The Chair called the meeting to order at 1:00 p.m. at City Hall, followed by the Pledge of

Request: The Community Development Board (CDB) is reviewing a proposed 88-
room hotel in the Tourist (T) District for the property located at 355 South Gulfview
Boulevard and 348 Coronado Drive. The project is 100 feet in height, includes a
minimum of 106 parking spaces and requests allowable flexibility from height and
setback requirements and Section VII.C.2 of the Design Guidelines of Beach by
Design; a Termination of Status of Nonconformity with regard to density; and a two-
year Development Order (Community Development Code Sections 2-803.D and 4-
407).

Attorney Paul Gionis, representing Michael Preston, objected to the notice of hearing,
requested Party Status, and additional time to speak.
Acting Member Hayden moved to grant Attorney Paul Gionis Party Status on behalf of
Michael Preston. The motion was duly seconded and carried unanimously.
Consensus was to increase the time allotted for Party Status and applicant comments
by 5 minutes.
Member Anuszkiewicz moved to accept Mark Parry as an expert witness in the fields of
redevelopment planning, comprehensive planning, annexation implementation, zoning,
land use/rezoning applications, land development, general planning, code amendments,

landscape ordinance, and special area plans/overlay districts. The motion was duly
seconded and carried unanimously.
Senior Planner Mark Parry reviewed the Staff Report. In response to questions, Mr.
Parry said Beach by Design acknowledged constraints on S. Gulfview Boulevard,
associated limitations, and that redevelopment likely required encouragement. Vacation
of the right-of-way would seamlessly link the hotel with BeachWalk. Parking would be
under the building; the ground level outdoor seating area must be maintained. Step
backs were required on Coronado, not S. Gulfview. The main entrance canopy and
building materials met Beach by Design guidelines and color pallet. The goal of the unit
reserve was to encourage development of limited service hotels.
Assistant Director of Planning & Development Gina Clayton said Gulfview Boulevard
reconstruction intended redevelopment to include the right-of-way. The City was not
compensated for vacating rights-of-way for the Hyatt, Wyndham, and other S. Gulfview
properties nor would it be compensated for vacating the subject right-of-way.
Discussion ensued with comments the vacation would make the development more
welcoming to BeachWalk and concerns the right-of-way currently provided public green
space that had significant pedestrian use and the project would bottleneck pedestrian
traffic by using the right-of-way for a parking lot.
Attorney Marilyn Healy, representing the applicant, reviewed the request, stating the 88-
room project would feature an outdoor cafe and other amenities in the right-of-way,
replace blight on south BeachWalk, and provide tourists with an affordable quality
experience. She said the City Council had approved the density and conceptual plan.
She distributed the proposal and expert witness resumes, requesting the CDB
(Community Development Board) accept the witnesses as experts in their fields:
Michael Palmer, Civil Engineer, Istvan Peteranec, Architect, Sue Ann Murphy, Land Use
Planner, and Robert Pergolizzi, planning, land use, and traffic impact studies.
Member Allbritton moved to accept Michael Palmer, Istvan Peteranecz, Sue Ann
Murphy, and Robert Pergolizzi as expert witnesses in their fields. The motion was duly
seconded and carried unanimously.
Sue Ann Murphy, representing the applicant, said the project's height and massing were
less than required and its architectural detail was greater. She said the current hotel
abutted the restaurant next door while the project provided a landscaped setback. She
said the project was smaller than nearby developments and met the goals and vision of
Beach by Design.
In response to questions, Istvan Peteranecz, representing the applicant, said
pedestrians could walk to the hotel entrance under the 2-story high Porte Cochere. He
said the building will not be in the right-of-way and will be setback farther than the

restaurant next door. He said the ground level cafe will be open to the public. He said
the design was based on negotiations and discussion with City staff. Ms. Clayton said
the building could have extended into the right-of-way.
Party Status holder Attorney Gionis, representing Michael Preston, objected to the
notice as it did not indicate the site included the right-of-way, which had not been
vacated. He said the parcel was smaller than contemplated for the development. He
requested the case be continued to provide him sufficient time for review.
Attorney Soto said the right-of-way belonged to the City; the separate vacation process
would not occur at this meeting. At its July 20, 2017 meeting, the City Council
contemplated the future vacation of the right-of-way when approving the conceptual
plan and reserve units. Attorney Gionis did not raise an objection while present at that
meeting.
Attorney for the Board Jay Daigneault opined that the meeting notice was proper.
Party Status holder Attorney Gionis, representing Michael Preston, said the right-of-way
should have been vacated before today's meeting and he would object to its vacation.
He opposed the proposed use of the right-of-way as BeachWalk was intended to be a
promenade and the hotel's parking lot entrance across it did not comply with Beach by
Design. He said the project would block public sight lines.
Attorney Healy said the City's normal process was to present a case before approval of
a right-of-way vacation.
Attorney Soto concurred. The subject right-of-way was not green space or parkland. Mr.
Parry said Beach by Design listed no preference for public green space and Code did
not grant rights to a view. Without the vacation, the redesign of the hotel with 80 units
would have to be approved by the City Council and CDB.
One person spoke in support of the project.
Party Status holder Attorney Gionis, representing Michael Preston, restated his
objections.
Attorney Healy said the City Council approved the project's density last July. She said
the outdoor cafe will attract pedestrians. She said the project met Beach by Design
guidelines. She said Attorney Gionis provided no evidence refuting expert witness and
staff testimony and he could have appealed the project months ago. She said the Staff
Report clearly stated the right-of-way vacation was a separate process.
Opposition was expressed to the project which would make the sidewalk unsafe, the
project's use of density units, and the entry did not incorporate pedestrian flow or

connect well with BeachWalk. If was questioned if 3 small tables were sufficient for a
cafe. Concern was expressed that flaws in Beach by Design allowed right-of-way
vacation to be developed with sheer walls that abutted BeachWalk rather than
openness. It was stated the beach had too little green space and it was suggested the
City develop the right-of-way as a parkway.
Support was expressed with comments that the process was followed re notice and at
today's hearing, the project was setback from the right-of-way and exceeded Code and
Beach by Design requirements, the applicant met the burden of proof, the architect did
a fantastic job; the hotel featured rich materials, a well-crafted human scale open space
entrance, and a beautiful Porte Cochere. The building's open street level was
complimented. Concerns were expressed that the final product may not feature all
decorative details that made the project attractive in the drawings.
Member Lau moved to approve Case FLD2017-07012 based on the evidence and
testimony presented in the application, the Staff Report and at today's hearing, and
hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report
with conditions of approval as listed. The motion was duly seconded. Members
Allbritton, Anuszkiewicz, Lau, Flanery, and Quattrocki voted "Aye"; Chair Funk and
Acting Member Haydon voted "Nay." Motion carried.

two attached dwelling units in the Medium Density Residential (MDR) District for the
property located at 1805 East Drive, 1807 East Drive, and 1809 East Drive. The
project includes six off-street parking spaces and requests allowable flexibility from
termination of status as a nonconformity requirements and landscape requirements
(Sections 6-109.0 and 3-1202.G).

Request: The Community Development Board is reviewing a proposed 11,037
square-foot vehicle service/office use in the Commercial (C) District for the property
located at 2337 Gulf-to-Bay Boulevard. The project is 27 feet in height, includes 53
off-street parking spaces and requests allowable flexibility from landscape
requirements (Sections 2-704 and 3-1202.G.).

Attorney Katie Cole, representing the applicant, requested an additional 10 minutes for
her presentation.
Member Anuszkiewicz moved to provide the applicant and staff an additional 10
minutes for presentations. The motion was duly seconded and carried unanimously.
Member Anuszkiewicz moved to accept Robert Tefft as an expert witness in the fields of
zoning, site plan analysis, code administration, and planning in general. The motion was
duly seconded and carried unanimously.
Senior Planner Robert Tefft reviewed the Staff Report. Staff recommended denial; the
Code permitted limited vehicle service in the commercial district but not adjacent to
residential property. In response to a question, he said the City had not received
objections to the request; the owner of the mobile home park, which had a common
property line, received notice of the hearing but not the residents. The property was
staked. He reviewed locations of nearby limited vehicle services; some uses were
grandfathered.
Discussion ensued with comments that a buffer and block wall separated the properties,
mobile home residents may not have known about the project, the bays opened
east/west and not toward residences, sound levels would be reduced by the closed bay
doors, and a concern that the project did not comply with Code.

Attorney Cole reviewed the request to construct a building for an AAA (American
Automobile Association) office, retail sales, and auto repair vehicle services. She said
Robert Pergolizzi previously was accepted as an expert witness.
Robert Pergolizzi said it was impossible to locate this use anywhere in the City. He
disagreed with the City's comprehensive plan, stating comprehensive infill criteria did
not fit this use. He said the CDB previously approved the Kauffman Tire shop in
Commercial zoning on a site shared with residential development. He said this project
was unique.
AAA representative Marlene Atkinson said AAA planned to relocate from its current
building. She said the auto vehicle space would be fully enclosed, air-conditioned, and
all repairs would be done inside. She said hours of operation would be 7:30 a.m. — 6:00
p.m. Monday through Friday and 8:00 a.m. to 4:00 p.m. on Saturdays. She said the
facility would be closed on Sundays and have no after hour activities. She reviewed
AAA's history in the area, its membership, sales, services, and community outreach
programs.
Mr. Pergolizzi said vehicle repair services would be an ancillary use. He distributed a list
of nearby vehicle repair service locations on US 19, Gulf-to-Bay Boulevard, and Drew
Street, noting several abutted LMDR (Low-Medium Density Residential). He said new
US 19 Corridor Zoning District prohibited vehicle repair services. He said the Code only
allowed auto vehicle services in the Industrial zoning district where office uses were not
permitted if greater than 25% of a building's footprint. He said the subject site on Gulf-
to-Bay Boulevard, which previously had a Saturn dealership, maintained the character
of the neighborhood, provided a transition to lower density, and was the proper location
for this infill project which combined a primary use of retail sales and office with vehicle
repair services. He said the development had a lower FAR (Floor Area Ratio) and ISR
(Impervious Surface Ratio) and larger setbacks than required, and the site was nearly 6
times larger than the minimum lot size. He submitted as part of the record a copy of the
Staff Report for the January 21, 2014 CDB meeting when the Kauffman Tire site was
approved.
Attorney Cole referenced Kauffman Tire, stating the CDB previously approved a
multiuse site with commercial and apartment uses. She said the proposed use
enhanced creative development and minimized commercial acoustics. She said the
structure was attractive and all service bays would be hidden from street view.
Party Status Holder Andrew Hupp said he owned the property, stating he had offered it
for build-to suit, not for sale. He said he had been particular re the type of business he
would accept. He said the proposed use would be an asset, comparable to the
Kauffman Tire development.

Mr. Tefft said the Kauffman Tire development was approved with the understanding that
the property would be subdivided and the vehicle repair service use would not be
adjacent to residential zoning. The adjacency in place upon approval was not a long
term issue.
Attorney Soto said many of the listed vehicle repair services distributed by Mr.
Pergolizzi were non conforming uses in place prior to updates to the Code. He said this
case was a request for spot zoning; the project was not compatible with adjacent
residential use.
Attorney Cole said Gulf-to-Bay Boulevard was a major corridor in Clearwater. She said
comprehensive infill criteria was allowed to vary use restrictions.
Mr. Tefft said comprehensive infill criteria was subject to certain criteria. Attorney Soto
reviewed restricted uses adjacent to residential properties including bars, nightclubs,
auto service stations, storage, problem uses, etc. In response to a question re
commercial uses permitted adjacent to residential zoning such as clinics, schools,
restaurants, motels, etc., Mr. Tefft said those uses had to meet landscaping and other
requirements. A previous Code permitted vehicle repair services adjacent to residential
properties. He said a permitted accessory use could use no more than 10% of a
building's footprint.
Attorney Soto objected to the submission of the January 21, 2014 CDB meeting Staff
Report as part of the record. He said the nearby Dayton Andrews dealership was a
legally non conforming use and did not justify the proposed development. The Code did
not permit comprehensive infill spot zoning.
Attorney Coles said testimony by expert witness Robert Pergolizzi and presented
evidence showed the request met Code criteria. She said it was ironic that auto
dealerships with vehicle sales were permitted to offer vehicle repair services in
Commercial zoning. She said staff had approved building permits for new Acura and
Audi dealerships last year abutting residential property, She said AAA was a great
corporate citizen that wanted to relocate to a main corridor in Clearwater. She said the
project would expand an existing economic engine.
Discussion ensued with comments that the development looked great, the back buffer
featured a block wall and road sufficiently separating residential use from the business,
he building's main business was selling insurance and travel and the positioning of the
building and the closed in auto repair business, with bays facing east and west, would
not be do heavy duty vehicle repairs.
Acting Member Hayden moved to approve Case FLD2017-08015 based on the
evidence and testimony presented in the application, the Staff Report and at today's
hearing, and hereby adopt the Findings of Fact and Conclusions of Law stated in the

Staff Report with conditions of approval as listed. The motion was duly seconded.
