09/28/1992 CITY COMMISSION SPECIAL MEETING September 28, 1992 The City Commission of the City of Clearwater met at City Hall, Monday, September 28, 1992 at 9:10 a.m., with the following members present: Rita Garvey Mayor/Commissioner Richard Fitzgerald Vice-Mayor/Commissioner Lee Regulski Commissioner Sue Berfield Commissioner Arthur X. Deegan, II Commissioner Also present: Michael J. Wright City Manager M.A. Galbraith, Jr. City Attorney Cynthia E. Goudeau City Clerk The meeting was called to order for the purpose of discussing the Florida Gulf Coast Art Center agreement. The Florida Gulf Coast Art Center (Art Center) and City staff have been negotiating regarding the Art Center's acquisition of a portion of what is commonly called the Maas Brothers property. A referendum is scheduled to be held on November 3, 1992 for the voters to approve the sale to the Art Center. The agreement would go into effect only if the referendum is approved by the voters. The major provisions of the agreement are included in Ordinance #5283-92 which establishes the ballot question for the referendum and is made a part of the agreement as Exhibit 2. A question was raised regarding whether or not the amount of property being lessed out from the legal description to accommodate a turning radius at the corner of Cleveland and Osceola was the maximum that would be needed. Peter Yauch, Traffic Engineer, indicated this is the maximum and it is possible the City would need less for the turning radius. A typographical error in paragraph 11 was noted that in the second line, the word "until", should be "unto" and it was requested that in paragraph 16, the second line, the words "may be", be changed to "shall be". Commissioner Berfield moved to approve the agreement with the Florida Gulf Coast Art Center. The motion was duly seconded and upon the vote being taken: Commissioners Berfield, Deegan and Regulski and Mayor Garvey voted "Aye"; Commissioner Fitzgerald voted "Nay". Motion carried. The meeting adjourned at 9:15 a.m.
