AMENDMENT NO 1 - TIME ONLY EXTENSION TO THE COOPERATIVE AGREEMENT WITH THE CITY OF DUNEDIN FOR THE DEVELOPMENT OF THE COMPREHENSIVE WATERSHED MANAGEMENT PLAN FOR CURLEW CREEK AND SMITH BAYOUAMENDMENT NO. 1—TIME ONLY EXTENSION TO THE COOPERATIVE AGREEMENT WITH THE CITY OF CLEARWATER AND THE CITY OF DUNEDIN FOR THE DEVELOPMENT OF THE COMPREHENSIVE WATERSHED MANAGEMENT PLAN FOR CURLEW CREEK AND SMITH BAYOU THIS AMENDMENT NO. 1, made and entered into on the day of 20Lsi by and between Pinellas County, a political subdivision of the State of Florida, hereinafter referred to as the COUNTY, and the City of Dunedin, a municipal corporation in the State of Florida, hereinafter referred to as DUNEDIN, and the CITY OF CLEARWATER, a municipal corporation in the State of Florida, hereinafter referred to as CLEARWATER, collectively Parties. WITNESSETH, that: WHEREAS, the COUNTY, DUNEDIN, and CLEARWATER entered into an Interlocal Agreement for the development of a comprehensive watershed management plan for Curlew Creek and Smith Bayou on May 26, 2016, (hereinafter "Agreement") pursuant to which conveyance and water quality, including the requirements of the state's total maximum daily load program, requires the Parties to cooperate extensively on watershed studies and projects; and WHEREAS, Section 7 of the Agreement provides for modification in writing upon full execution by the Parties; and WHEREAS, the COUNTY and the CITIES now wish to exercise a time only extension to the Agreement. NOW THEREFORE, the parties agree that the Agreement is extended as follows: 1. The Agreement is hereby extended pursuant to Section 8 thereof, effective beginning March 31, 2018, continuing for two (2) years thereafter for a revised completion date of March 31, 2020, unless terminated or canceled in writing by the Parties as provided therein. 2. In accordance with Florida Statutes 163.01, the Florida Interlocal Cooperation Act of 1969, and prior to its effectiveness, this Amendment shall be filed with the Clerk of the Circuit Court of Pinellas County. 2. Except as changed or modified herein, all provisions and conditions of the original Agreement shall remain in full force and effect.
