NOTICE OF ANNEXATION REVIEW SCHEDULE

Dear Ms. Bartlett and Ms. Brown:
The City of Clearwater is now initiating action to officially annex the property at 1827 Winwood
Drive (Parcel Number OS-29-16-98470-000-0070) into its jurisdiction under an Agreement to
Annex (a copy of which was mailed to you on April 1, 2010). The annexation process includes
public hearings and consideration of final approval by the City Council.
This letter is to notify you of the upcoming schedule for the review of this annexation by the City
Council as follows:
City Council (first reading of the ordinances) — Wednesday, August 18, 2010 at 6:00
PM — Meeting to be held in the City Council Chambers on the 3`d Floor of City Hall at
112 S. Osceola Avenue.
City Council (second reading of the ordinances) — Thursday, September 9, 2010 at
6:00 PM — Meeting to be held in the City Council Chambers on the 3`d Floor of City Hall
at 112 S. Osceola Avenue.

NOTICE OF ATA ANNEXATION
Dear Ms. Bartlett and Ms. Brown:
As you may be aware, previous property owner Tam Bay Developers, Inc. entered into an
Agreement to Annex (ATA) with the City of Clearwater on October 23, 1995. In accordance with
the provisions of this agreement, the City of Clearwater will be initiating an action to officially
bring your property, located at 1827 Winwood Drive (Parcel No. OS-29-16-98470-000-0070), into
its jurisdiction. This letter shall serve as 60 days written notice of the City's intent to annex this
property in accordance with the terms and conditions established in that ATA. The City will then
proceed with the action to annex this property. A copy of the ATA Agreement under reference is
enclosed for your convenience. The ATA is considered an application to annex and no further
application is needed from you to start the annexation process.
The benefits of annexation are many, including improved police and fire response, reduced rates
for utilities, city recreation programs, and garbage collection. An information sheet is also
enclosed for your convenience. The City of Clearwater looks forward to having you as a resident
and hopes you find this annexation beneficial.
The proposed public hearing meetings schedule will be sent to you immediately after the

WITNESSETH:
WHEREAS, the Owner now owns the following described real
property, located outside the municipal boundaries of the City of Clearwater:

-���-� -�' WHEREAS, the Owner desires to connect to the City sewer main and is agreeable to sigoing an
�� ��Agreement with the City for municipal sewer service; and
. __,___.�. WHEREAS, the City is agreeable to fumishing sewer service upon certain conditions and considerations;
--�-�1� NOW THEREFORE, the parties hereto hereby covenant and agree as follows:
�����v The �ity agrees to provide sewer service, subject to the terms of this Agreement, and to permit the
Owner to connect to its sewer main at the Owner's expense.
2. The Owner agrees:
(a) to pay the appropriate annexation fee when this Agreement is submitted for processing;
�b) to pay normal sewer connection charges and monthly sewer service charges to the City on the
same basis as sewer users outside the municipal boundaries are charged, as set out in the Code of Ordinances
of the City, until the property is annexed;
(c) that all �ecreation land, recreation facilities and open space land dedication and fees will be due
upon annexation in an amourrt and manner as prescribed in Sections 1 16.40 through 1 16.51, Code of Ordinances.
In particular, the owner shall either:
(1) pay the required recxeation facilities fee if this is the only fee require at the time this Agreement
is submitted for processing, or
12) place in escrow a deed transferring title to land or a promissory note made payable to the City
of Clearwater, or both as req�ired, such deed and promissory note, copies of which are attached
hereto as F�chibit A(if applicable) to be conveyed or paid prior to the second ordinance reading
effectuating the annexation of the subject property;
!dl that at such time as it becomes possible for the City to annex said real property, this Agreement
will consiitute an application to annex at that time, and the City will have the right, upon sixty �60� days written
notice to the property owner, to initiate action to annex the property to the City;

(e) that it is to the mutual benefit of the Owner and the City, in recognition of the eventual
incorporation of the properry within the City, to have site and buifding plans reviewed and accepted by the City
in advance of obtaining any requisite permit from Pinellas County. Acceptance of such plans shall precede the
execution of this Agreement by the City and any construction on this property shall comply with the applicable
building and fire codes in effect in the City of Clearwater;
(f) that all of the property described above shall be deemed a single parcel subject to annexation as
provided herein, and any subparcels of the property described above which are created by subdivision or by any
other means shall be included for the purposes of the subsequent annexation procedure, subsequerrt sale and
individual ownership notwithstanding;
(g) that the terms and provisions of the Agreement shall be a commitment and obligation which shalt
not only bind the preserrt owner of said described rea{ property, but shall be a covenant which shall run with the
land and shall bind and be entorceable against the heirs, successors and assigns of the Owner; and
(h) if the Owner or the heirs, successors, and assigns of he Owner, shaU default in the performance
of the terms and provisions of this Agreement, and the City shall institute legal proceedings to enforce #he terms
and provisions hereof, the Owner or the heirs, successors and assigns of the Owner shall pay all costs of such
proceedings including the payment of a reasonable attorney's fee in connection therewith.
3. The City shalt not be liable for any damage resulfing from any unavadable cessation of service
caused by Act of God, necessary mairYtenance work, or any cause beyond the control of the City.
4. All notices to be furnished hereunder shall be furnished to the City of Clearwater, to the City
Manager, P.O. Box 4748, Clearwater, Florida, 34618-4648 and to the owner at the post office address for the
property described above, at any other address which may be furnished by the Owner from time to time, or at the
address for the Owner according to the property tax rolls of Pinellas County, Florida.
5. This Agreement shall be recorded in the public records of Pinellas Courrty, Florida.
