The residential direct exposure Alternative SCTL of 1.0 mg/kg will be used at this site. In accordance with rule requirements of subsection 62-780.220(7), Florida Administrative Code (F.A.C.), the Person Responsible for Site Rehabilitation (PRSR) for a contaminated site is required to provide notification of intent to use Alternative Cleanup Target Levels (ACTLs) to the local government(s) with jurisdiction over the property(ies) subject to the ACTLs, to real property owner(s) of any property subject to the ACTLs, to any resident or business tenant, and to any party holding a materially affected encumbrance in the area subject to the ACTLs. www. dep. statefl. us InitialNoticeLessees&Tenants-092313 FDEP Facility ID# 528734699 Page 2 The petroleum contaminated site referenced above is eligible for cleanup funding from the DEP and in accordance with subsection 62-780.200(31), F.A.C., the PRSR is the DEP when the DEP is conducting the site rehabilitation at facilities with discharges eligible for cleanup funding. Therefore, this letter and attached tables provide you with a copy of the noticing information. In January 2017, the United States Environmental Protection Agency (USEPA) updated the toxicity values for Benzo(a)Pyrene based on new data that has become available for the compound. Following that update, the University of Florida used the USEPA toxicity values and the direct exposure alternative SCTL formula presented in Figure 5 of Chapter 62-777, F.A.C. (residential and industrial/commercial scenarios) and Figure 8 of Chapter 62-777, F.A.C. (leachability), to calculate ASCTLs for BaP EQ (Attachment A). The calculated ASCTLs are: Direct Exposure ASCTL Milligrams; per kilogram (mg/kg) Residential 1.0 Commercial/Industrial 3.1 Leachability to Groundwater 4.7 Please contact me at 850/877-1133, Ext. 3716 for further information or to inspect the facility file.
