1. Case: FLD2017-06009 — 3009 Gulf-to-Bay Boulevard Level Two Application
Owner: Giant Oil, Inc.

Location: 1.009 acres located on the south side of Gulf-to-Bay Boulevard at the
south east corner of the South Bayview Avenue and Gulf-to-Bay Boulevard
intersection.
Request: The Community Development Board (CDB) is reviewing an automobile
service station in the US 19-Regional Center Subdistrict (US 19 — RC) for the
property located at 3009 Gulf-to-Bay Boulevard. The project is 22 feet in height
(from grade to top of parapet wall), includes 14 off-street parking spaces, and
requests allowable flexibility to development standards for Street Frontage for front
building fagades and entries and the location of a Stormwater Facility (Sections B-
703.D and B-703.1).

Attorney Brian Aungst requested Party Status on behalf of Our Lady of Divine
Providence House of Prayer.
Member Allbritton moved to grant Attorney Brian Aungst Party Status on behalf of Our
Lady of Divine Providence House of Prayer.
Member Allbritton moved to accept Kevin Nurnberger as an expert witness in the fields
of zoning, site plan analysis, planning in general, and the landscape ordinance. The
motion was duly seconded and carried unanimously.
Senior Planner Kevin Nurnberger reviewed the Staff Report.
George Padilla, representing the applicant, reviewed the project, stating it was well
designed and met Code. He said the applicant had worked with neighbors and agreed
to some additional conditions: 1) fund a traffic signal warrant analysis to see if the Gulf-
to-Bay Boulevard/S. Bayview Avenue intersection warranted a traffic signal which then
would require FDOT (Florida Department of Transportation) approval; 2) with FDOT
approval, stripe a westbound turn lane on Gulf-to-Bay Boulevard directed into the
property to alleviate S. Bayview Avenue traffic; and 3) install a 20-foot by 20-foot
triangle with poles on the site's northwest corner.

Discussion ensued re hazards experienced by S. Bayview Avenue drivers when they
turned onto Gulf-to-Bay Boulevard, due to the State Road's high traffic volume. Support
was expressed for a u-turn lane on Gulf-to-Bay Boulevard.
Member Allbritton moved to accept Robert Pergolizzi as an expert witness in the fields
of transportation and urban planning. The motion was duly seconded and carried
unanimously.
Party Status Holder Aungst said significant development off N. Bayview Avenue created
additional delays and public safety impacts at the Bayview Avenue/Gulf-to-Bay
Boulevard intersection. He encouraged the City to lobby FDOT to install a traffic signal.
He requested that staff ensure that appropriate signage direct site egress to Gulf-to-Bay
Boulevard and not Bayview, and that conditions of approval require installation of the
triangle and that the applicant stripe a westbound left-turn lane on Gulf-to-Bay
Boulevard. He requested the ability to review the development order to be certain it
included CDB (Community Development Board) conditions.
Robert Pergolizzi, representing the applicant, said substantial side street traffic would
be necessary to warrant a traffic signal. He said striping a left-turn lane for the site
would not impact a traffic signal.
Six people spoke on the importance of a traffic signal as Bayview drivers were
endangered when accessing Gulf-to-Bay Boulevard, concerns were expressed that
customer ingress and egress should be via Gulf-to-Bay Boulevard only as Bayview
traffic already backed up at Gulf-to-Bay Boulevard, the project would increase
neighborhood traffic, noise and crime and imprison residents in their neighborhood, the
facility should close between 11:00 p.m. and 6:00 a.m., an 8-foot solid wall along the
southern border should be required to mitigate noise and light, a 15-foot vegetation
buffer should separate the wall from the project and block views of the building's rear,
the ingress should be at least 10 feet from the wall, trash and its associated odors
should be located away from residential property, and the applicant should pay for the
traffic signal and compensate neighbors for property value depreciation resulting from
the project.
Assistant City Attorney Camilo Soto said the applicant had agreed to install the triangle,
build an 8-foot wall along the southern property line, and pay for a traffic signal warrant
analysis. If approved by FDOT, the City would be responsible for traffic signal
construction costs. Based on Code, the project was not required to develop a traffic
management plan.
Party Status Holder Aungst expressed concern the project would negatively impact the
historic neighborhood's tranquility, serenity, and peace.

Mr. Padilla said the applicant had agreed to install the 8-foot wall on the site's south
border. He said the Police Department was responsible for monitoring noise. He said
the business would operate 24 hours a day to better serve the community. He said the
building's rear would have much glazing and the access ladder would be removed. He
said landscaping would meet Code. He said the size of the Bayview entrance was
important to accommodate fuel tanker access to the tanks. He supported maintaining
site ingress/egress on Bayview.
Member Quattrocki moved to approve Case FLD2017-06009 based on the evidence
and testimony presented in the application, the Staff Report and at today's hearing, and
hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report
with conditions of approval as listed plus reinstating conditions of approval 7 and 8, but
excluding requirement for Giant Oil to fund installation of the traffic signal equipment,
amending condition of approval 9 (numbered without conditions 7 and 8) to increase the
height of the wall along the south property line to 8 feet, and removing the access
ladder from the building's rear. The motion was duly seconded and carried
unanimously.
G. LEVEL THREE APPLICATIONS: (ITEMS 1-2)
1. Case: LUP2017-09008 — 1528 Lakeview Road Level Three Application

Location: 1.332 acres located on the north side of Lakeview Road approximately
500 feet east of South Highland Avenue.
Request: The Community Development Board (CDB) is reviewing a request to
request to amend the Future Land Use Map designation of a 1.332-acre property
from Residential Low (RL) and Residential High (RH) to Residential/Office General
(R/OG) and making a recommendation to City Council.

Assistant Planning & Development Director Gina Clayton reviewed the Staff Report. A
building plan was not submitted. The owner wanted the property's zoning and Future
Land Use Map designation to conform with its historic use to attract buyers.
Attorney Craig Taraszki, representing the property owner, said the structure had the
same use since it was built around 1985 when the City approved a special exception for
its zoning and Future Land Use Map designation. He said recently the City encouraged
the property owner to obtain a clean title. He said requested changes would reduce the
property's development potential. He said the request would provide a reasonable
transition between more intense neighborhood shopping and residential uses. He said a
business occupied the building.

Two residents spoke in opposition to the request, stating the changes would adversely
impact the integrity of the residential neighborhood and not benefit its residents. They
expressed concerns the building was in the middle of a residential neighborhood, close
to Kalmia Condominium residents, was empty for many years, and currently had trash,
debris, overgrowth, wire barrier fencing, and illegal parking.
Support for the request was expressed as it would bring the use into conformity. It was
stated that violations at the property needed to be reported to Code Enforcement.
Member Lau moved to recommend approval of Case LUP2017-09008 based on the
evidence and testimony presented in the application, the Staff Report and at today's
hearing, and hereby adopt the Findings of Fact and Conclusions of Law stated in the
Staff Report. The motion was duly seconded and carried unanimously.
2. Case: REZ2017-09008 — 1528 Lakeview Road Level Three Application

Density Residential (HDR) Districts to Office (0) District and making a
recommendation to City Council.

Ms. Clayton reviewed the Staff Report. The entire property would be rezoned. In
response to a question, Ms. Clayton said the parking lot would require landscaping if the
parcel was redeveloped. The City had no control re people smoking on site. Code
Enforcement could work with the owner to bring the property, including landscaping, into
compliance.
Attorney Craig Taraszki, representing the property owner, requested that his previous
testimony be incorporated in this case.
One resident opposed the request, stating the City had a significant amount of empty
office space elsewhere, the structure did not fit in the neighborhood, and units for
residents older than 55 would be a better use for the property.
Discussion ensued with comments that no one had come forward to develop senior
living units on the property during the many years it was for sale and the current use
had been in place for a long time.

Member Anuszkiewicz moved to recommend approval of Case REZ2017 -09008 based
on the evidence and testimony presented in the application, the Staff Report and at
today's hearing, and hereby adopt the Findings of Fact and Conclusions of Law stated
in the Staff Report. The motion was duly seconded and carried unanimously.
H. DIRECTOR'S ITEMS
Chair Funk reviewed his letter to the CDB that stated member talents were not "used to
their highest and best use" and its professional members were "eminently qualified to
approve and make recommendations that aid in shaping the City of Clearwater's
development and growth" by viewing areas in their entirety. He wrote the CDB had little
or no input re several significant bulk changes, significant new ordinances, and plan
changes. He said he had served on another municipality's planning board which met
more often, provided more input in the city's planning, and was involved in overall
approval of zoning and future land use maps. He recommended the board meet in work
sessions where "each member would have the opportunity to discuss ... areas of city
planning that with the input of all the board members could result in significant progress,
especially in certain areas of the city" and to review with staff and consider actionable
items re "areas of city planning that the CDB should be more involved in" than simply
viewing applications. He recommended the board address downtown and adjacent
areas.
Discussion ensued with comments that a workshop may be a vehicle to present
member concerns re issues such as bicycle corridor use and needs, make suggestions,
provide member input while planning processes were underway, and provide
community input through members.
Ms. Clayton said staff could look at scheduling updates for board members re upcoming
and long range projects with opportunities for member input. Staff will present the
downtown plan update next month and update on a grant to develop a complete streets
policy for Drew Street that will be a pilot for citywide policy. Downtown zoning changes
were planned for 2018.
