recreation facilities fees
and recreation land dedication and/or fees in the amount and manner prescribed by Chapter 54, Article II of
Clearwater Code of Ordinances; and
❑ When any substandard abutting street or utilities are subsequently upgraded by the City to meet City Standards,
said improvement(s) will be done on an assessment basis, consistent with City procedures therefore.

Dear Madams:
Please be advised that the City of Clearwater is in receipt of applications for voluntary annexation for
City owned properties located at 3111 and 3109 Wolfe Road and 501 and 421 McMullen Booth Road.
The subject parcels are located within the City of Clearwater Planning Area and upon annexation into
the City of Clearwater will be served by city sanitary sewer when made available and solid waste
service.
The proposed annexations are consistent with Florida law regarding municipal annexations pertaining to
contiguousness with existing city boundaries and compact concentration. A copy of the petitions for
annexation and related documents are enclosed.
The following schedule has been tentatively established for the City's review of the application, as well
as their companion future land use and rezoning cases, LUP2017-01001 and REZ2017-01001. Should a

The Kapok Terrace Septic to Sewer project includes Wolfe Rd. The Engineering Department is starting the annexation
process for the right of way for Wolfe Rd. In reviewing this area, I noticed that there are four properties owned by the
city that can be annexed into the city at the same time as the right of way. Is Parks and Recreation the owner of these
parcels? If so I can annex these parcels into the city on the same application as the right of way. Who in your
department would I talk to about being the agent for this annexation?

Thank you for reaching out and contacting me with your concerns, both in phone calls and in writing regarding
the four properties at Wolfe Road and North McMullen Booth Road. In an effort to respond prior the public
hearing tonight I am emailing you directly and requesting that you share this with the other neighbors who
signed the letter.
Regarding your concerns related to the deed restrictions in place on 3111 & 3109 Wolfe Road, Laura Mahony,
Assistant City Attorney, has advised that the restrictions have been extinguished as they were not re-recorded
within thirty years of being recorded (in 1954) and therefore expired in 1984. If you have further concerns
regarding the deed restrictions please contact the City's Real Estate Services Coordinator, Mr. James Benwell,
at 727-562-4754.
The additional nine concerns you have laid out are all very specific to site design and operations of the park. At
this time the property is being annexed into the City of Clearwater and the future land use designation and
zoning district are also being amended to facilitate the parks use. A property's future land use designation sets
the maximum development potential for the site, and the zoning district establishes the uses allowed, and the
setbacks and maximum heights of any structures. Thus, the public hearing for these three applications
evaluates generally whether recreational uses would be compatible with the surrounding area, but does not
include/require a site plan as these cases do not approve specific developments.
I apologize as I am unable to answer your specific questions related to future site plan and operational
characteristics of the future park and/or trail head. The City's Parks and Recreation Department will lead any
development on the park property and at that time will engage the public when developing a proposed site
plan. If you would like to discuss site plan related concerns, please contact the City's Parks Planning & Project
Manager, Mr. James Halios, at 727-462-6563x225.

Dear Sirs,
It is our understanding the (1954) deed restriction on the property was nullified, resulting in the purchase of
the property by the City of Clearwater. Please explain how the city is able to circumvent the deed
restriction that requires only homes to be built on the property.
We understand that one of the more benign applications of the property would be for "recreation/open space"
ON, however, this neighborhood still has some concerns.
1. The plan indicated a 25.3 foot buffer on the east side of lot D. Is the buffer still in the plan?
2. Will there be security lights placed on the property and how will the lights be prevented from shining
into the windows of the adjacent properties?
3. What are the planned hours the area will be accessible?
4. Will the property be monitored for after hour violations?
5. Will there be noise restrictions for after hours?
6. Will there be a wall or solid fence to keep vehicular lights from shinning on our properties?
7. Will a barrier be constructed to prevent visitors from using Wolfe Rd as a shortcut to the trail?
An increase in foot and bike traffic on Wolfe Rd (with no sidewalk) will create a safety issue.
8. Will the restrooms be locked after hours?
9. Does the plan still call for 13 paved spots, 29 grass spots for a total of 42 parking spots?
Please provide a response prior to the public hearing to each of the individuals signed below.

Hey Ella,
I will try to summarize, in writing, what we discussed the other day:
There are no restrictions on the city acquiring the property at 421 & 501 McMullen Booth Road or 3109 & 3111 Woolfe
Rd. There are no restrictions on annexing these properties into the City of Clearwater. There are restrictions to certain
development/land uses for 3109 & 3111 Woolfe Rd. These subdivision restrictions are outlined in the attachment
"Eskew City Sale Restrictions."
These restrictions are recognized by city staff and will be factored into whatever designs and development that will take
place on these lots.
If the gentleman that you have dealt with, would like to call me to discuss anything, feel free to pass along my
information. If he has any project related questions, on what's to become of these properties, he will have to speak to
someone in P&R Department.
This council meeting is for the annexation of these properties into the city. His concerns about any development,on this
property, will be inappropriate to the item and will not be listened to at that time.

While the park has yet to be designed we do believe that reclaimed water will be needed and possibly potable water
