LLC. 714 North Fort Harrison Avenue Clearwater, FL 33755 RE: Development Order regarding case FLS2005-02016 at 500 North Fort Harrison Avenue. Dear Mr. Coates: This letter constitutes a Development Order pursuant to Section 4-202.E of the Community Development Code. On March 25, 2005, Development Review Committee (DRC) reviewed your application for Flexible Standard Development approval to renovate a building and replace an existing vehicular sales and services establishment (a prohibited use within the Downtown Plan area) with an office within the Downtown District under the provisions of Section 2-902. The exterior of the building will be renovated with awnings (SW 6601 - Tanger) and painted SW 2865 - Classical Yellow and SW2831 (Classical Gold) (main body), SW 2817 (Rockwood Amber) and SW6649 (Tango) (accent -above and below storefront window, etc.) and SW 7104 (Cotton White) (trim) (all colors Sherwin Williams). The color of the awnings will be the color of the fabric and not painted on. Additional improvements to the site will include the removal of all attached and freestanding signage, window stickers, wall-mounted air conditioner units (and openings filled), weeds and debris and all vehicles for sale. Finally, existing beds will be landscaped. This differs from the original application which included the removal of additional paving and the installation of a more extensive landscape plan. The DRC recommended approval of the application with the following bases and conditions: Bases for Approval: 1. The proposal complies with other standards in the Code including the General Applicability Criteria per Section 3-913. 2. The proposal is in compliance with the Vision, Goals, Objects and Policies of the Clearwater Downtown Redevelopment Plan and the Downtown Core character district. 3. The proposal is consistent with the Design Guidelines. 4. The development is compatible with the surrounding area and will enhance other redevelopment efforts. That all other future changes to the exterior of the building be reviewed by Staff for compliance with Downtown Design Guidelines and all applicable Code requirements. 2. That all signage meet the requirements of Code and be limited to attached signs on the canopies or attached directly to the building and be architecturally-integrated with the design of the building with regard to proportion, color, material and finish as part of a final Comprehensive Sign Program package (as required) submitted to and approved by Staff prior to the issuance of any sign permits which includes that: . All signs be designed as part of an overall theme that respect, enhance and contribute to the architectural style, detailing and elements of a building; . All signs consist of design, colors, materials, size, shape and methods of illumination which reinforce the overall design of the fa<;ade; . All attached signs are installed so the method of installation is concealed or made an integral part of the design of the sign; . All wall signs be located on flat, unadorned parts of a fa<;ade such as the horizontal band between the storefront and second floor or on windows, awning flaps, fascia, etc.; . That all signs meet the requirements of Code and the Design Guidelines; and . The letter size, letter and word spacing, font style and other design elements of all signs create an overall high quality aesthetic appearance. I concur with the findings of the Development Review Committee and, through this letter, approve your application for Flexible Standard Development with the above two conditions. The approval is based on and must adhere to the application, paint samples and photographs dated received February 10 and 24,2005 and supplemental photographs dated received May 19,2005. The issuance of this Development Order does not relieve you of the necessity to obtain any building permits or pay any impact fees that may be required. In order to facilitate the issuance of any permit or license affected by this approval, please bring a copy of this letter with you when applying for any permits or licenses that require this prior development approval. Foundation plantings shall be provided for 100% of a building facade with frontage along a street right of way, excluding space necessary for building ingress and egress, within a minimum five foot wide landscaped area composed of at least two accent trees (or palm equivalents) or three palms for every 40 linear feet of building facade and one shrub for every 20 square feet of required landscaped area. Add an island at the north end of the parking spaces along Ft. Harrison in order to reduce the sidth of the curb cut. Landscape 10% Interior Condi Met Per Section 3-1202.E.1 Code requires a minimum of 10% interior green space of gross vehicular use area or 12% of gross vehicular use area if parking spaces area greater than 110% of the required parking. Interior islands shall be designed so that in most cases no more than 10 parking spaces are provided in a row. Interior islands shall be a minimum of 150 sq. ft., and be 8l, of green space from back of curb to back of curb. Landscape Curbing Condition Met Per Section 3-1204.0. all landscaping must be protected from vehicular and pedestrian traffic by the installation of curbing and wheel stops, or other protective devices along the perimeter of any landscaping which adjoins vehicular use areas and sidewalks.
