This FIRST AMENDMENT TO THE INTERLOCAL AGREEMENT BETWEEN
PINELLAS COUNTY AND NPDES MS4 CO-PERMITTEES FOR WATER QUALITY
AND BIOLOGICAL MONITORING (this “First Amendment”), is made and entered into
on this _____ day of ________________ 2017, between (1) Pinellas County, a political
subdivision of the State of Florida (the “COUNTY”); and (2) certain co-permittees of the
COUNTY’s National Pollutant Discharge Elimination System (“NPDES”) Municipal
Separate Storm Sewer System (“MS4”) Permit FLS000005: Town of Belleair, City of
Belleair Beach, City of Belleair Bluffs, City of Clearwater, City of Dunedin, Town of
Kenneth City, City of Gulfport, City of Indian Rocks Beach, City of Largo, City of
Madeira Beach, Town of North Redington Beach, City of Oldsmar, City of Pinellas Park,
Town of Redington Beach, Town of Redington Shores, City of St. Pete Beach, City of
Safety Harbor, City of Seminole, City of South Pasadena, City of Tarpon Springs, and
City of Treasure Island (although separate parties hereto collectively the “CO-
PERMITTEES”).
WITNESSETH:
WHEREAS, this First Amendment is made and entered between the COUNTY and
the CO-PERMITTEES pursuant to Section 163.01, Florida Statutes, the “Florida
Interlocal Cooperation Act of 1969”;
WHEREAS, the COUNTY and the CO-PERMITTEES entered into an agreement

(the “Agreement”) dated December 10, 2013 providing for the operation and
maintenance of a Water Quality Monitoring Program and Biological Monitoring Program
using COUNTY staff and equipment, as set forth in detail in “Exhibit A – PINELLAS
COUNTY AMBIENT WATER QUALITY MONITORING PROGRAM” of the Agreement;
and
WHEREAS, the COUNTY and the CO-PERMITTEES wish to extend the term of
the Agreement and update information regarding proper notice in the Agreement.
NOW THEREFORE, in consideration of the mutual covenants set forth herein, the
COUNTY and the CO-PERMITTEES agree as follows:
A. SECTION 5. NOTICES of the Agreement is replaced in its entirety with the
following language:

B. SECTION 9. AGREEMENT TERM of the Agreement is replaced in its entirety

This Agreement shall take effect as provided in Section 12 and shall remain in
effect until December 31st, 2020, unless renewed in writing by mutual agreement
of all parties hereto for an additional length of time.

C. Except as modified, amended or changed in this First Amendment, all of the
terms and conditions of the Agreement shall remain in full force and effect.
D. As required by Section 163.01(11), Florida Statutes, this First Amendment shall
be filed with the Clerk of Circuit Court of Pinellas County, Florida after this First
Amendment has been fully executed by all parties hereto, and shall take effect
upon the date of filing.
