09/05/1989 CITY COMMISSION SPECIAL MEETING September 5, 1989 The City Commission of the City of Clearwater met in special session at the City Hall, September 5, 1989, at 9:32 a.m., with the following members present: Rita Garvey Mayor/Commissioner Don Winner Vice-Mayor/Commissioner Lee Regulski Commissioner William Nunamaker Commissioner Richard Fitzgerald Commissioner Also present: Ron H. Rabun City Manager Milton A. Galbraith, Jr. City Attorney Cynthia E. Goudeau City Clerk The Mayor called the meeting to order. The purpose of the special meeting is to discuss an appeal on behalf of First Christian Church on the decision of the Pinellas Planning Council not to reclassify property from low density residential to public/semi public and an appeal of the decision by the Board of County Commission to the hearing officer for parcel #2 owned by Clearwater Christian College from low density residential to public/semi public. Item #1 - First Christian Church In February of 1989 the City Commission approved the annexation of property owned by First Christian Church and approved a zoning designation for PSP. Part of the annexation included a small parcel to the East side of the church property abutting Drew Street to the North. This parcel is at the intersection of Maywood Avenue and Drew Street with the remainder of Maywood Avenue being developed residentially. The Pinellas Planning Council approved the zoning and land use plan for the major portion of the annexation which is property to the West side of the church, but denied the rezoning of Parcel #2, stating that it is an intrusion into the single family residential area. In response as to why the city is appealing it was stated the church has requested that the City make this appeal. It is also stated this is coming to the Commission at this time as the church just decided on Friday how they wished to proceed. Commissioner Nunamaker moved to authorize the appeal of the decision by the Pinellas Planning Council. Motion was duly seconded. Upon the vote being taken, Commissioners Nunamaker and Winner and Mayor Garvey voted "aye", Commissioners Fitzgerald and Regulski voted "nay". Motion carried. Item #2 - Appeal of County Commission denial of rezoning request by Clearwater and land use plan amendment request by Clearwater Christian College. The City Commission had previously approved the land use plan amendment and zoning change for two parcels of property owned by Clearwater Christian College. The church had requested a land use plan amendment from low density residential to recreation open space and the zoning from RS4 to OSR on Parcel #1 and a land use plan amendment from low density residential to public/semi public and zoning amendment from RS4 to PSP for parcel #2. The request was made to reflect current ownership and to reflect planned preservation of publicly owned property known as Cooper's Point. The Board of County Commissioners denied the land use plan amendment as they wish the entire area to remain passive. The college wishes to install soccer fields and possibly parking on parcel #2, which is why they requested the PSP zoning. As the PPC had recommended approval their appeal will be automatic unless the City Commission takes action to not appeal the decision. Discussion ensued regarding the church'es desire to have limited use of the property. Discussion ensued regarding the effort to preserve Cooper's Point and it was stated that the parking would not be for individuals to visit Cooper's Point. In response to a question it was indicated that we could require turf block parking. No action was taken. The meeting adjourned at 9:55 a.m.
