MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF CLEARWATER
POLICE DEPARTMENT AND THE INDIAN SHORES POLICE DEPARTMENT
WHEREAS, The Clearwater Police Department, hereafter referred to as CPD, and the
Indian Shores Police Department, hereafter referred to as Contract Agency (CA), are both
criminal justice agencies, formally recognized by the Florida Department of Law
Enforcement (FDLE), and; CPD and the CA are headquartered within the boundaries of the
State of Florida, and;
WHEREAS, CPD wishes to utilize CA for the purpose of providing security and law
enforcement services for events within the boundaries of the City of Clearwater and;
THIS MEMORANDUM OF UNDERSTANDING, is entered into as of the 3 r4 day
of January, 2018, between the CA, whose mailing address is 19305 Gulf Boulevard, Indian
Shores, Florida, 33785and the Clearwater Police Department, whose mailing address is 645
Pierce Street, Clearwater, Florida 33756.
WHEREAS, Clearwater Police Chief Daniel Slaughter intends to request mutual aide
assistance for the purposes of providing security for contracted vendors within the boundaries of
the City of Clearwater.
NOW THEREFORE, the parties hereto agree as follows:
1. Extra-Dutv Jurisdiction. The parties agree that the CA will cover Extra -Duty Details
designated by Chief Slaughter so the Clearwater Police Department can allocate its resources to
meet the needs of general calls for service within the boundaries of the City of Clearwater. The
parties agree that the services will be effective from January, 2018 to December 31, 2018. If a
felony or misdemeanor involving a breach of the peace is committed in the presence of a CA, the
police officer while the officer is performing an Extra -Duty Detail pursuant to this
Memorandum, the CA police officer shall immediately request the assistance of a Clearwater
police officer.
2. Payment: The parties agree that Vendors will be charged $40.00 an hour for Extra -Duty
Details that are booked seven (7) days or more in advance, with $35.00 an hour going to the CA
officer assigned to the Extra -Duty Detail and the remaining $5.00 going to the Clearwater Police
Department as an administrative fee. Requests for Extra -Duty officers within seven (7) days will
be evaluated on a case by case basis. In the event that an Extra -Duty Detail is approved within
seven (7) days, the Vendor will be charged $45.00 an hour, with $40.00 going
to the CA officer assigned to the Extra -Duty Detail and the remaining $5.00 going to the
Clearwater Police Department as an administrative fee.
For Extra -Duty Details where a marked police vehicle is required or requested, the rate for the
marked police vehicle will be waived in the event a CA is assigned to the event.
Furthermore, if a supervisor is required and/or requested, the below listed billing rates apply:
• Lieutenant in a supervisory capacity $50.00/hour $60.00/hour (Premium)
• Sergeant in a supervisory capacity $45.00/hour $55.00/hour (Premium)
Holiday Pay:
The premium rate charge will be applied to all jobs on the following holidays:

The parties agree that at the end of the week, the CA will furnish a detailed invoice to the
Clearwater Police Department with the total amount of Extra -Duty Details worked and the
amount owed. The Clearwater Police Department will in tum pay the CA the invoice amount.
3. Officer's Pay Voucher: The parties agree that all CA officers working an Extra -Duty Detail
for the Clearwater Police Department will complete a pay voucher, which will be signed by all
Vendors if available. The white copy will be submitted to the Clearwater Police Department
payroll department, the red will remain with the Vendor and the CA will maintain the yellow for
his/her records.
4. Cancellation: In the event a CA officer is unable to work an assigned detail, the CA officer
shall contact the Extra Duty Coordinator as early as possible at 727-562-4152. If outside of
normal business hours, the CA officer shall contact Clearwater Police Department
Communication Center at 727-562-4235
5. Termination: The parties agree that this MOU will end at 2400 hours on Monday, December
31, 2018. This agreement will be made available to CA to renew the agreement with terms and
conditions updated as both parties see fit.
6. Indemnification Clause: The CA will hold harmless and indemnify the City of Clearwater,
including all of its officers and employees, from any claim, loss, damage, cost, or expense,
including attorney's fees and any costs incurred in enforcing this indemnity agreement, arising
out of any act, error, omission, or negligent act by officers and employees of the CA, during the
extra -duty assignment covered by the terms of this Memorandum of Understanding. However,
neither the CA nor its officers or employees shall be liable for any claim, loss, damage, cost,
expense, or attorney's fees attributable to any error, omission, or negligent act by the City of
Clearwater, including its officers and employees. Nothing herein shall be construed to waive or
modify the provisions of Section 768.28, Florida Statutes or the doctrine of sovereign immunity.
