03/18/1991 CITY COMMISSION SPECIAL MEETING March 18, 1991 The City Commission of the City of Clearwater met at City Hall with the following members present: Rita Garvey Mayor/Commissioner Richard Fitzgerald Vice-Mayor/Commissioner Lee Regulski Commissioner William Nunamaker Commissioner Sue Berfield Commissioner Also present were: Michael J. Wright City Manager M. A. Galbraith, Jr. City Attorney Cynthia E. Goudeau City Clerk The meeting was called to order at 9:08 a.m. and the following item was discussed: Item #1 - Resolution 91-10 - To the Florida Legistlature expressing opposition to proposed legislation relating to the subject of outdoor advertising. The billboard industry is mounting a lobbying effort to have legistation passed that would ban the use of an amortization period to remove bill boards. This special meeting was called in order to respond as quickly as possible to this effort. The Suncoast League of Municipalities has adopted a similar resolution. In response to a question it was indicated existing amoritization schedules will not be grandfathered. The provisions of the bill were reviewed and it was restated that the bill, if passed, will remove amoritization all together. A question was raised regarding the case citations attached to the bill including a case that had been appealed to the Federal Supreme Court and the lower court decision upheld. The City Attorney indicated he would research this. A concern was expressed that the City needs to be prepared to deal with the consequences should the bill pass. The City Attorney presented Resolution #91-10 and read it by title only. Commissioner Fitzgerald moved to pass and adopt Resolution #91-10 and authorize the appropriate officials to execute same. The motion was duly seconded, upon roll call the vote was: "Ayes": Regulski, Nunamaker, Fitzgerald, Berfield and Garvey. "Nays": None. The meeting adjourned at 9:16 a.m.
