STIPULATION OF PARTIES FOR THE CLOSURE OF THE CSX RAILROAD-HIGHWAY GRADE CROSSING - HENDRICKS STREET CROSSING NUMBER 626811FM STIPULATION OF PARTIES FOR THE CLOSURE OF THE CSX RAILROAD-HIGHWAY GRADE CROSSING, HENDRICKS STREET CROSSING, NUMBER 626811FM, CLEARWATER, FLORIDA The City of Clearwater (CITY), CSX (RAILROAD), and Florida Department of Transportation (DEPARTMENT) by and through their undersigned representatives enter into this Stipulation of Parties and agree to the following conditions: 1. The CITY has filed an application with the DEPARTMENT for a permit to close a public railroad-highway grade crossing, pursuant to Section 335.141(1), Florida Statutes (F.S.) and Rule 14-57.012, Florida Administrative Code (F.A.C,), attached as EXHIBIT "A." 2. The public railroad-highway grade crossing, Crossing Number 626811F, (hereinafter "the crossing") is located at Railroad Milepost SY874.55, Hendricks Street, Clearwater, Florida, as shown on the map, attached as EXHIBIT URI' S. The railroad tracks at the crossing location are classified as a main line with one through train and two switching trains per day, traveling at a maximum speed of ten miles per hour. 4. Hendricks Street is a two-lane, local road. 5. The City is applying the closure of Hendricks Street toward the requirements for the establishment of a Quiet Zone. The Quiet Zone application is included in Exhibit A. 6. The RAILROAD will notify the CITY a minimum of 72 hours prior to starting any work related to the closing of the crossing. 7. The RAILROAD, at the CITY'S expense, will remove all evidence of the crossing and restore the RAILROAD right-of-way. The RAILROAD is responsible for removing all crossing warning devices, warning signs, roadway pavement, and all crossing debris inside the RAI LROAD'S right-of-way. 8. Prior to the start of the crossing's closure, the CITY, at the CITY'S expense, shall SOP 626811E CLOSURE Page 1 of 5 November 1, 2017 provide road closure notification and maintenance of traffic, and will erect, on each side of the crossing, permanent closure signs, dead end signs and object markers as identified in the DEPARTMENT'S Standard Index 17349 and shown in Exhibit "C". 9All work by the RAILROAD, DEPARTMENT, or CITY will be in compliance with the current Manual of Uniform Traffic Control Devices, incorporated by reference in Rule 14-15.010, F.A.C., the American Association of State Highway and Transportation Officials (AASHTO) Policy, and the DEPARTMENT'S current Manual of Uniform Minimum Standards for Design, Construction, and Maintenance for Streets and Highways (Florida's Green Book), incorporated by reference in Rule 14-15.002, F.A.C, and any applicable City requirements. Notwithstanding the foregoing, no CITY work will occur within the railroad-highway grade crossing area for this project. 10. All work by the RAILROAD or CITY, within the railroad-highway grade crossing area, will be in accordance with all applicable railroad requirements, such as flagging, insurance, etc. Notwithstanding the foregoing, no CITY work will occur within the railroad-highway grade crossing area for this project. 11. The RAILROAD will provide the DEPARTMENT'S District Seven Rail Coordinator with the scheduled date of work and the project completion date. 12. The RAILROAD will provide the DEPARTMENT'S Opening and Closure Program Coordinator in Central Office with the project completion date and a completed U.S. DOT Crossing Inventory form identifying the updated crossing status as closed, as attached in EXHIBIT "D". 13. This Stipulation of Parties has been executed by all parties having an interest in this matter. The RAILROAD and CITY waive the right to request an administrative hearing, provided by Chapter 120, F.S., relating to the closure of the crossing by execution of this Stipulation of SOP 626811E CLOSURE Page 2 of 5 November 1, 2017 Parties. Upon compliance with the terms of this Stipulation of Parties, DEPARTMENT, CITY AND RAILROAD agree that the Hendricks Street railroad-highway grade crossing of RAILROAD covered under this Agreement (being the railroad-highway crossing described in Section 2 above) shall be thereafter in fact be a closed railroad-highway grade crossing, in accordance with CITY Resolution 17-35 as attached in EXHIBIT"E". 14. The terms of this Stipulation of Parties may not be changed, waived, discharged or terminated orally, but only by an instrument or instruments in writing, signed by RAILROAD, CITY, and the DEPARTMENT. 15. Any failure of any party to insist upon the strict performance of any terms or provisions of this Stipulation of Parties shall in no way constitute a waiver of future violations of the same or any other term or provision of this Stipulation. 16. This Stipulation of Parties is governed by, and shall be interpreted and construed in accordance with, the laws of the State of Florida. 17. The DEPARTMENT authorizes the closure of the Hendricks Street railroad-highway at- grade crossing 526811 F as evidenced by the execution of this Stipulation of Parties, provided that all conditions of the Stipulation are met, the removal of the crossing surface and signs are completed within twenty-four (24) months of the execution, and the completed closure project is inspected and approved by the DEPARTMENT. Fig-liga-Department 4.1 Approve acceptance of U.S. Department of justice, National Institute of Justice (NIJ) Grant Award in the amount of$30,671 for funding for Clearwater Pofice Department's (CPD) Cold Case Team Project and authorize the appropriate officials to execute same. (consent) On May 7, 2014, CPD was granted approval by the Resource Management Committee to submit a grant application for fundwilg of the department's Cold Case Team Project. The giant has been officially awarded and CPD now seeks approval to accept it. CPD currently has a total of 20 cold homicide cases that have the potential for beiN solved with DNA evidence. These cases reach as far back as 1968 and extend forward to 2008. The families and victims are still awaiting justice and closure. Like most other law enforcement agencies with numerous unsolved cases, CPD is operating under staff shortages, budgetary restrictions and heavy caseloads leaving her the time nor resources available to identify, review and prioritize violent crime cold cases that have the potential to be solved using DNA analysis. As a result, cold cases are unable to be pursued as vigorously as desired. Unwilling to give up on cold cases entirely, CPD created a Cold Case Unit in January 2012, consisting of members of the department's Homicide Unit and a retired law enforcement officer who volunteers his time to assist in working cold cases. The Cold Case Unit has had astonishing success in the short time that it has been operational, solving five cold cases in less than two years. The grant funding in the amount of$30,671 from NIJ will allow CPD to enhance its existing Cold Case Unit and solve even more cases with additional overtimeffringe benefits for case and evidence review. The funding for overtime will allow the Unit to devote the additional time necessary for cold cases while still attending to more recent crimes. There will be no additional FTE's or match assodated with this grant. Special project number 181-99209, Clearwater Cold Case Team Project 2014, will be established to account for the grant expenditures. In response to a question, Police Major David Dalton said the cold case unit already exists, the grant funds will provide additional resources for employee expenses. The grant period is for eighteen months. S.-Engineering 5.11 Approve revised Florida Department of Transportation (FDOT) Traffic Signal Maintenance and Compensation Agreement, which allows the City to be financially reimbursed by FDOT for maintaining state traffic signals on the state highway system within the City limits and authorize the appropriate officials to execute same. (consent) May 15, 2014, City Council executed the new FDOT Traffic Signal Maintenance and Compensation Agreement which replaced the existing agreement that had been in place between FDOT and the City for several years. Shortly after the distribution and execution of the new agreement, FDOT revised the new agreement to address issues regarding traffic signal mast arms. Traffic Operations staff took part in meetings with FDOT and is now aware of and supports the changes in the revised maintenance agreement. FDOT has once again requested that all maintaining agencies approve the revised maintenance agreement and return two executed copies to FDOT. The revised maintenance agreement still allows the City to be reimbursed for maintenance performed by the Traffic Operations Division on the state's traffic signals within the City of Clearwater. In response to questions, Traffic Operations Manager Paul Bertels said prior to 200 1, cities were not reimbursed for maintaining state traffic signals. The City Manager said FDOT will be mandating the flashing amber turn arrow statewide. Mr. Bertels said drivers can,make the turn when the turn arrow is flashing yellow or a solid green arrow. 5.2 Provide direction on the establishment of a Quiet Zone along the CSX railroad corridor through the City of Clearwater by reviewing various options and associated cost estimates. (WSO) Under the Federal Railroad Administration's(FRA)Train Horn Rule, locomotive engineers must sound the in horn in advance of all public grade crossings. To mitigate the impacts of the high decibel train horn,the FRA of the option of establishing a quiet zone. For crosswigs within a quiet zone the CSX locomotive engineer would cease sounding the train horn at public grade crossings unless an emergency situation arose. Establishing a quiet zone requires that the City go through a process which includes but isn't Urnited to* idenWng the crossings,determining if we wish to eliminate any crossings, obtaining the approval of all Wevant jurisdictions, using the FRA's Quiet Zone Calculator to detennine and compare the Quiet Zone Risk Index(Q I)with the Nationwide Significant Risk Threshold (NSRT) with associated costs estimates, and determining which Supplementary Safety Measures(SSM)to apply. Traffic Operations staff has used the quiet zone calculator to propose and evaluate several scenarios with various SSMs such as closing specific crossings, making certain roadways one-way, employing quad gates, constructing rnedians to avoid driving around the railroad arms,etc. Below are the options that are being proposed. Options 2 and 3 from the Quiet Zone Calculator are not being proposed since they were determined to be infeasible. Option 1- Belleair Road to Keene Road($1,267,000) Option 1A: Belleair Road to Keene Road($175,OW) Option 113: Belleair Road to Fairwood Avenue($W,000)-Covers all crossings within the city limits. On the average, two trains that go through downtown during daylight hours. Mr Berfels said the train also runs through downtown at night. The implementation schedule is expected to be 2-3 years.
