04/18/1991 - 4:07 pm CITY COMMISSION SPECIAL MEETING FOP SERGEANTS AND LIEUTENANTS IMPASSE April 18, 1991 The City Commission of the City of Clearwater met in special session at City Hall, Thursday, April 18, 1991 at 4:07 p.m., with the following members present: Rita Garvey Mayor/Commissioner Sue Berfield Vice-Mayor/Commissioner Lee Regulski Commissioner Richard Fitzgerald Commissioner Absent: William Nunamaker Commissioner Also present: Kathy S. Rice Deputy City Manager M.A. Galbraith, Jr. City Attorney Debbie Crumbley City's Labor Attorney Cynthia E. Goudeau City Clerk The meeting was called to order for the purpose of resolving the Impasse with the FOP Sergeants and Lieutenants Union. The City Attorney opened the meeting by reading portions of his April 15, 1991 memorandum regarding the procedures to be used for this hearing. Debbie Crumbley, Attorney representing the City in the negotiations with FOP Sergeants and Lieutenants, stated the collective bargaining unit did not accept the agreement presented to them. Therefore, it is necessary for the Commission to take action regarding the contract. She listed the articles not at impasse as follows: Article 4 - No Strike Article 6 - No Discrimination Article 7 - Work Rules and Personnel Practices Section 5. Personnel Records Section 7. Tobacco Produce Usage Section 9. Outside Employment Section 10. Productivity Section 11. Take-Home Cars Section 12. Police Officers' Bill of Rights Article 8 - Prevailing Rights Article 9 - Existing Rules Article 10 - Duties of Police Sergeants and Police Lieutenants Article 12 - Promotional Procedure Article 13 - Direct Economic Provisions Section 3. Recall Pay Section 4. Acting in Higher Position Pay Section 6. Physical Examinations and Inoculations Section 7. Funeral Leave Section 9. Line-of-Duty Injury Pay Section 16. Legal protection Section 17. Copies of Municipal Code Section 18. Standby Pay Section 19. Special Duty Call Out Section 21. Tuition Refund Program Article 15 - Amendments Article 16 - Severability and Waiver Article 17 - Discipline Article 19 - Review Boards Article 20 - Training Article 21 - Pension/Social Security Article 22 - Contract Constitutes Entire Agreement of the Parties Miss Crumbley indicated that, as these articles are not at impasse, there is no action required by the Commission. She further reported that FOP Sergeants and Lieutenants and the City have agreed to a Joint Stipulation, and have allowed the changes in those articles at impasse to be imposed with stipulated language for the remainder of fiscal year 90/91. She listed those articles as follows: Preamble Article 1 - Recognition and Authorized Representatives Article 2 - City Management's Rights Article 3 - Grievance Procedure Article 5 - Stewards, Checkoff and F.O.P. Business Article 7 - Work Rules and Personnel Practices Section 1. Sick/Injury Leave Section 2. Military Leave Section 3. Time Off Section 4. Leave Without Pay Section 6. Residency Requirement Section 8. Seat Belts and Safety Equipment Use Article 11 - Seniority Article 13 - Direct Economic Provisions Section 1. Holidays Section 2. Vacations Section 5. Court Attendance Section 8. Uniform Allowance Section 10. Insurance Section 11. Work Week and Overtime Section 12. Wages Section 13. Compensatory Time Section 14. Shift Differential Section 15. Funeral Detail Section 20. Canine Assignment Section 22. Job Assignment Pay Section 23. Light Duty Assignment Article 14 - Bulletin Boards, Rules and Regulations, Memos and Copying of Agreement Article 18 - Substance Abuse and Testing Article 23 - Duration, Modification and Termination Commissioner Regulski moved that the City Commission adopt the parties agreement with regard to the imposition of the impasse articles with stipulated language effective immediately. The motion was duly seconded and carried unanimously. The meeting adjourned at 4:21 p.m
