FORBEARANCE STIPULATION AND A REEMENT
This Amendmernt to the Notice of Unsafe Building Forbearance dated December
21, 2016 {"Notice") is made and entered into on this fig"`day of January, 2018.
("Effective Date") by and between the Clearwater Fre and Rescue Fire Marshal
"Marshal") and 1100 CLEVELAND LLC. For good and valuabL- consideration, the
receipt and sufficiency Of which are hereby acknowledged. the.parties hereby agree to
amend the.Agreement as.follows:
1. Paragraph 7 is amended to extend the-period of time in which to begin
construction by two (2) additional months and shall read as follows:. "Once time
Confingencies are met, Marshal agrees to hold the .NotiCe ordering demolition in
forbearance for fourteen(14) months as described below: Buyer will take the following
actions to bring the:Premises into compliance with the Fre Gads"
2. Paragraph 7.b. is amended to extend the period of time.'in which to obtainbuilding and construction Permits per time site plan flexible development approvalby one
(1).additional month and shall read as follows* "Dlbtain any and all necessary building
and construction permits per the Plan within seven(7)months of Plan approval;"
3. Paragraph 8 is amended to `extend the period of time in which to begin
construction by two (2) additional months and shall read as follows: "In the event that
the forbearance period expires and Buyer has felled.to begirt construction within the 14
months of closing, Marshal and appropriate City officials may avail themselves of all
rights under the Notice as to the Premises and the Buyer, including but.not limited to
demolition of the Premises, and all.rights under federal, state, and local law to recover
from Buyer the amount of the demalitian, investigatitire coats, and attorney's time
expended in the prosecution and attempt at resolution in this matter."
4: All other terms and conditions of the Agreement shall remain in full force '
and effect. ,
IN WITNESS WHEREOF, all AarUes hereto have thecapacity and ability to bind
themselves and have caused this Amendment to the Agreement to be executed on this
