CALL TO ORDER, INVOCATION, PLEDGE OF ALLEGIANCE The Chair called the meeting to order at 1:00 p.m. at City Hall, followed by the Pledge of Allegiance. To provide continuity for research, items are in agenda order although not necessarily discussed in that order. B. ROLL CALL: C. APPROVAL OF MINUTES OF PREVIOUS MEETING: April 18, 2017 In reference to page 7, it was stated Member Allbritton made the motion to approve. Member Lau moved to approve the minutes of the April 18, 2017 Community Development Board meeting as amended. The motion was duly seconded and carried unanimously. Alternate Member Haydon did not vote. D. CITIZENS TO BE HEARD RE ITEMS NOT ON THE AGENDA: None. E. REQUEST TO CONTINUE TO JUNE 20, 2017 MEETING: (Item 1) 1. Level Three Application Case: TA2017-01001 —Amendments to Clearwater Community Development Code Applicant: City of Clearwater Request: The Community Development Board is reviewing a request to amend the Community Development Code to establish a new medical marijuana treatment center use and applicable criteria, and making a recommendation to the City Council. Neighborhood Association: Clearwater Neighborhoods Coalition Presenter: Kyle Brotherton, Senior Planner Member Allbritton moved to continue Case TA2017-01001 to a date uncertain. The motion was duly seconded and carried unanimously. Alternate Member Haydon did not vote. G. CONSENT AGENDA: The following case is not contested by the applicant, staff, neighboring property owners, etc. and will be approved by a single vote at the beginning of the meeting: (Item 1) 1. Level Three Application Case: TA2017-03005 —Amendments to Clearwater Community Development Code Applicant: City of Clearwater Request: Review and recommendation to the City Council, of an amendment to the Community Development Code regarding signage. Neighborhood Association: Clearwater Neighborhoods Coalition Presenter: Gina Clayton, Assistant Planning and Development Director Member Anuszkiewicz moved to recommend approval of Case TA2017-03005 on today's Consent Agenda based on evidence in the record, including the application and the Staff Report, and hereby adopt the Findings of Fact and Conclusions of Law stated in the Staff Report. The motion was duly seconded and carried unanimously. Alternate Member Haydon did not vote. Clearwater Beach Crabby Bill's restaurant project It was stated in December 2015, the Community Development Board approved the Clearwater Beach Crabby Bill's restaurant proposal as it was presented with high quality exterior cladding materials, minimal stucco, and art work. Community Development 2017-05-16 2 Concern was expressed the completed project bore little resemblance to the board approved design; upscale exterior materials were replaced with stucco, the central art piece was missing, and the heavily landscaped north border was damaged. Planning & Development Director Michael Delk said the City issued a temporary CO (Certificate of Occupancy); final inspections were required. The applicant had not requested approval for the architectural changes. The City issued a Stop Work Order and letter indicating the project was in default. The applicant reported costs for internal upgrades had to be offset by external design alterations. While the restaurant had a long -term lease, the City owned the property and building. Following a meeting with the applicant and Crabby Bill's representative in the next week or two, the City will respond to a new proposal. Concerns were expressed the building was a focal point at the entrance to Clearwater Beach, its exterior was important to the City, and approval was based on architectural details such as external wood cladding and an art piece incorporated in the design.
