AMENDMENT NO 1 TO ENTERPRISE SERVICES AGREEMENTKUBRA
AMENDMENT No. 1 TO ENTERPRISE SERVICES AGREEMENT
This Amendment No. 1 to the Enterprise Services Agreement is made effective as of
October, 2017 and is between KUBRA Data Transfer Ltd. (the "Provider") and City of Clearwater
(the Customer").
WHEREAS Provider and Customer, entered into an Enterprise Services Agreement
dated June 19, 2017 (the "Agreement");
services;
AND WHEREAS the parties wish to amend the Agreement to reflect changes to the
NOW THEREFORE the parties hereto, for good and valuable consideration, the receipt
and sufficiency of which are hereby acknowledged, agree as follows;
1. Defined Terms. Capitalized terms used in this Amendment No. 1 and not otherwise defined
herein shall have the respective meanings attributed to them in the Agreement.
2. Amendments to the Agreement,. The Agreement is hereby amended by:
(a) All references to AmEx will be deleted.
(b) The language concerning The $1000 threshold referenced in Appendix A shall be
understood to mean that the maximum amount for any single card payment on an
account will be $1,000, and further that a customer may make 2 or more card payments
on an account provided the maximum amount does not exceed $2000 over 26 days.
3. Effect on Agreement. Except as specifically amended by this Amendment No. 1, the Agreement
shalt remain in full force and effect.
4. Counterparts. This Amendment No. 1 may be executed in any number of counterparts
(including by way of facsimile or email) and all of such counterparts taken together shall be deemed to
constitute one and the same instrument.
