The Chair called the meeting to order at 1:00 p.m. at City Hall, followed by the Pledge of
Allegiance.
To provide continuity for research, items are in agenda order although not
necessarily discussed in that order.

Member Allbritton moved to approve the minutes of the August 15, 2017 Community

F. CONSENT AGENDA: The following case is not contested by the applicant,
staff, neighboring property owners, etc. and will be approved by a single vote

1. Case: FLD2017-06008 — 607 Spruce Avenue Level Two Application

Location: 1.37 acres located generally at the northeast and northwest corners of
Spruce Avenue and Maple Street.
Request: The Community Development Board is reviewing a detached dwelling
development to be located in the Downtown (D) District and the Old Bay character
district of the Clearwater Downtown Redevelopment Plan. The site consists of nine
parcels addressed as 603, 6057 6077 609 and 611 Eldridge Street, 601, 6037 6057
and 607 North Garden Avenue, 604, 6067 608 and 610 Blanche B. Littlejohn Trail
and 605, 6067 6077 608 and 609 Spruce Avenue. The proposal includes 12 detached
dwelling units and requests allowable flexibility with regard to use (Section 2-903.D).

Member Anuszkiewicz moved to approve Case FLD2017-06008 on today's Consent
Agenda based on evidence in the record, including the application and the Staff Report,
and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff
Report, with conditions of approval as listed. The motion was duly seconded and carried
unanimously. Alternate Member Haydon did not vote.
G. LEVEL TWO APPLICATIONS (Items 1):
1. Case: FLD2017-07010 — 400 Mandalay Avenue Level Two Application

Request: The Community Development Board is reviewing the renovation of the
existing patio and beach stand, and addition of a new event space in the Tourist (T)
District for the property located at 400 Mandalay Avenue (Hilton). The project
requests allowable flexibility from setback requirements (Sections 2-803 and 3-905).
Neighborhood Associations: Clearwater Neighborhoods Coalition; Clearwater
Beach Association.

Linda Darwish, Mandalay Beach Club property manager, requested Party Status.
Member Boutzoukas moved to grant Linda Darwish Party Status.
Member Allbritton moved to accept Robert Tefft as an expert witness in the fields of
zoning, site plan analysis, code administration, and planning in general. The motion was
duly seconded and carried unanimously.
Senior Planner Robert Tefft reviewed the Staff Report. The City received 5 emails re
noise complaints, concerns the project would increase noise, and requests that the
property mitigate sound or curtail noisy activities. He said the project would replace
structure and not add space for additional activity. In response to a question, he said
contacting the police was the typical course of action for noise complaints.
Rob Eckel, representing the applicant, said a concrete deck would replace the wooden
one, a new roof structure would be built, the deck's north and east side would be
screened, and the upper portion would be open. He said a structural engineer would
design the screens.
Carlos Sanchez, general manager of the Hilton Hotel, said the property owner,
architect, and audio/visual engineers intended to consider neighbor noise complaints.
He said the hotel wanted to minimize noise to neighbors and would do something to
mitigate it; project materials would be more sound absorbent. He said to minimize
sound, the band and DJ were moved to the south and speakers were positioned to face
the gulf. He said the audio/visual engineer would determine how music bounces and
position speakers to minimize noise. He said the property owner would determine steps
to be taken to minimize noise. In response to a question, he said 90% of events ended
by 10:00 p.m.; a few continued to 10:30 or 11:00 p.m.
Discussion ensued with recommendations the hotel install a kill switch activated when
noise levels exceeded 65 decibels, add an acoustic fence designed to reduce noise by
approximately 28 decibels, or present a sound mitigation plan to planning staff for
approval.
Concerns were expressed that police answering noise complaints wasted City
resources, it was burdensome for those who complained to meet with police in the

lobby, police were required to make subjective decisions re noise volume, and the hotel
had a history of unhappy neighbors complaining about excessive noise.
Attorney for the Board Jay Daigneault said the Code did not specify a permitted
maximum decibel level and did not direct the board to evaluate noise levels when
considering setback requests.
General Standards' criteria for Level Two approval in section 3-914(A)6 were cited,"The
design of the proposed development minimizes adverse effects, including visual,
acoustic and olfactory and hours of operations impacts, on adjacent properties."
Party Status Holder Linda Darwish said she was presenting 41 petitions expressing
concerns proposed renovations likely would increase attendance and noise levels,
requesting the City require reductions to current noise levels, and listing Mandalay
Beach Club goals: 1) police protect and serve rather than respond to noise complaints;
2) residents be able to enjoy their homes without increasing noise levels; and 3) the
Hilton and similar facilities respect Clearwater Beach residents' privacy and rights.
In response to a question, Mr. Tefft said the agenda item request was to reconstruct
current space and not for new event space. Project plans submitted to the City had no
sound mitigation measures.
Mr. Sanchez said the project would have no new event space and would not expand the
2nd level space. A deck on the south side of the building by the parking lot will be
enlarged to add seating for Coasters Bar.
Planning & Development Director Michael Delk said his email to Ms. Darwish stated it
was not apparent that replacement of existing improvements would result in any
demonstrable change to what the Hilton may or may not choose to do as a business
practice.
Discussion ensued with comments that the proposal was consistent with Code, public
concerns needed to be considered, the Hilton should be a good neighbor, and a
condition of approval should require sound mitigation approved by staff to reduce noise
to the north.
Member Lau moved to approve Case FLD2017-07010 based on the evidence and
testimony presented in the application, the Staff Report and at today's hearing, and
hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report
with conditions of approval as listed subject to an additional condition of approval that
during the design review process planning staff is satisfied that the design of the
proposed development minimizes adverse effects, including visual, acoustic and
olfactory and hours of operations' impacts on adjacent properties as stated in section 3-

914(A)6 of the General Standards. The motion was duly seconded and carried
unanimously. Alternate Member Haydon did not vote.
DIRECTOR'S REPORT
Mr. Delk referenced the Crabby Bills building on Clearwater Beach, stating some of the
design was modified with City approval to substantially meet the site plan presented to
the CDB (Community Development Board). The art piece was being fabricated.
Discussions were underway to add a mural to the back of the building as an art
component. Once the art piece is in place, the City will issue a permanent CO
(Certificate of Occupancy).
Mr. Delk said the developer of the affordable housing development on Woodlawn Street
thought he could meet the condition of approval re tree mitigation approved by the CDB.
The Parks & Recreation Department was not comfortable with additional plantings at
the abutting park. The item will return to the CDB if the tree mitigation requirement
cannot be met; staff could not modify a condition of approval.
